disebut PIHAK KEDUA.

the SECOND PARTY.

Kedua belah pihak dengan ini menerangkan bahwa PIHAK PERTAMA selaku
pemilik sah telah setuju untuk menyewakan kepada PIHAK KEDUA, dan
PIHAK KEDUA telah setuju untuk menyewa dari PIHAK PERTAMA berupa:
Both parties hereby declare that the FIRST PARTY as the lawful owner has agreed to
lease to the SECOND PARTY, and the SECOND PARTY has agreed to lease from the
FIRST PARTY, the following:

Untuk selanjutnya disebut KENDARAAN.

Hereinafter referred to as the VEHICLE.

Selanjutnya kedua belah pihak bersepakat bahwa perjanjian sewa-menyewa

KENDARAAN harian antara PIHAK PERTAMA dan PIHAK KEDUA ini
berlaku sejak tanggal penandatanganan surat perjanjian ini dimana syarat-
syarat serta ketentuan-ketentuan dalam surat perjanjian ini diatur dalam 10
(sepuluh) pasal, sebagai berikut:
Further, both parties agree that this daily rental agreement of the VEHICLE between
the FIRST PARTY and the SECOND PARTY shall be effective from the date of signing
of this agreement, wherein the terms and conditions of this agreement are regulated in
10 (ten) articles, as follows:

PASAL 1
MASA BERLAKUNYA PERJANJIAN SEWA
ARTICLE 1
DURATION OF THE RENTAL AGREEMENT

Ayat 1
Sewa-menyewa ini dilangsungkan untuk jangka waktu [( ---- ) (----- jumlah

Clause 1
This lease shall be for a period of [(----) (----- amount in words -----)] days,
commencing from the date of (---- date, month, and year ----) and ending on the

Ayat 2
Setelah jangka waktu tersebut lampau, maka sewa-menyewa ini dapat
diperpanjang untuk jangka waktu dan dengan syarat-syarat serta
ketentuan-ketentuan yang akan ditentukan dalam Surat Perjanjian
tersendiri.

Clause 2
After the expiration of said period, this lease may be extended for a period and
under terms and conditions to be determined in a separate Agreement.

PASAL 2
HARGA SEWA
ARTICLE 2
RENTAL PRICE

Ayat 1
Harga sewa atas KENDARAAN sehari adalah [(Rp. ------------,00) (------
jumlah uang dalam huruf ------ )] sehingga untuk seluruh jangka waktu sewa
berjumlah [(Rp. ------------,00) (------ jumlah uang dalam huruf ------ )] yang
keseluruhannya akan dibayarkan PIHAK KEDUA secara sekaligus
bersamaan dengan penandatanganan Surat Perjanjian ini.

Clause 1
The daily rental price for the VEHICLE is [(Rp. ------------,00) (------ amount in words -
-----)], so that for the entire rental period it amounts to [(Rp. ------------,00) (------
amount in words ------)], all of which shall be paid by the SECOND PARTY in full
together with the signing of this Agreement

Ayat 2
Surat Perjanjian ini berlaku sebagai tanda bukti pelunasan yang sah dari
sejumlah uang sewa KENDARAAN termaksud.

Clause 2
This Agreement shall serve as valid proof of payment for the rental amount of the
said VEHICLE.

 PASAL 3
JAMINAN
ARTICLE 3
SECURITY DEPOSIT

Ayat 1
PIHAK KEDUA memberikan jaminan kepada PIHAK PERTAMA berupa
uang sejumlah [(Rp. ------------,00) (------ jumlah uang dalam huruf ------ )].
Clause 1
The SECOND PARTY shall provide a security deposit to the FIRST PARTY in
the amount of [(Rp. ------------,00) (------ amount in words ------)].

Ayat 2
Uang jaminan tersebut sepenuhnya akan dikembalikan PIHAK
PERTAMA kepada PIHAK KEDUA setelah PIHAK KEDUA
mengembalikan KENDARAAN.
Clause 2
The security deposit shall be fully refunded by the FIRST PARTY to the
SECOND PARTY upon the return of the VEHICLE.

PASAL 4
PENYERAHAN KENDARAAN
ARTICLE 4
DELIVERY OF THE VEHICLE

Ayat 1
PIHAK PERTAMA menyerahkan KENDARAAN kepada PIHAK
KEDUA setelah ditandatanganinya Surat Perjanjian ini berikut Surat
Tanda Nomor Kendaraan (STNK) dari KENDARAAN yang dimaksud.

Clause 1
The FIRST PARTY shall deliver the VEHICLE to the SECOND PARTY upon
the signing of this Agreement along with the Vehicle Registration Certificate
(STNK) of the VEHICLE in question.

Ayat 2
Dalam perjanjian sewa mobil harian ini PIHAK KEDUA tidak
membutuhkan jasa pengemudi atau sopir dari PIHAK PERTAMA.

Clause 2
In this daily car rental agreement, the SECOND PARTY does not require the services
of a driver from the FIRST PARTY.

Ayat 3

 PIHAK KEDUA wajib menyerahkan kembali KENDARAAN tersebut
kepada PIHAK PERTAMA dalam keadaan jalan, terawat baik, dan
kondisinya lengkap seperti ketika PIHAK KEDUA menerimanya dari
PIHAK PERTAMA setelah perjanjian sewa-menyewa ini berakhir.

Clause 3
The SECOND PARTY shall return the VEHICLE to the FIRST PARTY in a
roadworthy condition, well-maintained, and in complete condition as when received
from the FIRST PARTY upon the expiration of this rental agreement.

