• Pre-2010
• SDVOSB eligibility completely self-certifying (SBA)
• Veteran’s Benefits, Health Care and Information Act of 2006
• Implemented by Veteran’s First Program in 2007
• Created dual system
• VA has sole jurisdiction over ownership and control for VA Contracts
• SBA has jurisdiction over ownership and control for all other Contracts

• In 2010, VA begins process of “verifying” eligibility of SDVOSBs
for VA contracts
• Center for Verification and Evaluation (CVE)
• Formal application process
• Only the SBA can determine size!
• SBA system was, and remains, self-certifying

• National Defense Authorization Act of 2017
• Required a standardized set of definitions for SDVOSBs and VOSBs
• Mandated the VA to use revised, consolidated SBA regulatory
definitions
• The VA would continue to verify eligibility for VA procurements
• Ownership and Control challenges determined by SBA’s Office of
Hearings and Appeals (OHA)

• March 30, 2018 – Final Rule regarding OHA jurisdiction to hear
