NATIONAL BUILDING CODE OF THE
PHILIPPINES
OVERVIEW OF THE NBC (PD 1096)

Why was the NBC formulated?


The National Building Code was formulated :

 To set up uniform parameters, general policies and standards


 To insure the safety as well as the best use, occupancy and maintenance of
buildings and other structures when local building ordinances were found to be
inadequate
 To prevent damages and loss of lives due to building failures that could have been
prevented if proper safeguards were observed.
The rapid advance in the development of new technologies have made some
provisions of the ordinances obsolete that some flexibility had to be introduced
in order to adapt to changes in the continuing search for better materials and
construction techniques.
How was the NBC formulated?

The late President Ferdinand Marcos therefore ordered the then Minister of MPWTC
for an updated Uniform National Building Code that could be enforced nationwide
after the following disaster:

 The 1976 powerful earthquake in Mindanao causing death to over 10,000 people
 Wide spread destruction to properties due to the tsunamis triggered by the tremor.
 The 1968 earthquake that damaged the Ruby Tower bldg. and some other edifices
 Earlier studies by MPWTC which passed the RA 6541 titled “An Act to Ordain and
Institute a National Building Code of the Philippines” as a law, but was found to
have some inadequacies.
 The 1976 earthquake hastened the formulation of the NBC.
The National Building Code was formulated and
enforced nationwide after the following disaster:
When did the NBC and its IRR take effect?

 On February 19, 1977, the National Building Code took effect as PD 1096.

 The Old Implementing Rules and Regulations took effect on various dates as they
were issued in the form of Memorandum Orders by then Minister of the defunct
Ministry of Public Works, Transportation and Communications (MPWTC).
 Rule XIX on Parking and Loading Space Requirements took effect on July 16, 1979.

 Every issuance of the Memorandum Orders was published in a newspaper of major


circulation (The Daily Express) which was compiled in book form by the Building
Research and Development Staff.
 The only updating of the IRR occurred in 1992 when Permit Fees were raise 100%
to alleviate and augment the needs of the office of the Building Officials in the
performance of their functions.
What is the Building Code’s Scope and Application?

The provisions of this code :

 shall apply to the design, location, sitting, construction,


alteration, repair, conversion, use, occupancy,
maintenance, moving, demolition of, and addition to
public and private buildings and structures, except
traditional indigenous family dwellings intended for the
use and occupancy by the family of the owner only and
constructed of native materials.

 All buildings and structures constructed prior to the


enactment of the Code, if legally done according to RA
6541 of to existing city or municipality codes then, shall
be respected subject to the limitations established in
this Code. However, alterations, additions, conversion
and/ or repairs to be made shall be subject to the
provisions of this Code.
GENERAL BUILDING REQUIREMENTS

• All buildings or structures as well as accessory facilities thereto shall conform


in all respects to the principles of safe construction and must be suited to
the purpose for which they are designed.

• Buildings or structures intended to be used for the manufacture and/ or


production of any kind of article or product shall observe adequate
environmental safeguards.

• Buildings or structures and all parts thereof as well as all facilities found
therein shall be maintained in safe, sanitary and good working condition.
Who is responsible for its Administration and Enforcement?
Pursuant to Section 201 of PD 1096, the administration and enforcement of
the provisions of this Code including the imposition of penalties for the
violations thereof, is vested in the Secretary of Public Works, Transportation,
and Communications, now, Secretary of Public Works and Highways. The
Building Official however, shall be responsible for carrying out the provisions
of this Code as well as the enforcement of orders and decisions made
pursuant thereto, in the field.
According to section 206 of this Code, no person shall be appointed as a
Building Official unless he possesses the following qualifications:

• A Filipino Citizen and of good moral character.


• A duly registered architect or civil engineer.
• A member of good standing of duly accredited association of
his profession for not less than two years.
• Has at least five years of diversified and professional
experience in building design and construction.

