CITIZENSHIP
CITIZENSHIP
membership in a political community such as a
city or state with full and civil and political
privilege and allegiance of all members of a
political community.

ARTICLE IV SECTION 1
Section 1. The following are citizens of the Philippines:

[1] Those who are citizens of the Philippines at the time of the
adoption of this Constitution;
[2] Those whose fathers or mothers are citizens of the Philippines;

[3] Those born before January 17, 1973, of Filipino


mothers, who elect Philippine citizenship upon reaching
the age of majority; and
[4] Those who are naturalized in accordance with law.
JUS SOLI
(Latin: right of the soil)
Citizenship by virtue of place of birth regardless the
citizenship of the parents .

JUS SANGUINIS
(Latin: right of blood)
Citizenship by virtue of blood relationship.
Children follow the citizenship of parents
NATURALIZATION
The legal act of adopting a foreigner and clothing
him with the privileges of a natural born citizen.

QUALIFICATIONS FOR NATURALIZATION


1. 21 years old and above
2. 10 years continuous residency in the
Philippines
3. good moral character
QUALIFICATIONS FOR NATURALIZATION
4. real estate of more than P5,000 or lucrative trades, profession
or lawful occupation
5. must be able to speak or write English or Spanish or any one of
the principal languages6. children enrolled in a government
recognized public school
ARTICLE IV SECTION 2
Section 2. Natural-born citizens are those who are citizens of the
Philippines from birth without having to perform any act to acquire or
perfect their Philippine citizenship. Those who elect Philippine
citizenship in accordance with paragraph (3), Section 1 hereof shall be
deemed natural-born citizens.

KINDS OF CITIZENS UNDER THE CONSTITUTION:


1. Natural-born citizens
2. Citizens at the time of the adoption of this
constitution.
3. Those who elect citizenship upon the age of reason;
and
4. Those who are naturalized in accordance with the law.
ARTICLE IV SECTION 3
Section 3. Philippine citizenship may be lost or
reacquired in the manner provided by law.

Grounds for Losing Philippine Citizenship:

1. By Naturalization in a foreign country


2. By Expatriation
3. By subscribing to an oath of allegiance to
support the Constitution and law of a foreign
country;

4. By rendering service to or accepting commission in the armed forces
of a foreign country;
5.By cancellation of his certificate of naturalization by the court; and
6.By having been declared by competent authority a desertes of the
Philippine Armed Forces in time of war.

Grounds for Reacquiring Philippine Citizenship


1. By Naturalization
2. By Repatriation
3. By direct act of Congress
ARTICLE IV SECTION 4
Section 4. Citizens of the Philippines who marry aliens shall
retain their citizenship, unless by their act or omission, they
are deemed, under the law, to have renounced it.

ARTICLE IV SECTION 5
Section 5. Dual allegiance of citizens is inimical
to the national interest and shall be dealt with
by law.
