Izin merupakan alat pemerintah yang bersifat yuridis

preventif, dan digunakan sebagai instrumen administrasi
untuk mengendalikan perilaku masyarakat. Oleh karena itu
terdapat dua fungsi yaitu fungsi sifat preventif dan represif
• izin bersifat preventif, karena dalam instrumen izin, tidak
bisa dilepaskan dengan perintah dan kewajiban yang
harus ditaati oleh pemegang izin
• izin bersifat represif. Izin dapat berfungsi sebagai
instrumen untuk menanggulangi masalah lingkungan
disebabkan aktivitas manusia yang melekat dengan dasar
perizinan. Artinya suatu usaha yang memperoleh izin atas
pengelolaan lingkungan, dibebani kewajiban untuk
melakukan penanggulangan pencemaran atau perusakan
lingkungan yang timbul dari aktivitas usahanya

Menjadikan konsep perizinan itu sesuai dengan semangat Negara hukum

yang demokratis. Maka dari itu terdapat prinsip-prinsp berikut harus
menjadi patokannya. Dimana kalau berbicara gagasan demokrasi yang
berdasar atas hukum (constitutional democracy) mengandung prinsip
pokok, yaitu:
• Adanya jaminan persamaan dan kesetaraan dalam kehidupan
bersama,
• Pengakuan dan penghormatan terhadap perbedaan atau pluralitas,
• Adanya aturan yang mengikat dan dijadikan sumber rujukan bersama,
dan
• Adanya mekanisme penyelesaian sengketa berdasarkan mekanisme
aturan yang ditaati bersama itu.
• Pengakuan dan penghormatan terhadap hak asasi manusia
• Pembatasan kekuasaan melalui mekanisme pemisahan dan
pembagian kekuasaan disertai mekanisme penyelesaian sengketa
ketatanegaraan antar lembaga Negara, baik secara vertikal maupun
horizontal

Konstitusional Warga Negara

Kasus yang cukup aktual

Kementerian Energi dan Sumber Daya Mineral telah
merekomendasikan pencabutan surat keputusan Bupati
Bima, Nusa Tenggara Barat, tentang izin eksplorasi
pertambangan kepada PT Sumber Mineral Nusantara di
daerah itu. Pencabutan harus dilakukan mengingat
kegiatan eksplorasi pertambangan telah menimbulkan
kerusuhan yang menelan korban jiwa dan terjadi
penolakan keras dari warga setempat. Kewenangan
penerbitan dan pencabutan berada pada kepala daerah
ssesuai dengan uu no 4 tahun 2009.