BRIEF HISTORY

EXPLANATORY NOTE
The stepped up economic, physical and infrastructural
development of the country brings to the fore the need to have a
uniform Building Code enforceable nationwide which shall embody not
only general policies and standards on building design and construction
but also the requirements of modern technology to insure safety as well
as the best use, occupancy and maintenance of buildings and other
structures.
In 1972 during the last session of the now defunct Congress,
Republic Act No. 6541 entitled “An Act to Ordain and Institute a
National Building Code of the Philippines”, was passed. This Code could
have been the answer to the present need if it were not for the
deficiency and the inapplicability, not to mention the ambiguity of
some of the substantive provisions found therein. For Instance, the
Code is not clear as to the enforceability of its provisions on both the
national and local levels by failing to expressly declare its supremacy
over charters and local ordinances. Because of the lack or absence of
sanctions and penal provisions, full compliance with the provisions of
the Code cannot reasonably be expected. And more importantly, the
organizational structure and machinery (the Joint Building and
Environmental Planning Research and Standards Commission)
conceived in the Code to oversee the implementation of its provisions,
is not only functionally weak but is now deemed nullified by the
abolition of Congress from which part of the Commission’s membership
is supposed to be drawn.
The formulation and adoption anew of an up-to-date national
building code is therefore one of the imperatives of time and necessity.
Accordingly, in undertaking this project, attention is given not only to
the inadequacies, defects and ambiguities of R.A. No. 6541 but to the
need to achieve maximum safety in building construction; to establish
such standards and requirements for the construction of buildings
capable of withstanding powerful earthquakes and other calamities or
of surviving these without undue damage; to consult with and avail of
the expert knowledge and technical advice of suitable authorities on the
subject; to consider the best operational and structural means of
instituting and carrying out a building construction program; and to see
to it that, on the whole, the Code conforms to the developmental goals
and over-all infrastructure program of the New Society.
PRESIDENTIAL DECREE NO. 1096

ADOPTING A NATIONAL BUILDING CODE OF THE PHILIPPINES


THEREBY REVISING REPUBLIC ACT NUMBERED SIXTY-FIVE
HUNDRED FORTY ONE
WHEREAS, the country’s accelerating economic and physical
development, coupled with urbanization and population growth, makes
imperative the formulation and adoption of a uniform building code
which shall embody up-to-date and modern technical knowledge on
building design, construction, use, occupancy and maintenance;

WHEREAS, while there is Republic Act No. 6541, entitled “An


Act to Ordain and Institute a National Building Code of the Philippines”,
the same does not conform with the developmental goals and
infrastructure program of the Government and does not adequately
provide for all the technological requirements of buildings and
structures, in terms of up-to-date design and construction standards
and criteria;
WHEREAS, in the formulation of a New National Building
Code, it is the desire and policy of the Government to avail of and
harness the technical expertise and professional know-how of men not
only in the public but in the private sectors as well.
DECLARATION OF POLICY

PRESIDENTIAL DECREE 1096, Popular know as the National


Building Code of the Philippines, which was issued on February
19, 1977 has achieved the purpose of enforcing uniform standard
and requirements

The code hereby declared to be the policy of the State


to safeguard life, health, property, and public welfare, consistent
with the principles of sound environmental management and
control; and to this end, make it the purpose of this Code to
provide for all buildings and structures, a framework of minimum
standards and requirements to regulate and control their
location, site, design, quality of materials, construction, use,
occupancy, and maintenance.
SCOPE AND APPLICATION

A. The provisions of this Code shall apply to the design,


location, siting, construction, alteration, repair, conversion, use,
occupancy, maintenance, moving, demolition of, and addition to
public and private buildings and structures, except traditional
indigenous family dwellings as defined herein.

B. Buildings and/ or structures constructed before the approval


of this Code shall not be affected thereby except when alterations,
additions, conversations or repairs are to be made therein in which
case, this Code shall apply only to portions to be altered, added,
converted or repaired.
GENERAL BUILDING REQUIREMENTS

A. All buildings or structures as well as accessory facilities


thereto shall conform in all respects to the principles of safe
construction and must be suited to the purpose for which they are
designed.

B. Buildings or structures intended to be used for the


manufacture and/ or production of any kind of article or product shall
observe adequate environmental safeguards.

C. Buildings or structures and all parts thereof as well as all


facilities found therein shall be maintained in safe, sanitary and good
working condition.
DUTIES OF A BUILDING OFFICIAL

In his respective territorial jurisdiction, The BUILDING OFFICIAL


shall be primarily responsible for the enforcement of the provisions of this
Code as well as of the IMPLEMENTING RULES AND REGULATIONS ISSUED
therefor. He is the official charged with the duties of issuing building
permits.
In the performance of his duties, a Building Official may enter any
building or its premises at all reasonable times to inspect and determine
compliance with the requirements of this Code, and the terms and
conditions provided for in the building permit as issued.

