3 Menurut Buchhols (1947), Jaksa Learned Hand
menetapkan sebuah analisis hukum KELEMBAGAAN tentang
kelalaian dengan mengidentifikasi 3 faktor kunci sebagai berikut :

1. Kemungkinaan terjadinya kerusakan (the probability of

injury, P)
2. Akibat atau kerugian karena kerusakan (the extend of injury or
loose, L)
3. Biaya untuk menghindari terjadinya kecelakaan (cost of
preventing the accident, C)

Secara matematis dapat ditulis : PxL>C

Secara geografis Kabupaten Tulungagung terletak antara
koordinat (111°43' - 112°07') Bujur Timur dan (7°51' – 8°18')
Lintang Selatan.
Fisiografi wilayah Kabupaten Tulungagung menunjukkan
adanya dataran rendah, perbukitan bergelombang serta
daerah lereng Gunung Wilis. Adapun secara garis besar
KEADAAN dapat dibedakan sebagai berikut:

GEOGRAFIS Bagian utara (barat daya) seluas +25%, adalah daerah

lereng gunung yang relatif subur yang merupakan bagian
tenggara dari Gunung Wilis.
Bagian selatan seluas +40% adalah daerah perbukitan yang
relatif tandus, namun kaya akan potensi hutan (walaupun
akhir-akhir ini terjadi kerusakan besar-besaran) dan bahan
tambang merupakan bagian dari pegunungan selatan
Jawa Timur.
Bagian Tengah seluas +35% adalah dataran rendah yang
subur dimana dataran ini dilalui oleh Sungai Brantas dan
Sungai Ngrowo beserta cabang-cabangnya.

POTENSI
Secara Geografis Kabupaten tulungagung
berbatasan langsung dengan samudera hindia
dengan lebih dari 80 % wilyahnya adalah
PERIKANAN dataran rendah maka diperkirakan daerah ini
memiliki potensi sumberdaya perikanan yang
besar. Hal itu di dukung dengan penerapat
wilayah pembangunan di tulungagung pada
sub SWP (Satuan wilyah Pembangunan) Tulung
agung yang berfokus pada sector perikanan.
