Made on 3 December 1996.


Come into force on 1 January 1997.
Apply to safety and health committee (SHC) established under section 30 of
OSHA 1994.
Have 6 parts and 32 sections:

INTERPRETATION:
Term

PART I: PRELIMINARY
Explanation on the citation, commencement, interpretation, application, and duties of
employers.
The employers must comply with Parts II and III of these regulations, and ensure that
Parts IV and V are complied with.

PART II: COMPOSITION OF SHC


SHC shall consists of:
1) Chairman Employer/authorized manager
2) Secretary Safety and health officer
3) Representatives of employers - Appointed by employer
4) Representatives of employees Nominated by employees or appointed by
employer

Removal of member of committee:
1)
Fails to attend 3 consecutive meetings of the committee without leave of the
chairman.
2)
Found/declared to be of unsound mind.
3)
Bankrupt.
4)
No longer employed at the place of work.
5)
There has been proved against him or he has been convicted on, a charge in
respect of:
a)
An offence involving fraud, dishonesty or moral turpitude.
b)
An offence under a law relating to occupational of safety and health.
c)
Any other criminal offence.
6)
Unable/incapable of discharging his duties as a member of the committee.

PART III: FUNCTIONS OF SHC
Functions of committee:
1) Assist in the development of safety and health rules and safe systems.
2) Review the effectiveness of safety and health programs.
3) Carry out studies in the trend of accident, near-miss accident, dangerous
occurrence, poisoning or disease, and report to employer of any unsafe or
unhealthy condition/practices with recommendations for corrective actions.
4) Review the safety and health policies, and make recommendations for any
revision.
Inspect the workplace at least once in every 3 months.
Investigate the cause of the accident and recommend measures to prevent
reoccurrence.
Make a report or recommendations and direct any employee to take action as the
employer/authorized manager deems necessary.

When performing its functions, consider safety audits and reports from safety and
health officers and government agencies.
Investigate the complaint from employees and make recommendations.
Assist an employer in any competition, talk and activity on safety and health.
Rules on safety and health:
1) An employer, in consultation with SHC, shall prepare and promote rules on safety
and health.
2) The rules may be amended, varied or rescinded by the committee with
employers approval.
3) The employer shall furnish to each of his employees a copy of the rules.
4) An occupational safety and health officer shall be given a copy of the rules when
so requested.
May form sub-committee for assistant.

PART IV: MEETINGS OF SHC

Explanation on the frequency of meetings of committee, the duty of employer to provide


a place for meeting, inaugural meeting in which employer shall inform his safety and
health policies, plans and proposals; quorum of meeting, attendant of non-member,
matters to be discussed, and minutes of meeting.

PART V: PROVISIONS OF TRAINING AND INFORMATION

Explanation on the duties of employer to ensure basic knowledge and functions of


committee, provide adequate training, as well as make available relevant document and
information except for information regarding national security, prohibition imposed
by/under any law, relating to specific individual, effect on health, safety or welfare at
work, and for the purpose of instituting, prosecuting or defending any legal proceedings.

PART VI: PENALTY

A fine not exceeding RM5000 or to imprisonment not exceeding 6 months or to both.