When any building work is found to be contrary to the provisions


of this Code, the Building Official may order the work stopped and
prescribe the terms and/ or conditions when the work will be allowed to
resume. Likewise, the Building Official is authorized to order the
discontinuance of the occupancy or use of any building or structure or
portion thereof found to be occupied or used contrary to the provisions of
this Code.
FUNCTION STATEMENT

The City Building Official shall take charge of the following :

 Enforce the provision of the National Building Code and implement the rules and regulations issued
thereafter;
 Process all building permit applications on such as the basis of land use and architectural, structural,
geodetic, sanitary and plumbing, electrical, mechanical and fire as well and other standard
requirements, rules and regulations promulgated in accordance with the National Building Code,
DPWH Memorandum, City Ordinances and other referral codes;
 Inspect all buildings or its premises at all reasonable times in determining compliance with the
National Building Code, and the terms and conditions as provided for in the building permit issued;
 Review and evaluate the designs, plans and programs with the corresponding specifications
estimates and other necessary building documents of all building projects under its charge;
 Order discontinuance of the occupancy or use of any building or structure or portion thereof found to
be occupied or used contrary to the provisions of National Building Code;
 Inspect the constructions, repair, addition, renovations and/or demolition of all buildings in
accordance with the National Building Code and prescribed the terms and/or conditions when the
work will be allowed to resume;
 Keep a permanent record and accurate account of all fees and other charges fixed and authorized by
the Secretary of Public Works and Highway.
EXEMPTION

 Public buildings and traditional indigenous family dwellings shall be


exempt from payment of building permit fees.

 As used in this Code, the term “traditional indigenous family dwelling”


means a dwelling intended for the use and occupancy by the family of
the owner only and constructed of native materials such as bamboo,
nipa, logs, or lumber, the total cost of which does not exceed fifteen
thousand pesos.
However, a building permit shall not required for the following
constructions and repairs; provided that said constructions or repairs shall
not violate any provisions of the Code and its Implementing Rules and
Regulations:

A.
Minor Constructions:
1. Sheds, outhouses, greenhouses, children’s playhouses, aviaries, poultry
houses and the like, not exceeding 6sq.m. in floor area, provided they are
completely detached from any other building and are intended only for the
private use of the owner.
2. Addition of open terraces or patios resting directly on the ground, not
exceeding 20 sq.m. in floor area, exclusively for the private use of the
owner.
3.
Installation of the window grilles.
4.
Garden pools for the cultivation of water plants and/ or aquarium fishes
not exceeding 500 millimeters in depth.
5.
Erection of garden walls other than party walls not exceeding 1.80 meters
in height, cementing of footpaths, garden walks and/ or driveways.
A. REPAIRS:

1. Repair works not affecting or involving any structural member, such as


replacement of deteriorated roofing sheets or tiles, gutters, downspouts,
fascias, ceilings and/ or sidings.
2. Repair of non load –bearing partition walls.
3. Repair of any interior portion of a house not involving addition or alteration.
4. Repair and/ or replacement of windows.
5. Repair and/ or replacement of flooring.
6. Repair of perimeter fence and walls.
7. Repair and/ or replacement of sanitary or plumbing fixtures, such as toilet
bowls and cisterns, urinals and bidettes, pipes, faucet, valves, water pumps
and/ or tanks.
8. Repair or replacement of faulty or deteriorated wiring devices, fixtures and
safety devices, provided that no alteration shall be made on the service
entrance and the main switch or breaker, and that no additional circuits shall
be added.
THE IMPLEMENTING RULES AND REGULATIONS

In the implementation of the provisions of this Code, the


Secretary shall formulate necessary rules and regulations and adopt
design and construction standards and criteria for buildings and others
structures. Such standards, rules and regulations shall take effect after
their publication once a week for the three consecutive weeks in a
newspaper of general circulation.

The original rules and regulations of the Code were issued on


various dates in 1977-1979 through memorandum orders by the
defunct Ministry of Public Works Transportation and communications.
These rules and regulations were then compiled by their Ministry of
Public Works and Highways.
PENAL PROVISIONS

 Any person, firm or corporation that will erect, construct, enlarge, alter,
repair, move, improve, remove, convert, demolish, equip, use, occupy, or
maintain any building or structure or cause the same to be done contrary
to or in violation of any provision of this Code shall be considered
unlawful
 Any person, firm or corporation who shall violate any of the provisions of this
Code:
• a fine of not more than twenty thousand pesos or by imprisonment
of not more than two years or by both such fine and imprisonment
• In the case of a corporation firm, partnership or association, the
penalty shall be imposed upon its officials responsible for such violation

• In the case of alien, he shall immediately be deported after payment of


the fine and/ or service of his sentence.
DANGEROUS AND RUINOUS BUILDINGS OR STRUCTURES

