01 Obat legal & ilegal
OBAT LEGAL :
Obat adalah obat jadi termasuk produk biologi, yang merupakan bahan atau
paduan bahan digunakan untuk mempengaruhi atau menyelidiki sistem
fisiologi atau keadaan patologi dalam rangka penetapan diagnosis,
pencegahan, penyembuhan, pemulihan dan peningkatan kesehatan, dan
kontrasepsi untuk manusia.

OBAT ILEGAL :
suatu barang di katakan ilegal adalah apabila bertentangan atau dilarang oleh
hukum, khususnya hukum pidana Obat yang di produksi oleh yang tidak
berhak berdasarkan peraturan perundang - undangan yang berlaku, obat
yang tidak terdaftar, dan obat yang kadar zat berkhasiatnya menyimpang
lebih dari 20% dari batas kadar yang di tetapkan.

PERATURAN MENTERI KESEHATAN NOMOR 1148/MENKES/PER/VI/2011
TENTANG PEDAGANG BESAR FARMASI
Menurut pasal 4, Untuk memperoleh izin PBF, pemohon harus memenuhi persyaratan
sebagai berikut:

a. berbadan hukum berupa perseroan terbatas atau koperasi

b. memiliki Nomor Pokok Wajib Pajak (NPWP)
c. memiliki secara tetap apoteker Warga Negara Indonesia sebagai penanggung jawab
d. komisaris/dewan pengawas dan direksi/pengurus tidak pernah terlibat baik langsung atau tidak
langsung dalam pelanggaran peraturan perundang-undangan di bidang farmasi dalam kurun
waktu 2 (dua) tahun terakhir
e. menguasai bangunan dan sarana yang memadai untuk dapat melaksanakan pengadaan,
penyimpanan dan penyaluran obat serta dapat menjamin kelancaran pelaksanaan tugas dan
fungsi PBF
f. menguasai gudang sebagai tempat penyimpanan dengan perlengkapan yang dapat menjamin
mutu serta keamanan obat yang disimpan dan
g. memiliki ruang penyimpanan obat yang terpisah dari ruangan lain sesuai CDOB.
Menurut Pasal 7
(1) Untuk memperoleh izin PBF, pemohon harus mengajukan permohonan kepada
Direktur Jenderal dengan tembusan kepada Kepala Badan, Kepala Dinas Kesehatan
Provinsi dan Kepala Balai POM dengan menggunakan contoh Formulir 1 sebagaimana
terlampir.
(2) Permohonan harus ditandatangani oleh direktur/ketua dan apoteker calon penanggung
jawab disertai dengan kelengkapan administratif sebagai berikut:
a. fotokopi Kartu Tanda Penduduk (KTP)/identitas direktur/ketua
b. susunan direksi/pengurus
c. pernyataan komisaris/dewan pengawas dan direksi/pengurus tidak pernah terlibat
pelanggaran peraturan perundangundangan di bidang farmasi dalam kurun waktu 2 (dua)
tahun terakhir
d. akta pendirian badan hukum yang sah sesuai ketentuan peraturan perundang-undangan
e. surat Tanda Daftar Perusahaan
f. fotokopi Surat Izin Usaha Perdagangan
g. fotokopi Nomor Pokok Wajib Pajak
h. surat bukti penguasaan bangunan dan gudang
i. peta lokasi dan denah bangunan
j. surat pernyataan kesediaan bekerja penuh apoteker penanggung jawab
k. fotokopi Surat Tanda Registrasi Apoteker penanggung jawab.

(3) Untuk permohonan izin PBF yang akan menyalurkan bahan obat selain harus memenuhi
persyaratan sebagaimana dimaksud pada ayat (2) harus melengkapi surat bukti penguasaan
laboratorium dan daftar peralatan.

 Pasal 106
(1) Sediaan farmasi dan alat kesehatan hanya dapat diedarkan setelah mendapat izin
edar.
(2) Penandaan dan informasi sediaan farmasi dan alat kesehatan harus memenuhi
persyaratan objektivitas dan kelengkapan serta tidak menyesatkan.
(3) Pemerintah berwenang mencabut izin edar dan memerintahkan penarikan dari
peredaran sediaan farmasi dan alat kesehatan yang telah memperoleh izin edar, yang
kemudian terbukti tidak memenuhi persyaratan mutu dan/atau keamanan dan/atau
kemanfaatan, dapat disita dan dimusnahkan sesuai dengan ketentuan peraturan
perundang-undangan.
 Pasal 197
Setiap orang yang dengan sengaja memproduksi atau mengedarkan
sediaan farmasi dan/atau alat kesehatan yang tidak memiliki izin
edar sebagaimana dimaksud dalam Pasal 106 ayat (1) dipidana
dengan pidana penjara paling lama 15 (lima belas) tahun dan
denda paling banyak Rp1.500.000.000,00 (satu miliar lima ratus
juta rupiah).
