Aturan mengenai pers di Indonesia diatur
oleh Undang-undang No.40 tahun 1999
tentang pers.
Segala bentuk aktivitas jurnalisme, baik
yang menggunakan media cetak, media
penyiaran, dan media baru dilindungi dan
dijamin oleh Undang-undang Pers.
BAGAIMANA DENGAN MEDIA ONLINE ???
1. Pada perkembangannya, praktik jurnalistik pada media online
tidak sesederhana formulasi pada undang-undang Pers.
2. Ruang lingkup media baru yang menghadirkan sedemikian
banyak kebaruan menghadirkan persoalan dilematis karena karakter
media yang berbeda.
3. Karakter media yang berbeda membuat aktivitas jurnalistik pada
media baru juga mengalami pergeseran dan dinamika yang luar
biasa. Hal ini pula yang kemudian menghadirkan persoalan
dilematis di wilayah normatif dan etis
 persoalan
Pertama, Bagaimana posisi Undang-undang Pers dalam konteks hukum media di Indonesia, baik
dalam perspektif lex spesialis maupun perspektif lex generalis.
Kedua, posisi Undang-undang Pers dilihat dalam konteks empirik pada berbagai kasus jurnalisme
media online di Indonesia.
Konteks empirik ini lebih melihat pada bagaimana fakta yang terjadi di wilayah hukum dalam
menanggapi berbagai persoalan terkait pers di media online.

rujukan terdapat pengaturan mengenai Pers.

Kebebasan pers ini menjadi semakin tertantang untuk dijamin dan
dilaksanakan dengan kehadiran media digital yang mengubah ekosistem media. Ekosistem media
yang dimaksudkan disini adalah wilayah ekologi media dimana aktivitas aktivitas pers berlangsung.

Munculnya jurnalisme online atau dikatakan juga sebagai jurnalisme konvergensi adalah salah
satunya (Quinn, 2005). Belum lagi dengan berbagai implikasi lain yang muncul mengiringinya
misalnya, munculnya banyak perusahaan pers yang tidak terlegitimasi, adanya fenomena hoax,
tantangan pada pelaksanaan televisi digital, dan sebagainya.
Disahkannya Pedoman Media Siber
Menjadi pelengkap untuk Kode Etik Jurnalistik dan
Undang-undang Pers.
Kedua, Undang undang Informasi dan Transaksi Elektronik.
Secara eksplisit undang-undang ini memang tidak diperuntukkan untuk pers dalam wilayah media digital. Hanya saja, dalam
beberapa kasus yang muncul terdapat wartawan atau bahkan media online terjerat undang-undang ini. Dalam kondisi inilah
menjadi penting untuk meletakkan kembali undang-undang pers dan kebebasan pers dalam konteks ekosistem media digital.
