Art.XI, 1987 Constitution (Public Accountability)
Public office is a public trust. Public officers and employees
must at all times be accountable to the people, serve them
with utmost responsibility, integrity, loyalty, and efficiency, act
with patriotism and justice and lead modest lives.
The phrase public office is public trust refers to a
representative government, the officers being mere agents and
not rulers of the people, one where no one man or set of men
has a proprietary or contractual right to an office, but where
every officer accepts office pursuant to the provisions of law
and holds the office as a trust for the people.

The State shall ensure and promote the Constitutional mandate
that appointments in the Civil Service shall be made only
according to merit and fitness.
The Civil Service Commission as the central personnel agency
of the Government shall:
a) Establish a career service;
b) Adopt measures to promote morale, efficiency, integrity,
responsiveness, and courtesy in the civil service;
c) Strengthen the merit and rewards system;
d) Integrate all human resources development program for all
levels and ranks; and
e) Institutionalize a management climate conducive to public
accountability.

No officer or employee in the Civil Service shall be suspended
or dismissed except for cause as provided by law and after due
process.
The phrase for cause refers to grounds for disciplinary actions
enumerated in EO No. 292.
The procedure in administrative cases is governed by the Revised
Rules on Administrative Cases in the Civil Service (RRACCS) with
the Rules of Court being applied in suppletory character.
Investigation and adjudication of administrative complaints
against appointive local officials and employees as well as their
suspension and removal shall be in accordance with the Civil
Service Law and Rules and other pertinent laws. The results of
such administrative investigations shall be reported to the CSC.

It is the policy of the State to promote a high standard of ethics in
public service. Public officials and employees shall at all times be
accountable to the people and shall discharge their duties with
utmost responsibility, integrity, competence, and loyalty, act
with patriotism and justice, lead modest lives, and uphold
public interest over personal interest.
Norms of Conduct of Public Officials and Employees:
1) Commitment to public interest- always uphold the public
interest over and above personal interest.
2) Professionalism perform and discharge duties with the highest
degree of excellence, professionalism, intelligence, and skill.
3) Justness and Sincerity remain true to the public at all times.

Norms of Conduct of Public Officials and Employees:
4) Political Neutrality provide service to everyone without unfair
discrimination and regardless of party affiliation or preference.
5) Responsiveness to the public extend prompt, courteous and
adequate service to the public.
6) Nationalism and Patriotism shall at all times be loyal to the Republic
and to the Filipino people, promote the use of locally produced goods,
resources and technology and encourage application and pride of
country and people.
7) Commitment to democracy commit themselves to the democratic
way of life and values, maintain the principle of public accountability,
and manifest by deeds the supremacy of civilian authority over the
military

Duties of Public Officials and Employees. In the performance of


their duties, all public officials and employees are under
obligation to:
1) Act promptly on letters and requests
2) Submit annual performance reports
3) Process documents and papers expeditiously
4) Act immediately on the publics personal transactions
5) Make documents accessible to the public

RA No. 6713 Code of Conduct and Ethical Standards for
Public Officials and Employees
Prohibited Acts and Transactions. The following shall constitute prohibited acts
and transactions of any public official and employee:
1) Financial and material interest shall not have financial or material interest in
any transaction requiring the approval of their office.
2) Outside employment and other activities related thereto shall not:
a) Own, control, manage or accept employment as officer, employee, consultant, counsel,
broker, agent, trustee or nominee in any private enterprise regulated, supervised or
licensed by their office unless expressly allowed by law;
b) Engage in the private practice of their profession unless authorized by the Constitution
or law, provided that such practice will not conflict or tend to conflict with their official
functions; or
c) Recommend any person to any position in a private enterprise which has a regular or
pending official transaction with their office.
3) Disclosure and/or misuse off confidential information.
4) Solicitation or acceptance of gifts or anything of monetary value from any
person in the course of their official duties.

This Rules shall apply to all disciplinary and non-disciplinary
cases brought before the Civil Service Commission (CSC),
agencies and instrumentalities of the National government,
local government units, and government-owned or controlled
corporations with original charters except as provided by law.

The CSC shall hear and decide administrative cases instituted


by or brought before it, directly or on appeal, including
contested appointments and review decisions and actions of its
offices and of the agencies attached to it.

