(b) To define the extent of the rights and obligations of water users and owners
including the protection and regulation of such rights;
(d) To identify the administrative agencies which will enforce the law.
EMERGING PRINCIPLES
(b) All waters that belong to the State cannot be subject to acquisitive prescription;
(c) The State may allow the use or development of waters by administrative
concession;
(e) Preference in the use and development of waters shall consider current usages
and be responsive to the changing needs of the country.
Waters, as used in the Code, refers to water under the grounds, water above the
ground, water in the atmosphere and the waters of the sea within the territorial
jurisdiction of the Philippines.
STATE OWNERSHIP OF
WATERS
The following belong to the state:
Navigable river - Rivers navigable in fact when they are used, or susceptible
of being used, in their ordinary condition as highways for for commerce over
which trade and travel are or maybe conducted in the customary modes of
trade and travel on water.
River banks - The boundaries which confine the water to its channel
throughout the entire width when stream is carrying its maximum quantity of
water.
- DEFINITION OF TERMS
Creek - A small stream less than a river. The term imports a recess,
cove, bay, or inlet in the shore of a river. and not a separate or
independent stream, though it is sometime used in the latter meaning.

Use of water for domestic purposes is the utilization of
water for drinking, washing, bathing, cooking or other
household needs, home gardens, and watering of lawns or
domestic animals.
c. Swamps and marshes which are owned by the State and which
primary value for waterfowl propagation or other wildlife purposes
may be reserved and protected from drainage operation and
development.
d. No person shall, without proper permission from the
Environmental Management Bureau (EMB), build any
works that may produce dangerous or noxious substances
or perform any act which may result in the introduction of
sewage, industrial waste, or any pollutant into any source
of water supply.
