Environmental Compliance Certificate

representations of the proponent and
the preparers, as reviewed and
validated by the EIARC, the proposed
project or undertaking will not cause a
significant negative environmental
impact.

An ECC is issued by DENR-EMB after


a positive review of the projects
application.

The ECC contains specific measures


and conditions that must be met by
the project proponent before and
during the operation of the project.

An ECC also certifies that the


proponent has complied with all the
requirements of the Environmental
Impact Statement (EIS) System and
has committed to implement its
approved environmental
management plan.

Sec. 15.0 Issuance of ECC


Within 15 days from receipt of the report of
the EMB Director, unless circumstances
warrant a longer period of time, the Secretary
shall either grant or deny the issuance of the
ECC. In granting or denying the issuance of
the ECC, the Secretary shall take into account
the social and environmental cost
implications relative to the judicious
utilization, development and conservation of
the countrys natural resources.

Sec. 16.0 Transmittal of EIS Records


and ECCs
In the event that an ECC is issued,
the Secretary shall cause the
transmittal of the EIS, all pertinent
records and documents, and the ECC
to the EMB within 10 days from the
date of such issuance. The offices of
the concerned Regional Executive
Director, PENRO, CENRO, the
Municipal/City Mayor and the
proponent shall also be furnished a

Recommending ECC denial


If the IEE has been evaluated as not having
satisfied the substantive requirements, the
EMPAS may recommended denial of ECC. In
case of an ECC denial recommendation, the
following will be contained in the report to the
RED.
Identification of specific issues and comments
that have not been satisfied by the
proponent; and
Draft letter to inform proponent of ECC denial

PROCEDURE

GENERAL PROCESS
First step: for applicants
Submits application to Environmental
Impact Assessment Management
Division(EIAMD) for screening.

Second step:

Contents of the EMPAS report recommending issuance of ECC

-If the EMPAS finds that IEE has substantially


addressed all the significant impacts and
relevant issues by way of mitigation and
enhancement measures, it shall recommend
the issuance of the ECC. The report shall
include a summary description of the project
or undertaking presenting the following:

Environmental impacts and


corresponding costed mitigation and
enhancement measures;
Key issues/concerns;
Proponents response to issues;
Compliance with review criteria,
technical and substantive content social
acceptability requirements;
Acceptability of the proposed EMP

Projects that have no significant


environment impact shall not be
required to secure ECC.

In cases a Certificate of Non-Coverage


(CNC) is to be secured for the perusal
of other government agencies and/or
organizations, the above-mentioned
requirements may be submitted to the
EMB or its Regional Offices.

Description of Categories
Category A
Projects or undertakings which are classified
as environmentally critical projects (ECPs)
under Presidential Proclamation No.
2146(1981), Proclamation No. 803(1996), and
any others projects that may later be
declared as such by the President of the
Philippines. Proponents of these implemented
from 1982 onwards are required to secure an
Environmental Compliance Certificate(ECC)

Category B
Projects or undertakings which are not
classified as ECP under Category A, but which
are likewise deemed to significantly affect the
quality of the environment by virtue of being
located in Environmental Critical Area(ECA) as
declared under Proclamation 2146 and
according to the parameters set forth in the
succeeding sections. Proponents of these
projects implemented from 1982 onwards are
required to secure an ECC.

Category C
A projects or undertakings not falling
Category A or B which are intended
to directly enhance the quality of the
environment or directly address
existing environmental problems.

Category D
Projects or undertakings that are
deemed unlikely to cause significant
adverse impact on the quality of the
environment according to the
parameters set forth in the Screening
Guidelines. These projects are not
covered by the Philippines EIS
system and are not required to
secure an ECC.

Determining categories for existing projects for


expansion/modification

Existing projects that will


undertake expansion,
rehabilitation and/or
modification shall request EMB
for amendment of ECC

Major ECC amendment


The requested amendment is
considered major when the
modification is envisaged to have an
additional and significant
negative/adverse impact to
environment

Examples of Major ECC


amendments
Expansion of project area outside the
catchment or environment as
described in the original EIA Report
Increase in the project size
parameter by more than the
corresponding coverage thresholds
as indicated in Annex A

Minor ECC amendment


The requested amendment is
considered minor when modification
has no or negligible adverse impact
to environment or those that can be
addressed by existing or modified
EMP.
Also considered minor amendments
are request for change in name,
address and similar administrative
matters.

Typographical error
Extension of deadlines for
submission of post ECC requirements
Extension of ECC validity (should be
filed three months prior to expiration)
Change in company name/ownership

Projects that have stopped operation for more than 5 years are not required to obtain a new ECC provided all of the following conditions are met:

CMR/CMVR had continuously been


submitted or an official request for
suspension of the CMR/CMVR had
been approved by EMB.

No request for relief and/or


cancellation of ECC had been
approved

The resumption of operation will nit


involve expansion in terms of
production capacity(volume of
output; number of product lines) or
area

There is no change in ownership or


corporate dissolution

A project is deemed to have


stopped operation when all of
the following conditions
are met:

All production, processing or


manufacturing activities have
ceased.

The absence of any emission or


discharges except those attributed to
domestic activities of maintenance or
administrative personnel only.