Dangerous buildings are


those which are herein declared as
such or are structurally unsafe or not
provided with safe egress, or which
constitute a fire hazard, or are
otherwise dangerous to human life,

or which in relation to existing use,


constitute a hazard to safety or health
or public welfare because of
inadequate maintenance, dilapidation,
obsolescence, or abandonment; or
which otherwise contribute to the
pollution of the site or the community
to an intolerable degree.
BUILDING PERMITS
PERMITS AND INSPECTION

No person, firm or corporation, including any agency or


instrumentality of the government shall erect, construct, alter, repair, move,
convert or demolish any building or structure or cause the same to be done
without first obtaining a building permit therefor from the Building Official
assigned in the place where the subject building is located or the building
work is to be done.
APPLICATION FOR PERMIT
In order to obtain a building permit, the applicant shall file an application
therefor in writing and on the prescribed form with the Office of the
Building Official. Every application shall provide at least the following
information:
1. A description of the work to be covered by the permit applied for;
2. Description and ownership of the lot on which the proposed work is to
be done as evidenced by TCT and/ or copy of the contract of lease over
the lot if applicant is not the registered owner;
3. The use or occupancy for which the proposed work is intended;
4. Estimated cost of the proposed work.
To be submitted together with such application are at least five sets of
corresponding plans and specifications prepared, signed and sealed by a
duly licensed architect or civil engineer in case of architectural and
structural plans, by a registered mechanical engineer in case of
mechanical plans, by a registered electrical engineer in case of electrical
plans and by a licensed sanitary engineer or master plumber in case of
plumbing or sanitary installation plans excepts in those cases exempted or
not required by the Building Official under this Code.
APPLICATION FOR PERMIT / REQUIREMENTS

Any person desiring to obtain a building permit shall file an


application therefor in writing and on the prescribed form.
A. Together with the accomplished application from the following
shall be submitted to the Office of the Building Official:
a.) In case the applicant is the registered owner of the lot:
1. Certified true copy of TCT
2. Tax Declaration, and
3. Current Real Property Tax Receipt.
b.) In case the applicant is not the registered owner of the lot:
1. Duly notarized copy of the Contract of Lease, or
2. Duly notarized copy of the Deed of Absolute Sale, or
3. Duly notarized copy of the Contract of Sale.
B. Five (5) sets of plans and specifications prepared, signed and sealed
a.) By a duly licensed architect or civil engineer, in case of architectural
and structural plans;
b.) By a duly licensed sanitary engineer or master plumber, in case of
plumbing or sanitary installation plans;
c.) By duly licensed professional electrical engineer, in case of electrical
plans;
d. ) By duly licensed professional mechanical engineer, in case of
mechanical plans.

PROCESSING OF BUILDING PERMITS

The processing of building permits shall be under the overall


administrative control and supervision of the Building Official and his
technical staff of qualified professionals.

In processing an application for a building permit, the Building


Official shall see to it that the applicant satisfies and conforms with
approved standard requirements on zoning and land use, lines and
grades, structural design, sanitary and sewerage, environmental
health, electrical and mechanical safety as well as with other rules and
regulations promulgated in accordance with the provisions of this
Code.

ISSUANCE OF BUILDING PERMITS

 When the application is in conformity with the requirements of the


Code and other pertinent rules and regulations, the Building Official
shall issue the building permit applied for within fifteen days from
payment of the required fees by the applicant

 A building permit shall be issued for the construction of only a portion


of a building or structure whenever the plans and specifications
submitted together with the application do not cover the entire building
or structure.

 Approved plans and specifications shall not be changed, modified or


altered without the approval of the Building Official and the work shall
be done strictly in accordance thereto.
VALIDITY OF BUILDING PERMITS

The issuance of a building permit shall not be construed as an


approval or authorization to the permittee to disregard or violate any of
the provisions of this Code.

Whenever the issuance of a permit is a based on approved plans


and specifications which are subsequently found defective, the Building
Officials is not precluded from requiring pemittee to effect the necessary
corrections in said plans and specifications or from preventing or ordering
the stoppage of any or all building operations being carried on there
under which are in violation of this Code.
A building permit issued under the provisions of this Code shall
expire and become null and void if the building or work authorized
therein is not commenced within a period of one year from the date of
such permit, or if the building or work so authorized is suspended or
abandoned at any time after it has been commenced, for a period of 120
days.
NON-ISSUANCE, SUSPENSION OR
REVOCATION OF BUILDING PERMITS

The Building Official may order or cause the non-issuance, suspension


or revocation of building permits on any or all of the following reasons
or grounds:

• Errors found in the plans and specifications;


• Incorrect or inaccurate data or information supplied;
• Non-compliance with the provisions of this Code
or of any rule or regulation.