PASAL 5
KETERLAMBATAN PENYERAHAN KENDARAAN
ARTICLE 5
DELAY IN DELIVERY OF THE VEHICLE

Apabila PIHAK KEDUA terlambat mengembalikan KENDARAAN selama

jangka waktu [( ---- ) (----- jumlah dalam huruf ----- )] hari, terhitung sejak
berakhirnya perjanjian ini, PIHAK KEDUA dinyatakan melakukan
pelanggaran dan tidak berkeberatan dituntut melakukan pelanggaran tindak
pidana sesuai Pasal 372 Kitab Undang-Undang Hukum Pidana (KUHP).

If the SECOND PARTY is late in returning the VEHICLE for a period of [(----) (-----
amount in words -----)] days, calculated from the expiration of this agreement, the
SECOND PARTY shall be deemed to have committed a violation and shall not object to
being prosecuted for the offense under Article 372 of the Criminal Code.

PASAL 6
HAK DAN TANGGUNG JAWAB PIHAK KEDUA
ARTICLE 6
RIGHTS AND RESPONSIBILITIES OF THE SECOND PARTY

Ayat 1
PIHAK KEDUA berhak sepenuhnya untuk menggunakan KENDARAAN
yang disewanya dengan Perjanjian ini.

Clause 1
The SECOND PARTY shall have the full right to use the leased VEHICLE under this
Agreement.

Ayat 2
Mengingat KENDARAAN telah dipegang oleh PIHAK KEDUA sebagai
penyewa, karenanya PIHAK KEDUA bertanggung jawab penuh untuk
merawat dan menjaga keutuhan serta kebaikan kondisi KENDARAAN
tersebut sebaik-baiknya atas biaya PIHAK KEDUA sendiri.

Clause 2
Since the VEHICLE is held by the SECOND PARTY as the lessee, the SECOND
PARTY shall be fully responsible for maintaining and preserving the integrity
and good condition of the VEHICLE at the best of their ability at their own
expense.

PASAL 7
KERUSAKAN DAN KEHILANGAN
ARTICLE 7
DAMAGE AND LOSS

Ayat 1
Apabila terjadi kerusakan pada KENDARAAN, PIHAK KEDUA
diharuskan memperbaikinya, diwajibkan mengganti spare part
KENDARAAN yang rusak akibat pemakaian yang menyebabkan spare
part tersebut tidak dapat digunakan lagi dengan spare part yang sama, dan
semua biaya tersebut dibebankan sepenuhnya kepada PIHAK KEDUA.

Clause 1
In the event of damage to the VEHICLE, the SECOND PARTY shall be required to
repair it, replace damaged vehicle parts due to usage that render such parts unusable
with similar spare parts, and all such costs shall be fully borne by the SECOND
PARTY.

Ayat 2
PIHAK KEDUA dibebaskan dari segala ganti rugi atau tuntutan dari
PIHAK PERTAMA akibat kerusakan pada KENDARAAN yang
diakibatkan oleh force majeure.
Yang dimaksud dengan Force majeure adalah:
1. Bencana alam, seperti: banjir, gempa bumi, tanah longsor, petir, angin
topan, serta kebakaran yang disebabkan oleh faktor extern yang
mengganggu kelangsungan perjanjian ini.
2. Huru-hara, kerusuhan, pemberontakan, dan perang.

Clause 2
The SECOND PARTY shall be exempt from any indemnity or claims from the FIRST
PARTY due to damage to the VEHICLE caused by force majeure.
Force majeure refers to:

 1. Natural disasters, such as: floods, earthquakes, landslides, lightning,
hurricanes, and fires caused by external factors that disrupt the continuity of
this agreement.
2. Riots, civil unrest, rebellions, and wars.

Ayat 3
Apabila terjadi kehilangan KENDARAAN karena kelalaian PIHAK
KEDUA, maka PIHAK KEDUA diharuskan untuk mengganti dengan
KENDARAAN sejenis dengan tahun pembuatan dan kondisi sesuai atau
sebanding dengan KENDARAAN yang disewanya.

Clause 3
In the event of loss of the VEHICLE due to the negligence of the SECOND PARTY, the
SECOND PARTY shall be required to replace it with a similar VEHICLE with the
same year of manufacture and condition or comparable to the leased VEHICLE.

PASAL 8
LAIN-LAIN
ARTICLE 8
OTHERS

Hal-hal yang belum tercantum dalam perjanjian ini akan diselesaikan secara
kekeluargaan atau musyawarah untuk mufakat oleh kedua belah pihak.

Matters not specified in this agreement shall be resolved amicably or by mutual consent
of both parties.

PASAL 9
PENYELESAIAN PERSELISIHAN
ARTICLE 9
DISPUTE RESOLUTION

Apabila terjadi perselisihan dan tidak bisa diselesaikan secara kekeluargaan

atau musyawarah untuk mufakat, kedua belah pihak bersepakat untuk
menyelesaikannya secara hukum dan kedua belah pihak telah sepakat untuk
memilih tempat tinggal yang umum dan tetap di ( ------ Kantor Kepaniteraan
Pengadilan Negeri ------ ).
In the event of a dispute that cannot be resolved amicably or by mutual consent, both
parties agree to settle it through legal means, and both parties have agreed to choose
their general and permanent place of residence at the (------ District Court Registry
Office ------).

 PASAL 10
PENUTUP
ARTICLE 10
CLOSING

Surat perjanjian ini dibuat rangkap 2 (dua) dengan dibubuhi materei

secukupnya yang berkekuatan hukum yang sama yang masing-masing
dipegang PIHAK PERTAMA dan PIHAK KEDUA dan mulai berlaku sejak
ditandatangani kedua belah pihak.
This agreement is made in duplicate with sufficient stamps of equal legal force, each
held by the FIRST PARTY and the SECOND PARTY and shall be effective from the
date of signature by both parties.
