Introduction

Administration of justice is defined as


the process and structure which allows
conflicts between parties to be settled by a
body dedicated to that purpose.

The current situation of the courts in the
Philippines is not going well.

The situation is believed to become worse


and the backlog will continue to grow
rather than diminish unless judges are
enabled to dispose of more cases through
a systematic and sustained judicial reform
program.

Katarungang Pambarangay Law (KPL) or otherwise
known as Presidential Decree 1508 was implemented to:
amicably settle disputes in the barangay level wherein
the disputing parties are encouraged to make mutual
concession to obtain a peaceful resolution of the dispute
without formal adjudication thereof.
promote the speedy administration of justice and to
relieve court dockets and prosecutors offices of
conciliable case.
Cases must be brought to the Katarungang
Pambarangay first before filing them in court.

But despite the presence of KPL,
indiscriminate filing of cases in the courts of
justice continues and contributes heavily
and unjustifiably to the congestion of court
dockets.

Without effective implementation of KPL,
the attainment of peace, order and
common good is impossible.

Thus, this study aims to know the problems


encountered in the implementation of KPL
and the prospects of the selected
barangays in achieving the efficient
implementation of the law.

Statement of the Problem:

1. What is the socio-economic profile of each barangay in


terms of:
a. location
b. population
c. educational attainment of officials

2. What is the number of cases filed in the barangays? What


is the rate of the settled cases?

3. What is the level of compliance to the procedures
provided by the Katarungang Pambarangay Law written as
follows:
a. Receiving of the complaint by the Brgy. Chairman
filed by the complainant.
b. Issuance of summons to the respondents by the
Barangay.
c. Serving of notice to the complainant by the
Barangay.
d. Scheduling of hearing of the conflict of parties by
the Brgy. Chairman.

f. Forming or constituting of Pangkat or Lupon by the
Brgy. Chairman.
g. Hearing of the conflict in presence of the parties, their
witnesses, the Brgy. Chairman and the Pangkat or Lupon.

remedies that the complainant may avail.
i. Giving of sanctions.
j. Arriving of the Pangkat or Lupon at a settlement or
resolution of the dispute.
k. Compliance in the form of settlement.
l. Execution of the award.
m. Repudiation.

Research Design
The nature of the study requires a
descriptive design of research since it is
appropriate in dealing with the collected data as
well as in drawing results. The researchers use
this design for it is the most efficient way in
terms of gathering information through the help
of interview and questionnaire.

Under the descriptive design, the
researchers use the Survey method or the
normative method. The researchers find this
method the most appropriate one for this study
because it involves gathering of data through
direct interaction or interview and also through
questionnaires. Through this, the researchers
are able to easily analyze the responses given
by the respondents of this study.

Findings of the Study
In the light of the gathered data, the researchers came
out with the following findings.
1. Socio economic profile of each barangay in terms of:
a. Location
Based on the data gathered, Barangay 21 Poblacion is the
nearest to the Batangas City Muncipal Hall which is only 2
Kilometers away. Next is Barangay Cuta which is 1.50
Kilometers away from the City Hall. The farthest of all is
Barangay Balagtas which is 5.60 Kilometers away from the
City Hall.
Barangay Balagtas has the highest total internal revenue
allotment for the years 2011, 2012 and 2013 while Barangay
21 Poblacion has the least.

b. Population
From the data gathered, it can be drawn that
Barangay Cuta has the highest number of
residents. And Barangay 21 Poblacion has the
least number of residents.
c. Educational Attainment
Out of 108 respondents, 36 are High School
Graduates.

2. Number of cases filed in the barangays and the rate
of settled cases.
The gathered data conveyed that Barangay 21
Poblacion has the least number of cases filed but has the
highest number of settled cases which result to a high rate
of settled cases.

3. Level of compliance to the procedures provided by the
Katarungang Pambarangay Law.
There are several procedures provided by Katarungang
Pambarangay Law. Of all the procedures, the barangay officials
always complied the receiving of the complaints with a weighted
mean of 4.93. This simply means that the barangay officials of
the barangays are very accommodative. Though all of the
procedures provided are always complied by the barangay
officials, the least complied is the arriving of the Pangkat or
Lupon at a settlement or resolution of the dispute within 15 days
which obtained a weighted mean of 4.44. This is maybe because
15 days is quite a short period of time for the barangay officials
to reach or arrive at a settlement.

5. Factors which affect the efficient implementation of
Katarungang Pambarangay Law.
Results indicated that the least factor is the
laziness of the barangay officials during the hearing of the
dispute which acquired a weighted mean of 1.21.

On the other hand, the factor that most likely to


affect the implementation of the Katarungang
Pambarangay Law is the availability of the parties
involved on the day of hearing which obtained a weighted
mean of 1.98.

6. Problems encountered in the implementation of the
Katarungang Pambarangay Law.
The gathered data conveyed that there are quite a
few problems encountered in the implementation of the
Katarungang Pambarangay Law.
Majority of the respondents, with a percentage of
74.07, observed that the inadequacy in budget is the
number one problem that each of the barangay
encounter.
The least problem that they encounter is the issue of
gender sensitivity of those administering KPL which
covers 6.48% of the respondents.

7. Proposed suggestions
83.33% of the respondents selected that the
barangay officials should undergo trainings and seminars
to improve the implementation of KPL covering the majority
of the respondents.

59.26% of the respondents selected that sanctions


should be strictly implemented.

Conclusions

Most of the respondents are high school


graduates.

The educational attainment of the barangay


officials does not affect their ability to efficiently
implement the Katarungang Pambarangay Law.

The barangay officials of the selected
barangays always complied with the
procedures provided by the Katarungang
Pambarangay Law in settling disputes.
The barangay officials are very
enthusiastic in receiving complaints filed
by the residents. Because of this, all
complaints are heard and tried with the
help of the Lupon ng Tagapamayapa.

The less number of cases filed, the
more the barangay officials are able to
comply with every procedure or step
provided by the law which also results
to a higher rate of settled cases.

The barangay officials of the selected
barangays have disagreed that the factors
presented by the researchers affect the
efficient implementation of the Katarungang
Pambarangay Law. None of the respondents
agreed that even one of the factors given
produce an effect on the execution of the law.
This simply means that there is a smooth flow
in the implementation of the Katarungang
Pambarangay Law.

Problems encountered by the barangay officials in the
implementation of the Katarungang Pambarangay
Law. The number one problem is that the barangays
have inadequate budget which prevents the barangay
officials in undergoing trainings and seminars. Other
problems are the lack of knowledge and skills of
implementators in classifying cases, difficulty of
establishing quorum during hearings,
uncooperativeness of the respondents/parties
involved, unavailability of barangay officials and the
issue of gender sensitivity of those administering the
Katarungang Pambarangay Law.

The selected barangays find their
implementation of the law in good
condition with the rate of cases they have
settled. With this, they have positive
prospects in achieving efficient
implementation of the KPL.

Recommendations
From the foregoing conclusions, the researchers
offer the following recommendations:
The barangay officials should come up with
several fund raising events, since the barangays
have inadequate budget, for them to be able to
gather funds and use it in attending seminars
and trainings for them to better achieve the
efficient implementation of the Katarungang
Pambarangay Law.

The barangay officials should schedule
hearing of disputes depending on the
availability of the officials and the parties
to avoid postponements whenever one is
absent or unavailable and to establish a
quorum.

The residents of the selected barangays must be made
properly aware of the essence of the Katarungang
Pambarangay Law.
Similar study may be conducted to strengthen the
validity of the findings of this research.
