 BAB I
PENDAHULUAN
1.1 Latar Belakang
Indonesia merupakan negara hukum yang yang berlandaskan
UUD 1945 dan Pancasila, dengan menjadi negara hukum bertujuan
untuk menciptakan kehidupan bermasyarakat yang aman dan
sejahtera juga agar terciptanya negara yang kondusif. Melalui
aparaturnya pemerintah harus berperan aktif demi mewujudkan
tujuannya tersebut. Terdapat tindakan atau perbuatan pemerintah
yang dilaksanakan untuk menjaga hubungan pemerintah dengan
masyarakatnya.
Perbuatan pemerintah pada dasarnya merupakan tindakan hukum
yang dilakukan oleh aparatur pemerintahan dalam melaksanakan
fungsinya dalam hal ini dilakukan untuk kepentingan umum,
termasuk diantaranya membuat ketetapan atau keputusan. Istilah
perbuatan pemerintah merupakan terjemahan dari Bestuurhandeling
(Belanda), perbuatan atau pemerintahan merupakan tindakan atau
perbuatan dari alat administrasi negara melingkupi juga perbuatan di
luar lapangan hukum administrasi.
Perbuatan-perbuatan penyelenggara pemerintah tersebut dapat
digolongkan menjadi dua, yaitu:

1. Perbuatan non yuridis yaitu perbuatan pemerintah yang tidak

berakibat hukum atau sering juga disebut perbuatan pemerintah yang
didasarkan pada fakta-fakta saja (feitelijke handeling),seperti
perbuatan pemerintah untuk meresmikan jembatan dan sebagainya.
2. Perbuatan yuridis (rechtshandeling) yaitu perbuatan pemerintah
yang berakibat hukum. Bagi hukum administrasi negara yang lebih
penting adalah perbuatan yang dilakukan oleh penyelenggara
pemerintahan atau negara yang berakibat hukum, dan yang bukan
perbuatan hukum dalam hukum administrasi negara tidak penting
atau tidak dipermasalahkan.
 BAB II PEMBAHASAN
2.1 Pengertian Perbuatan Pemerintah
Tindakan atau perbuatan pemerintah merupakan tiap-tiap tindakan
atau perbuatan dari suatu alat administrasi negara (bestuur organ),
melingkupi juga perbuatan ataupun hal-hal yang berada di luar lapangan
hukum administrasi negara, misalnya keamanan, peradilan dan yang
lainnya. Tindakan ini dimaksudkan menimbulkan akibat hukum dalam
bidang hukum administrasi, atau perbuatan pemerintah adalah perbuatan
yang dilakukan oleh pejabat tata usaha negara dalam rangka melaksanakan
urusan pemerintahan.
Menurut Romijen, perbuatan pemerintah yang merupakan “ bestuur
handling “ yaitu tiap-tiap dari alat perlengkapan pemerintah.
Menurut Van Vallen Hoven, perbuatan pemerintah merupakan
tindakan secara spontan atas inisiatif sendiri dalam menghadapi keadaan
dan keperluan yang timbul tanpa menunggu perintah atasan,dan atas
tanggung jawab sendiri demi kepentingan umum.

Menurut E. Utrecht, “Perbuatan pemerintah ialah tiap-tiap perbuatan yang

dilakukan pemerintah dengan maksud untuk menyelenggarakan
kepentingan umum, termasuk perbuatan mengadakan peraturan maupun
perbuatan mengadakan ketetapan atau perjanjian.”
2.2 Jenis-Jenis Perbuatan Pemerintah

Adapun Jenis-Jenis Perbuatan Pemerintah yaitu:

1. Feitelijk Handelingen (Tindakan Materiil/Tindakan Faktual)
Tindakan materiil merupakan tindakan nyata atau fisik yang
dilakukan oleh Pemerintahan. Tindakan materiil akan selalu bersegi
satu karena bersifat sepihak saja. Oleh karenanya segala jenis
Feitelijk Handelingen masuk ke dalam ranah hukum publik.

2. Echtshandelingen (Tindakan Hukum)

Sebagaimana telah dijelaskan sebelumnya, bahwa Tindakan Hukum
ini ada yang bersegi satu dan ada yang bersegi dua. Indroharto
menyatakan bahwa Bestuur Handelingen atau tindakan administrasi
pemerintahan haruslah selalu bersifat sepihak dan bersegi satu
oleh karena yang masuk ke dalam ranah hukum administrasi (TUN)
hanya tindakan hukum sepihak dan bersegi satu. Sedangkan
tindakan hukum yang bersegi dua maka masuk ke dalam perbuatan
hukum perdata (atau campuran publik-perdata).
2.3 Tindakan Hukum Bersegi Satu dan Tindakan Hukum Bersegi Dua

Tindakan Hukum Bersegi Satu (Eenzijdige Publiek Rechtshandelingen)

Sesuai dengan tugas administrasi yakni “mengatur” dan “mengurus”, maka
bentuk dari tindakan Administrasi Pemerintahan dapat berupa
pengaturan (regeling, pseudo-wetgeving), atau keputusan/penetapan
(beschikking, plan).

Tindakan Hukum Bersegi Dua (Tweezijdige Publiek Rechtshandelingen)

Tindakan bersegi dua ini adalah tindakan yang dibuat oleh Pemerintah
tidak sepihak, artinya melibatkan pihak lain. Contoh konkret dari Tindakan
ini adalah kontrak antara pemerintah dengan pihak swasta (warga
Masyarakat).
