ANNUAL VERIFICATION

1. REFERENCES

a. IRR of PD 1866, as amended by RA 8294;


b. Section 897 of the Revised Administrative Code;
c. LOI 49/09 Bilang- Boga dated June 23, 2009;
and
d. PC-INP Circular No. 2 (Annual Verification of
Firearms) dated September 11, 1990.
e. PNP MEMO CIRCULAR NO. 2012-016: Revised
Guidelines in the Annual Verification of Firearms.

2. SCOPE

This Memorandum Circular sets the guidelines for


the conduct of HOUSE VISITIATION OR ANNUAL
VERIFICATION of all registered firearms license/s
(individual and juridical) of which unrenewed firearms
licenses shall be given priority.

3. PURPOSES
a. To conduct physical accounting of all registered firearms;
b. To find out the reason why the licensee is no longer renewing his
firearm/s license/s;
c.

To revoke/cancel firearms licenses that are considered beyond


possibility of renewal due to the status of firearm or the licensee
after verification by and
due endorsement from police
units/offices, other law enforcement agencies, prosecutors and
courts;

d. To be able to disaggregate from the Firearms Information


Management System (FIMS) all firearms licenses that are already
cancelled/revoked; and

STEP 1. Upon receipt of the list of holders of unrenewed firearm
licenses, local authorities (Police Stations) shall notify through letter all
the registered holders of the expired firearm licenses within their
respective Area of Responsibility (AOR). House visitation will be
conducted to the licensee for the inventory of the firearm/s. PNP
Personnel conducting House Visitation should be assisted by Local
Officials (Barangay Officials) who will also stand as witnesses to the
activity

Step 2. The inspector, with due courtesy, shall inform the firearm license
holder, the nature of visitation in accordance with the implementation of
Annual Verification of Firearms (Memorandum Circular no. 2012-016).
The Inspector must also inform the licensee that failure to present the
firearms and its license is a breach of conditions for the issuance of
license shall be ground for revocation of license. The inspector, then, shall
request the firearm license holder to present the firearm and firearms
license/s for checking.
Government entities and private firms will likewise be inspected and shall
go through the same process requiring them to present the Long
Certificate of Registration (LCR), Short Certificate of Registration (SCR)
and Long Regular License (LRL), Short Regular License (SRL)
respectively;

Step 3. The inspector shall reiterate and remind the licensee that his/ her
firearm license is already expired. The inspector will thoroughly check the
data of the firearms and make sure that the description reflected on
the license card matches the firearm description provided by FEO. If,
there is a discrepancy in the firearm and the license card, the inspector will
note it to the Certificate of Verification. Also, Letter of Undertaking
provided by the inspector shall be signed by the licensee indicating therein
his/her willingness to renew his/her license the soonest;

Step 4. If the licensee decided to renew his license, he/she will be
provided by the inspector with the authorized renewal form, documentary
requirements and the instruction on where and how to renew the license .
The inspector will return to the licensee after fifteen (15) days to verify if
the license is already renewed, if not, the licensee will be given another
fifteen (15) days and failure to do so, the inspector can conduct
appropriate action as provided by law;

Step 5. Discrepancy on the description due to clerical error, transfer of
residence of the licensee and change of status/ qualification of the
licensee shall be reflected on the Prescribed Report Formats (PRFs) for
appropriate action of FEO. The following remarks (legend) shall be
applied to the Report on Annual Verification as the case maybe.
Herewith, are the possible scenario and the action to be undertaken, to wit;

- Expired License
Advised the licensee for the immediate renewal of firearm license. In the
event that the licensee decided not to renew the firearm license and just
surrender the firearm, an acknowledgment receipt shall be provided by the
inspector to be signed by the firearm holder.

LF
- Lost Firearm
Execute an Affidavit of Loss stating the reason why he/she lost the firearm
supported by an investigation report from the Police Unit which has the
jurisdiction over the case. Submit said documents to the Inspection and
Enforcement Section of Firearms and Explosives Office (I&E,FEO) for the
issuance of an Order of Payment (OP) amounting to Five Thousand
(P5,000.00) Pesos and pay the same to Land Bank of the Philippines
(E.O. 580 Administrative fine for Loss Firearm). A certification will be
issued upon compliance of the above.
SDS
- Sold through Deed of Sale
Require the vendee to facilitate the transfer of ownership of firearm at the
FEO. Under existing rules, a firearm will only be delivered to the vendee
upon approval of the application for transfer (Para IV, Sec 2 of the SOP
No. 13). A mere deed of sale does not constitute a complete transaction

CCSDAF

- Captured, Confiscated, Surrendered, Deposited and


Forfeited Firearms
The inspector shall indicate in the Report on Annual Verification the status
of the firearm/s for proper documentation at the FEO. In the event that
firearm/s is/are deposited anywhere else except FEO, the inspector shall
determine the location of the firearm/s to be turned-over to FEO-SAO for
proper disposition and safekeeping.
LD
- Licensee is Dead
In case of the death of the firearm license holder, it shall be immediately
reported by the relative to FEO for the revocation of the firearm license. In
the event that one of the heirs would like to claim possession of the said
firearm, he/ she will be advised to process the transfer of firearm at FEO
(Para X, Sec 2 [ b ] of SOP NO. 13). In case that licensee is dead and the
firearm could not be found, an affidavit will be executed by the next of kin
stating therein that the firearm cannot be located to be submitted to FEO
together with the death certificate for proper documentation.

ANE/ PF
- Address Non- Existent/ Person is Fictitious
The inspector shall indicate to the PRFs such discovery for proper
documentation at the FEO. A certification from the Local Government Unit
(Barangay) must be secured by the inspector as reference.
LTAA
- Licensee Transferred to another Address
The inspector shall indicate to the PRFs such discovery for proper
documentation at the FEO. The inspector shall secure a certification from
the Barangay that the firearm license holder is no longer a resident of the
given address to be submitted to FEO for appropriate action. It is an
indispensible duty of a license holder to notify the FEO regarding his/her
change of domicile (Sec 890 of the Revised Administrative Code of the
Philippines).
LDOF
- Licensee Denies Ownership of Firearms
Execute an Affidavit of Denial to be signed by the firearm license holder to
be submitted to FEO for investigation and appropriate action.

Step 6. If the description of the firearm on provided list of FEO does not
tally with the description indicated in the license card, a report shall be
reflected on the PRF for appropriate action of the FEO;
Step 7. Accomplishment reports with the Prescribed Report Formats
provided by the FEO will be collated and consolidated by the PROs
including the Certificate of Verification and Certificate of Inspection for
submission to FEO on a monthly basis. Acknowledgement Report must be
signed by the licensee and witnessed by a relative of the licensee and a
barangay official/tanod;
Step 8. FEO will make appropriate actions on the results of said visitation
and will render report to TDO of action taken.
