AN ACT TO PROHIBIT THE


CUTTING, DESTROYING
OR INJURING OF PLANTED OR
GROWING TREES, FLOWERING
PLANTS AND SHRUBS OR PLANTS
OF SCENIC VALUE ALONG PUBLIC
ROADS,
IN PLAZAS, PARKS, SCHOOL
PREMISES
OR IN ANY OTHER PUBLIC
GROUND
The Policy (Section
1)
It is the Policy of the
Government
• To cherish, protect and
conserve planted or
growing trees,
flowering plants and
shrubs or plants of
ornamental value along
public roads, in plazas,
parks, school premises or
in any public ground
Objectives

• To promote and conserve the


beauty of objects of scenic and
ornamental value along public
places
• To help preserve cool,fresh and
healthful climate
Subject To Law

• Planted or growing trees


Subject To Law

• Flowering plants and shrubs


Subject To Law

• Plants of ornamental value


Location

• Public roads
• Plazas
• Parks
• School premises or
• In any public ground
What is Prohibited?

• Cutting, destroying, or injuring of


the subject of the law in the above-
mentioned location
What are the
Requisites for
Exception?
• Necessary for public
safety, or
• Necessary to enhance its
beauty
• Recommendation of the
committee and upon the
approval of the Director
of Parks and Wildlife.
Powers of Director of Parks and Wildlife (Section 2)

• Power to create a committee in


each and every municipality in the
Philippines
• Power to issue and promulgate
rules and regulations as may be
necessary in carrying out the
provisions of this Act.
Who Compose the Committee? (Section 2)

• Chairman
• Ex-officio members:
• Municipal mayor,
• Municipal treasurer,
• Supervising school teacher, and
• Municipal health officer
Powers and Duties of the Committee

• Coordinate with the Director of


Parks and Wildlife in the
beautification of their respective
locality and
• Under its supervision, require
school children on Arbor Day to
plant trees and flowering plants
of useful and scenic value in
places provided for in the
preceding paragraph.
What is Arbor Day?

• According to Merriam Webster, the


word arbor in Arbor Day, means “tree”.
• In the Philippines, Arbor Day was
declared through Proclamation No. 30
by former President Manuel Roxas in
1947, to be held every second
Saturday of September of each year in
schools and communities.
• Most recently, it was revived through
Republic Act 10176 or the Arbor Day
Act of 2012 when then President
Benigno Aquino III signed into law a
bill reviving tree-planting day as yearly
event for local government units. This
revival institutionalized Arbor Day to
be observed every June 25
throughout the nation.
Punishment

• Prison correctional in its


minimum period to prison
mayor in its minimum period.
