DIFFICULTY IN THE
APPLICATION OF THE LAW
1. No accountability for
not investigating Not to investigate a
complaint of torture
is very common. The
absence of any sort
of accountability by
investigating bodies
is not seen as
anything wrong.
2. Excessive delay in
investigation and
even when the
complaint is
Investigated, the
completion
requirement of 60
days for the
investigation never
happens
3. No
protection to
victims and
their families
The lack of
complaint of
torture does
not mean there
are no cases of
torture.
4. Inability and
unwillingness
to identify and
locate alleged
perpetrators is
a significant
impediment to
ensuring justice
for torture
victims.
5. Distorted
interpretation
of the crime of
torture -
In spite of the
United Nations,
Amnesty
international and
the Geneva
Convention, torture
is still practiced all
over the world
today, most often
by all kinds of
governments, may
they be
democratically
elected or not
