ART. 10.3. Cuando una misma invención hubiere sido realizada por distintas
personas de forma independiente, el derecho a la patente pertenecerá a aquél
cuya solicitud tenga una fecha anterior de presentación en España, siempre que
dicha solicitud se publique con arreglo a lo dispuesto en el artículo 32.

OBLIGACIÓN DE COMUNICACIÓN
1. Las invenciones realizadas por el personal investigador al servicio del Consejo Superior de
Investigaciones Científicas (CISIC), del Centro de Investigaciones Energéticas,
Medioambientales y Tecnológicas (CIEMAT), del Instituto Nacional de Técnica Aerospacial
«Esteban Terradas» (INTA), del Instituto Nacional de Investigación y Tecnología Agraria y
Alimentaria (INIA), del Instituto Español de Oceanografía (IEO), del Instituto Geológico y
Minero de España (IGME) y del Instituto de Salud «Carlos III» se regirán, en lo previsto en el
apartado 9 del artículo 20 de la Ley 11/1986, de 20 de marzo, de Patentes, por las
disposiciones contenidas en el presente Real Decreto.
2. Tiene la consideración de personal investigador, a efectos de lo establecido en el presente
Real Decreto:
a) Los funcionarios civiles o el personal militar vinculados a los organismos señalados en el
apartado 1 del presente artículo por una relación de servicios de carácter estatutario. que
desarrollen actividades de investigación.
b) El personal contratado en régimen de derecho laboral por los mismos organismos que,
asimismo, desarrolle actividades de investigación.

CLAUSULA DE CONFIDENCIALIDAD
Asimismo el EMPLEADO se obliga a no explotar en modo alguno, por sí mismo ni por medio
de terceros, ninguno de dichos resultados, durante la vigencia del presente contrato ni
después de haberse producido la extinción del mismo, salvo en el caso de que dispusiera de
previa, expresa y escrita autorización de la EMPRESA para ello.

9.1 This Article 9 applies to all work, intellectual creations and inventions,
whatever the nature, including know-how, methods and methodologies,
technologies, developments, equipment and models, software and the
documentation related thereto as well as any realization which can be
protected under intellectual property rights or by any other means
(hereinafter collectively designated as the "Creations") designed or
developed by the Partner, alone or jointly, in any place, in connection
with the performance of this employment contract and in the exercise of
his duties within the Company.

9.4 The present transfer of intellectual property rights is made for the
entire world and for the entire duration of the copyrights attached to the
Creations.
9.5 As a result of the present transfer, the Partner formally agrees not to
reproduce or reuse, in any form whatsoever, all or part of the transferred
rights, notwithstanding his right to reuse the experience and know-how
acquired in connection with this employment contract.
9.6 The Partner hereby undertakes not to make any claim relating to his
moral rights, if any, on the Creations against Accenture, any Group
entity, the clients of the Company or the Group, or the holders of a use
license (dudosa)
