Penyelesaian Kepailitan (Bahasa Indonesia)

proses kepailitan. Untuk tujuan penelitian ini, istilah kredit purna mulai tidak mencakup pinjaman
baru yang ditawarkan sebagai bagian dari rencana reorganisasi.
“Pengelolaan Kurator” adalah proses penunjukan oleh pengadilan, kontrak atau pejabat pemerintah
dari seorang kurator untuk mengambil hak pengelolaan atas properti, bisnis, sewa dan keuntungan
dari debitur yang telah melanggar ketentuan pinjaman dari kreditur dengan membebankan biaya
perusahaan. Seorang kurator dapat diizinkan untuk melanjutkan usaha debitur sebelum menjual
usaha tersebut sebagai bentuk kesinambungan usaha atau sebelum menjual aset secara terpisah
untuk melunasi utang. Untuk tujuan penelitian ini, istilah pengelolaan kurator merujuk hanya untuk
proses resmi di pengadilan.
“Reorganisasi” adalah proses melalui dimana kondisi keuangan dan kelangsungan usaha debitur
dapat dipulihkan berdasarkan suatu rencana reorganisasi, sehingga usaha dapat terus berjalan
melalui cara-cara yang mungkin meliputi pengampunan utang, penjadwalan kembali utang,
konversi utang menjadi ekuitas dan penjualan usaha (atau bagian dari padanya) demi kelangsungan
usaha debitur. Untuk tujuan penelitian ini, istilah reorganisasi merujuk hanya pada proses resmi
pengadilan yang tersedia untuk semua debitur komersial dan tidak mencakup skema pengaturan,
perjanjian di luar pengadilan dengan kreditur atau rencana reorganisasi di hadapan badan-badan
administratif.
“Rencana Reorganisasi” adalah rencana yang dilakukan dimana kondisi keuangan dan
kelangsungan usaha debitur dapat dipulihkan.

likuidasi serta melalui reorganisasi? Harap berikan rincian di bagian komentar, jika ada, atau referensi
