Pengawasan adalah suatu proses pengamatan daripada pelaksanaan seluruh kegiatan organisasi untuk menjamin agar
semua pekerjaan yang sedang dilakukan berjalan sesuai dengan rencana yang telah ditentukan sebelumnya. Pengawasan
bertujuan agar pelaksanaan tugas yang telah ditetapkan dapat mencapai yang dikehendaki dan terhindar dari
penyimpangan-penyimpangan. Begitu pula dengan notaris diperlukan pengawasan secara optimal demi kelancaran
pelayanan kepentingan masyarakat. Pengawasan notaris dilakukan oleh Majelis Pengawas yang dibentuk oleh Menteri
Hukum dan HAM. Berdasarkan Pasal 68 UUJN Majelis Pengawas terdiri dari:
1. Majelis Pengawas Daerah (MPD);
2. Majelis Pengawas Wilayah (MPW); dan
3. Majelis Pengawas Pusat (MPP).

Selain Majelis Pengawas, pengawasan notaris juga dilakukan oleh Majelis Kehormatan Notaris (MKN) yang mempunyai
kewenangan untuk melaksanakan pembinaan notaris dan berkewajiban memberikan persetujuan atau penolakan untuk
kepentingan penyidikan dan proses peradilan. MKN dibentuk berdasarkan Permenkumham Nomor 17 Tahun 2021.
Berdasarkan Pasal 3 MKN terdiri atas:

4. Majelis Kehormatan Notaris Pusat; dan

5. Majelis Kehormatan Notaris Wilayah.
 1. Provinsi Jambi
MPD Jambi dalam melaksanakan tugas dan fungsi kewenangan menemukan berbagai macam pelanggaran yang dilakukan oleh
para notaris, namun MPD tidak dapat berbuat banyak karena MPD hanya dapat melakukan pemeriksaan laporan masyarakat atas
dugaan pelanggaran kode etik notaris saja sehingga tidak berwenang dalam menjatuhkan sanksi, birokrasi yang terlalu rumit
menyebabkan penjatuhan sanksinya berjalan lamban dan kurang efektif.
Adapun kendala internal yang dihadapi MPD Jambi terdapat pada sekretariat MPD belum optimal dalam mendukung kinerja MPD,
dikarenakan sekretaris masih merangkap jabatan sebagai perancang. Sementara untuk kendala eksternal MPD terhadap notaris
berhubungan dengan masih banyak notaris yang belum rapi seperti saat dilakukan uji petik notaris ditemukan kelemahan dan
disarankan untuk dikoreksi namun tidak dikoreksi.
Berkaitan dengan pembinaan, MPD selalu memberikan masukan mengenai pentingnya administrasi pada notaris yangmana selama
ini belum begitu efektif karena kewenangan MPD hanya memberikan nasehat saja, sehingga menurut responden kedepannya MPD
perlu diberikan kewenangan untuk memeriksa dan memberikan sanksi terhadap berbagai pelanggaran yang dilakukan notaris sesuai
ketentuan UUJN karena pengawasan tanpa wewenang jelas menimbukan beberapa permasalahan seperti notaris kurang menghargai
MPD sehingga pelanggaran yang dilakukan cenderung berulang.
MPW Provinsi Jambi dalam kaitan pemberian sanksi hanya berwenang untuk memberi sanksi teguran lisan dan tertulis,
sementara untuk sanksi berat seperti pemberhentian sementara 3 (tiga) sampai 6 (enam) bulan atau pemberhentian dengan
tidak hormat dapat mengusulkan kepada MPP.
