The purpose of this research were to find out and analyze protection regulation and regulation of
banking responsibility at costumer personal data that disadvantage by using internet banking.
This research is a normative juridical which means this legal research obtained by examining
library materials or secondary data. The approach of that writer use in this research is statutory
approach, conceptual approach, and case approach. The result of the research indicate that
regulation of legal protection and bank responsibility for the confidentiality of customer
personal data has not been able to provide legal certainty for the public because the problem still
happen to the costumer that their data is leaking to third party and the bank still didn’t give full
attention to the costumer’s complaint about their personal data that already leaking to the
unauthorized parties. In article 40 Act of the Republic of Indonesia Number 10 of 1998 about
Banking that there is still obscurity of norms regarding the Protection of customer personal
data. Bank Indonesia regulation Number 7/7/PBI/2005 about settlement of costumer’s complaint
as amended by Bank Indonesia regulation Number 10/10/PBI/2008 which by the substance
regulate the settlement of costumer’s complaint. In this condition Bank Indonesia obligates all
banks to resolve all customer’s complaint related to financial losses on the customer side. In this
Bank Indonesia regulation is set procedure of acceptance, handling and monitoring the complaint
settlement too.