Decentralization of authority to decide administrative cases:
Thus, CSC Regional Office (CSCROs) are now empowered to take
cognizance of administrative cases arising within their
jurisdiction and dispose of the same up to logical conclusion,
subject only to appeal which may be taken to the CSC proper. For
this purpose, the jurisdiction of the CSC proper and CSCROs were
delineated as follows:
CSC Proper
a. Disciplinary
1. Decisions of CSCROs brought before it on petition for review;
2. Decisions of heads of departments, agencies, provinces, cities,
municipalities;
3. Complaints against CSC Proper personnel;

CSC Proper
a. Disciplinary
4. Complaints against third level officials who are not presidential
appointee;
5. Complaints against civil service officials and employees which
are not acted upon by the agencies and such other complaints
requiring immediate action, in the interest of justice;
6. Requests for transfer of venue of hearing on cases being heard
by CSCROs;
7. Appeals from the Order of Preventive Suspension; and
8. Such other actions or requests involving issues arising out of or
in connection with the foregoing enumeration.

CSC Proper
b. Non - Disciplinary
1. Decisions of CSCROs brought before it;
2. Requests for favorable recommendation on petition for
executive clemency;
3. Protest against the appointment or other personnel actions
involving third level officials; and
4. Such other analogous actions or petitions arising out of or in
relation with the foregoing enumeration.

CSCROs
a. Disciplinary
1. Complaints initiated by or brought before the CSCROs provided
that the alleged acts or omissions were committed within the
jurisdiction of the Regional Office, including examination
anomalies or irregularities and the person complained of are
employees of agencies, local or national, within the said
geographical areas;
2. Complaints involving CSCRO personnel who are appointees of
said office; and
3. Petitions to place respondent under preventive suspension.

CSCROs
b. Non - Disciplinary
1. Disapproval of appointments brought before it on appeal;
2. Protest against the appointments of first and second level
employees brought before it directly or on appeal;
3. Decisions of national agencies and local government units
within their geographical boundaries relative to personnel
actions and non-disciplinary cases brought before it on
appeal; and
4. Requests for accreditation of services and correction of
personal information in the records of the Commission.

No officer or employee in the Civil Service shall be suspended
or dismissed except for cause as provided by law and after due
process.
The phrase for cause refers to the following administrative
offenses with corresponding penalties which are classified into
grave, less grave or light, depending on their gravity and effects
on the government service:
Grave offenses are those which may be punished with dismissal
from the service for the first offense or the maximum of 1-year
suspension for the 1st offense and dismissal from the service for
the 2nd offense. Examples of grave offense punishable with
dismissal are:
1) Dishonesty

2) Gross neglect of duty
3) Grave misconduct
4) Being notoriously undesirable is based mainly on the general
reputation of an employee for being difficult to work with, due
to his/her quarrelsome attitude and/or repeated infractions of
office rules.
5) Conviction of a crime involving moral turpitude everything
which is done contrary to justice, honesty, modesty or good
morals.
6) Falsification of official document
7) Physical or mental incapacity due to immoral or vicious habits
8) Engaging directly in partisan political activities

9) Receiving for personal use, a fee, gift or other valuable thing in
the course of official duties when the same is given by any
person in the hope or expectation of receiving a favor
10) Contracting loans of money or property from persons with
whom thee office of the employee has business relations
11) Nepotism and disloyalty to the Republic of the Philippines

Examples of Grave Offense punishable with 6mos. and 1 day to 1


year are:
1) Oppression
2) Disgraceful and immoral conduct
3) Inefficiency and incompetence in the performance of official

Examples of Grave Offense punishable with 6mos. and 1 day to 1
year are:
4) Frequent unauthorized absences or tardiness
5) Refusal to perform official duty
6) Gross insubordination
7) Having financial and material interest in any transaction
requiring the approval of his office; owning, controlling, etc, as
officer in any private enterprise regulated or supervised or
licensed by his office
8) Disclosing or misusing confidential or classified information to
further his private interests, among others

Less Grave Offenses are those punishable with 1mo. and 1 day
too 6 mos. For the first offense and dismissal for the 2nd offense.
Examples are:
1) Simple neglect of duty
2) Simple misconduct
3) Gross discourtesy in the course of official duties
4) Violation off CS Law and Rules of serious nature
5) Insubordination
6) Habitual drunkenness
7) Failure to file sworn statements of assets and liabilities
8) Failure to resign from his position in the private business where
there is conflict of interest within 30 days from assumption of

Duration and effect of administrative penalties:
The penalty of dismissal shall result in the permanent separation
of the employee from the service with perpetual disqualification to hold
public office.
Suspension shall be considered a gap in the service and during
that period the respondent will not be entitled to all money benefits
including leave credits. He shall not also be promoted during the said
period.
The penalty of fine shall be in an amount not exceeding 6 months
salary of the respondent. The prohibition for promotion shall be
equivalent to the period had the penalty been suspension. The fine shall
be paid to the agency that imposed the same.
The penalty of reprimand does not carry any accessory penalty.
