REGULATIONS 2004

COURSE OBJECTIVES
To explain the duties of employer on
notification of accidents, dangerous
occurrence, occupational poisoning and
occupational diseases;
To explain the dos & donts when accident
occur in your workplace;
To describe the maintenance of accident
record & its relevant scheduled forms;

NOTIFICATION OF ACCIDENT, DANGEROUS
OCCURRENCE, OCC. POISONING AND
OCC.DISEASE REGS. 2004 (NADOOPOD )

Part 1 Preliminary
Approved means approved by the D.G
Serious bodily injury means any injury
listed in Schedule 1
Fatal injury means injury leading to
immediate death or death within one year
of the accident

Cont. Part 1
Non-fatal injury means:

(a) a lost-time injury which prevents a worker from


performing normal work and leads to permanent or
temporary incapacity for work; or

(b) a no-lost-time injury where no work time is lost


beyond that is required for medical attention

Dangerous occurrence means an occurrence arising out


of or in connection with work as per Schedule 2;

Accident means an occurrence arising out of or
in connection with work which results in fatal
injury or non-fatal injury;
Occ. Poisoning & Occ. Disease means a
poisoning or a disease arising out of or in
connection with work as per Schedule 3;
Lost-time means lost days counted from and
including the day following the day of the
accident measured in calendar days;
Application apply to all places of work;

Part 2 Reporting of Accident,
DO, OP and OD ( Reg. 5 ) cont.
Cases to be reported:

Death; or
Serious bodily injury more than 4 days;
Dangerous occurrence
Notify the nearest DOSH by the quickest means
available; and
Within 7 days send a report thereof in an approved form;
An injury which causes death within one year of the date
of that accident, the employer shall inform in writing to
DG as soon as it comes to his knowledge;

Reporting Occp. Poisoning &
Occp. Disease - Part 2
Where a person at work suffers or likely to suffer from
one of the Ops & Ods as per Schedule 3 , in column 1 &
2;

Employer shall send a report within 7 days to the


nearest DOSH office in an approved form;

Every registered medical practitioner or medical officer


attending to or called in to visit, a patient whom he
believes to be suffering from any of Op & Od listed in 3rd
schedule shall within 7 days report to DG in an
approved form and same time notify the patients
employer;

Part 3 No Interference At Accident
Or Dangerous Occurrence Scene

Where accident or Do causes:

Death of any person or


Serious bodily injury or
Serious damage and
Dangerous to plant or other property

Cont. No Interference.
No person shall unless authorized:

To remove or
In any way interfere with or
Disturb any plant, substance, article or
thing related to the incident

Cont. - No Interference..
Except to the extent necessary to:

Save the life, prevent injury or relieve the


suffering of any person;
Maintain the access of the general public to
an essential service or utility; or
Prevent further damage to or serious loss
of property or environment;

Part 4 Maintenance Of All Records
of Accident, Do, Op & Od
Employer & Self-employed shall record & maintain
a register in an approved form:

All accidents & Do;


All Ops or Ods which have occurred or are likely
to occur;
Record shall be kept for at least 5 years;
Send 1 year record to DG before 31 January of
each year ending on 31 December of each year;

Requirement of further information

DG may require further information as per 4th Schedule


within the time limit so specified by DG

Fourth Schedule: e.g


- further details of the circumstances leading to the
reported incidents
- details about the nature /designs of any
plant/substances involved in the incident
- safety systems/procedures involved in the incident
- and others ( 1 8 ), please refer 4th schedule;

Part 5 - Miscellaneous

Minister may amend any Schedule to these regulations


from time to time.
First Schedule Serious bodily injury
Second Schedule Dangerous Occurrences wherever they
occur, Dos in relation to Mines, Dos in relation to
Quarries, Dos in relation to Forestry, & Dos in relation to
Agriculture;
Third Schedule refer to Op & Od
Fourth Schedule Matters which the DG may require
involved in the reported incident;

PENALTY

Any person who contravenes any provision


of these Regulations;

RM 10,000 , or
One year imprisonment, or
Both
