Pihak Kedua setuju untuk tidak menggunakan Informasi rahasia termasuk LOA untuk tujuan apapun kecuali dengan persetujuan tertulis dari Pihak Pertama untuk pengungkapan tersebut. Diperlukan surat dukungan spesifik untuk partisipasi dalam tender tertentu. 2. Apabila ada material limbah yang tidak sesuai dengan sample awal yang disediakan oleh Pelanggan ("ketidaksesuatan limbah), Pihak pertama berhak memusnahkan limbah tersebut di fasiitas/-maupun fasilitas lainnya dengan catatan apabila ada biaya tambahan atas pengolahan dan pemusnahannya akan dibebankan atas persetujuan Pelanggan. [par PakLETTER OF AGREEMENT ‘Second Party shall in addition to provide any labeling, packaging, symbol or other such document required by law and applicable regulations. First Party has the rightto impose additional fee to the Second Party ifthe waste that has been sent is different from the type of waste contained in the Quotation and Confirmation Letter that has been signed by the Second party. First party has the right to impose additional fee of 10% of the total invoice of waste treatment fees to the Second Party if the waste that has been sent is in a package that is not suitable for transport. First Party has the right to determine the weight (in tons or drums or other measure) or volume in M® or other measure of the Waste accepted in the First Party's facility based on the scales of the First Part and/or the Second Party. If Second Party have own calibrated scale on their site, any discrepancy of ‘measurement for more than 10% both parties will look for any possible difference and agreed on ‘measurement to be used for invoice. Non-Disclosure Obligations = Second Party agree to hold the disclosing party's Confidential information in strict confident in accordance with this agreement. = Second Party agree not to disclose any confidential information including its LOA to third parties (including, without limitation, any clients, affiliates, independent contractors and consultant) without the prior written consent of the disclosing party except as expressly permitted inthis agreement. Limitation of Liability = Second Party's shall be liable for any incidental, special or consequential damages during handling and transportation of the waste before given to First Party. = First Party's shall be liable for any incidental, special or consequential damages during transportation from Second Party Facility to First Party Facility, treatment and disposal after the waste received based on standard operation procedure applied in First Party's facility. Page 2 of 3 3. Pihak Kedua berkewajiban memberikan label, kemasan, simbol atau dokumen lain sebagaimana diwajibkan oleh undang-undang dan peraturan yang berlaku. 4. Pihak Pertama bethak mengenakan biaya tambahan kepada Pihak Kedua apabita limbah yang telah dikirim berbeda dengan jenis limbah yang terdapat dalam perhitungan biaya yang telah ditandatangani oleh Pihak Pertama, 5. Pihak Pertama berhak mengenakan biaya tambahan sebesar 10% dari total tagihan biaya pengolahan kepada Pihak Kedua apabila limbah yang telah dikirim berada dalam kemasan yang tidak layak angkat. 6. Pihak Pertama mempunyat hak untuk menentukan uukuran berat (dalam ton atau drum atau ukuran Jainnya) atas limbah yang diterima di fasilitas Pihak Pertama berdasarkan timbangan Pihak Pertama dan/atau Pihak Kedua yang akan digunakan untuk penagihan. Apabila Pihak kedua juga memiliki ‘timbangan yang terkalibrasi dan selisihnya/perbedaannya lebih dari 10% (sepuluh persen) maka kedua belah pihak akan menelusuri adanya perbedaan tsb hingga dicapai kesepakatan berat per netto yang akan dipakai sebagai dasar penagihan/pembayaran. 7. Kewajiban Tidak Mengungkapkan + Pihak Kedua setuju untuk menyimpan informasi rahasia sesuai dengan perjanjian in + Pihak Kedua setuju untuk tidak mengungkapkan informasi rahasia termasuk LOA tersebut kepada pihak ketiga (termasuk, tanpa batasan, setiap Ikien, afiliasi, kontraktor independen dan konsultan) tanpa persetujuan tertulis dari Pihak Pertama kecuali difzinkan secara tertulis dalam perjanjian ini. 8 Batas Pertanggungjawaban ~ Pihak Kedua bertanggung jawab penuh atas resiko dan akibat yang mungkin timbul dari kegiatan pengangkutan serta handling limbah tsb sebelum diserahkan kepada Pihak Pertama. - Pihak Pertama bertanggung jawab penuh atas resiko dan akibat yang mungkin ditimbulkan dari kegiatan Pengangkutan dari Lokasi Pihak Kedua ke Lokasi Pihak pertama serta pengolahan limbah limbah tsb sejak diterimanya limbah tersebut di fasilitas Pihak Pertama sesuai dengan standar prosedur yang berlaku di fasiltas Pihak Pertama.LETTER OF AGREEMENT 9. Payment of Service Fee = Second Party's agrees to pay Service Fee to First Party’sas specified in the Quotation (Attachment 1) within 30 (thirty) days of the date of invoice.