Notice of non-issuance, suspension or revocation of building permits


shall always be made in writing, stating the reason or grounds therefor.
CERTIFICATE OF OCCUPANCY

No building or structure shall be used or occupied and no change in


the existing use or occupancy classification of a building or structure or portion
thereof shall be made until the Building Official has issued a Certificate of
Occupancy therefor as provided in this Code.

A Certificate of Occupancy shall be issued by the Building Official


within thirty (30) days if after final inspection and submittal of a Certificate of
Completion referred to in the preceding section, it is found that the building or
structure complies with the provisions of this Code.

The Certificate of Occupancy shall be posted or displayed in a


conspicuous place on the premises and shall not be removed except upon order
of the Building Official.

The non-issuance, suspension and revocation of Certificates of


Occupancy and the procedure for appeal therefrom shall be governed in so far
as applicable, by the provisions of Section 306 and 307 of this Code.

Approved Plan of Architectural/Structural, Electrical, Mechanical and


Sanitary/Plumbing (for final inspection purpose only.
Note: Three (3) sets of As-built plans will required if there are changes/
modifications on the approved plan.
• Accomplishment Certificate of Completion for Building, Electrical, Mechanical
and Sanitary/Plumbing duly signed and sealed by Architect/Engineer-in-Charge
of construction or installation.
Note: The Architect/Engineer-in-Charge who signed in the Building Permit,
Electrical, Mechanical and Sanitary/Plumbing should be the same person
who shall sign with its corresponding dry seal the Certificate of Completion.
In case of change, please see our respective counter representative for
proper guidance.
• Concrete Test, Soil Test and Steel Test results for medium and high rise buildings.
• Logbook duly signed and sealed by Architect/ Engineer-in-Charge.
• Picture showing the full view of the completed structure especially the sidewalk
(for new construction, extension and additional only).
• Affidavit of Undertaking of the owner/ manager for the use of Liquified
Petroleum Gas (LPG) and Certification of Safeness of the system from the
installer/ supplier of the LPG piping layouts and tanks.

PROTECTION OF PEDESTRIAN
DURING CONSRUCTION OR DEMOLITION

SECTION 1101. GENERAL REQUIREMENTS


• No person shall use or occupy a street, alley or public sidewalk
for the performance of work covered by a building permit
except in accordance with the provisions of this Chapter.
• No person shall perform any work on any building or structure
adjacent to a public way in general use for pedestrian travel,
unless the pedestrians are protected as specified in this Chapter.
• Any material or structure temporarily occupying public property,
including fence, canopies, and walkways, shall be adequately
lighted, between sunset and sunrise.
SECTION 1102. STORAGE IN PUBLIC PROPERTY

Materials and equipment necessary for work to be done under


a permit when placed or stored on public property shall not obstruct
free and convenient approach to and use of any fire hydrant, fire or
police alarm box, catch basin, or manhole and shall not interfere with
any drainage of any street or alley gutter.

SECTION 1103. MIXING MORTAR ON PUBLIC PROPERTY

The mixing of mortar, concrete, or similar materials on public


streets shall be not be allowed.

AN ACT TO ENHANCE THE MOBILITY OF DISABLED PERSONS BY REQUIRING CERTAIN
BUILDINGS; INSTITUTIONS, ESTABLISHMENTS, AND PUBLIC UTILITIES TO INSTALL
FACILITIES AND OTHER SERVICES.
Be it enacted by the Batasang Pambansa in session assembled:
Section 1. In order to promote the realization of the rights of disabled persons
to participate fully in the social life and the development of the societies in which they
live and the enjoyment of the opportunities available to other citizens, no license or
permit for the construction, repair or renovation of public and private buildings for
public use, educational institutions, airports, sports and recreation centers and
complexes, shopping centers or establishments, public parking places, workplaces,
public utilities, shall be granted or issued unless the owner or operator thereof shall
install and incorporate in such building, establishment, institution or public utility, such
architectural facilities or structural features as shall reasonably enhance the mobility of
disabled persons such as sidewalks, ramps, railings and the like. If feasible, all such
existing buildings, institutions, establishments, or public utilities may be renovated or
altered to enabled the disabled persons to have access to them: Provide, however, That
buildings, institutions, establishments, or public utilities to be constructed or
established for which licenses of permits had already been issued may comply with the
requirements of this law.

• Construction without building permit

• Non-compliance with the approved plan causing violation with


the zoning ordinance, the building code and other referral code.

• Problems regarding lot ownership
