E – Governance Objective : • Build service around citizen’s choice • Make government more accessible • Provide information responsibly • Use government resources effectively • Reduce government spending • Deliver on- line service • Involve citizen in governing process E – Governance Significance of electronic governance : • Record keeping and Reducing in files • Effective coordination and supervision • Automation of process • Helps in taking strategies decision at appropriate time. • Citizens empowerment Electronic Record According to Section 2 (1) (t) of Information technology Act,2000 “ Electronic record means data, record or data generated, image or sound stored, received or sent in electronic form or microfilm or computer generated micro fetch. “ Attribution of E-Record An electronic record shall be attributed to the originator : a) If it was send by originator himself. b) By a person who had the authority to act on behalf of the originator in respect of that electronic record. c) By an information system programmed by or on the behalf of the originator to operate automatically. Acknowledgement of E-Record 1. Where the originator has not agreed with the addressee that the acknowledgement of receipt of e-record given in particular form or by a particular method, an acknowledgement may given by : • Any communication by addressee, automated or otherwise. • Any conduct of addressee, sufficient to indicate to the originator that the e-record has been received. Acknowledgement of E-Record 2. If the terms of business require the addressee to give acknowledgement the electronic record cannot bind the originator unless he has received acknowledgement. Acknowledgement of E-Record 3. Where nothing was agreed about acknowledgement and if the originator does not get any acknowledgement from the addressee, the originator should give the notice to the addressee that he has not received any acknowledgement within the reasonable time. Time & Place of Dispatch of electronic record I. Save as otherwise agreed to between the originator and the addressee, the dispatch of an electronic record occurs when it enters a computer resources outside the control of originator. II. Save as otherwise agreed between the originator and addressee, record shall be determined. ……………. Dispatch of electronic record iii. Save as otherwise agreed to between the originator and the addressee, an electronic record is deemed to be dispatched at the place where the originator has his place of business, and is deemed to be received at the place where addressee has his place of business. iv. The provision of sub-section (2) shall apply notwithstanding that one place where the computer resource is located may be different from the place the place where electronic record is deemed to have been received Penalties and Offence
