IMPLEMENTATION

OF
CONSTRUCTION SAFETY AND HEALTH PROGRAM
(CSHP)
IN THE WORKPLACE
(ORIENTATION ON THE PROVISIONS OF THE MOA AND JAO NO.
1 SERIES OF 2011)

OBJECTIVES OF CSHP ORIENTATION:


1. To encourage participants promote a culture of Safe
and
Healthful workplaces in the field of Construction
Industry.
2. To promote a Zero Accident Program.
3. To know the process flow in the preparation and
approval of Construction Safety and Health Program
(CSHP) for every Construction Project.
4.
To
know
some
issuances
(Memos/DOs/AOs/Agreement) and the implementation of
D.O. 13.
5. To formulate a local agreement regarding the issues
and concerns on Construction Safety and Health Program.

I. Introduction:
Pursuant to Art. 162 of the Labor Code of the
Philippines
as
amended
and
in
line
with
implementation of the DOLE Rationalization Program,
a Guidelines was issued for a strict implementation
which also decentralize the evaluation and approval
of the Construction Safety and Health Program
(CSHP-section 5 of D.O. no. 13 ) to the DOLE Regional
Offices.
On April 7, 2011, a Memorandum of Agreement
was entered into by and among the five (5)
government agencies (DOLE, DPWH, DTI-CMDF/PCAB,
DILG and PRC) to strengthens their coordination and
linkages in order to promote the welfare of the
Construction Workers and the growth of the
Construction Industry.

II. Guiding Principles:


On May 11, 2011 a Joint Administrative Order
no. 01 series of 2011 was issued for strict
implementation of the MOA. The Commitment,
agreements and responsibilities among the
collaborating agencies as specified in the
aforementioned MOA to include other related
programs and activities with the end view of
ensuring proper coordination and harmonization of
policies and programs to ensure safety and health
of the workers in the construction industry.
The programs and activities covered by this
Joint Administrative Order (JAO) shall complement
the relevant provisions of the following policy
guidelines of the collaborating agencies:
DPWH- Department order no. 56 s 2005
( Guidelines for the implementation of D.O. no. 13
s 1998) and constructors Performance Evaluation
System-Implementing Unit (CPES-IU)

DILG- Memorandum Circular 2004-65, 2004-65A and


2008-113 on the Civil Applications Systems, requiring
Local Government Units to ensure that all contractors,
sub-contractors and specialty contractors are to
secure first a license from PCAB prior to the granting
of business permit to engage in construction business.
DTI-CMDF/PCAB- Republic act no. 4566
( Contractors licensing Law ), Presidential Decree no.
1746 ( Construction Industry authority of the
Philippines, CIAP Law and other applicable trade and
industry laws, rules and regulations.

PRC- Republic Act no. 8981-PRC Modernization


Act of 2000 specially on strengthening PRCs
enforcement power.

DOLE- Labor Standards Enforcement Program (LSEP),


Department Order no. 13 series of 1998 ( Guidelines
Governing OSH in the Construction Industry) and other
related policies, rules and regulations on construction
safety and health. The DOLE enforcement procedures
shall be followed in coordination with concerned
agencies to ensure the efficient monitoring of
contractors compliance with Labor Standards including
OSH Standards and D.O. no. 13 series of 1998.
Also, the implementation of the Anti- red tape Act of
2007 (RA 9485) to effectively eliminate bureaucratic red
tape and improve efficiency in the delivery of
government
services.
For
these
purpose,
the
requirements being implemented by the concerned
agencies shall not be duplicated but shall be
strengthened
with
a
harmonized
issuance
of
permit/license

DILG Memorandum Circulars 2004-65 and 65A requiring all
contractors, sub-contractors and specialty contractors to secure
first a license from PCAB before engaging in any construction
activity in the country.

implementation of D.O. 13 and the OSHS.
Likewise, it shall assist in the monitoring
and inspection of worksites.

Section 5 -Inter-agency Action


Plan

The DOLE through the BWC, in coordination


with the concerned agencies,
shall
be
responsible for the development of an interagency action plan and shall act as
the
coordinating office relative to the inter-agency
activities..
There shall be a periodic review of the action
plan to conform to the developments in the
construction industry.
