 LATAR BELAKANG
Salah satu dampak negatif dan kemajuan teknologi dalam masyarakat
UMUM adalah terjadinya pergeseran pola hidup, dari pola hidup sederhana
menjadi pola hidup konsumtif. Dengan demikian akan menimbulkan Pola Hidup Konsumtif ialah
suatu tindak kejahatan ataupun pelanggaran dalam memenuhi atau keinginan memiliki barang-barang

Suatu perbuatan tidak dapat dikatakan sebagai tindak pidana jika
perbuatan tersebut tidak secara tegas tercantum dalam KUHP (Kitab

TUJUAN & KEGUNAAN PENELITIAN

Tujuan Penelitian
a. Untuk mengetahui bagaimana penerapan sanksi pidana terhadap
pelaku Tindak Pidana pemalsuan surat berdasarkan Pasal 263
Kitab Undang-undang Hukum Pidana.
b. Untuk mengetahui apa faktor penghambat pada penerapan sanksi
terhadap pelaku tindak pidana pemalsuan surat.

Kegunaan penelitian
a. Secara Akademis/TeoritisSecara akademis diharapkan penulisan
ini dapat memberikan ilmu pengetahuan, terutama disiplin ilmu
Hukum Pidana.
b. Secara Praktis untuk melengkapi bahan-bahan kepustakaan yang

Pengertian Tindak Pidana
Tindak Pidana

Tindak Pidana adalah perbuatan yang dilarang olehsuatu aturan hukum larangan mana
disertai ancaman sanksi yang berupa pidana tertentu, bagi barang siapa melanggar larangan
tersebut. Marwan Mas mengemukakan bahwa perbuatan hukum adalah setiap perbuatan atau
tindakan subjek hukum yang mempunyai akibat hukum, dan akibat hokum itu memang
dikehendaki oleh subjek hukum.
Perbuatan pidana merupakan perbuatan yang bertentangan dengan tata ketertiban yang
dikehendaki oleh hukum.Tegasnya mereka merugikan masyarakat, dalam arti bertentangan

Apakah istilah perbuatan pidana itu dapat disamakan dengan istilah belanda “strafbaar feit”,
yang berarti: Strafbaar adalah suatu pelanggaran norma yang dilakukan secara disengaja
maupun tidak disengaja. Feit berarti handeling kelakukan dan tingkah laku.
Simons menerangkan bahwa strafbaar feit adalah kelakuan (handling) yang diancam dengan
pidana, yang bersifat melawan hukum, yang berhubungan dengan kesalahan dan yang
dilakukan oleh orang yang mampu bertanggung jawab. Simons juga berpendapat bahwa
strafbaar feit adalah perbuatan manusia yang bertentangan dengan hukum, perbuatan
dilakukan oleh seseorang yang dipertanggungjawabkan, dapat diisyaratkan kepada si
pembuatnya (si pelaku
Strafbaar feit sebagai tindakan seseorang (menselijke gedraging) yang telah dirumuskan oleh
wet yang bersifat melawan hukum yang patut dipidanakan (strafwaarding) dan dilakukan
dengan adanya kesalahan.
 Tinjauan Umum Tentang Pemalsuan Surat
Pasal 263 kuhp
1. Barang siapa membuat surat palsu atau memalsukan surat yang dapat menimbulkan sesuatu hak,
perikatan atau pembebasan hutang, atau yang diperuntukkan sebagai bukti daripada sesuatu hal dengan
maksud untuk memakai atau menyuruh orang lain memakai surat tersebut seolah-olah isinya benar dan
tidak dipalsu, diancam jika pemakaian tersebut dapat menimbulkan kerugian, karena pemalsuan surat,
dengan pidana penjara paling lama enam tahun.

Pasal 264 Ayat (1) KUHP

Pasal 264 ayat (1) angka 1 KUHP menjelaskan bahwa tindak pidana pemalsuan surat ancaman lebih berat,
apabila surat tersebut dipalsukan dan surat tersbut adalah surat-surat-surat otentik. Menurut Soesilo surat
otentik merupakan sebuah surat yang dibuat berdasarkan bentuk dan syarat-syaratnya ditetapkan oleh
undang-undang oleh seorang notaris.
TINJAUAN UMUM TENTANG PENERAPAN SANKSI

Kekuasaan Hakim merupakan suatu badan yang menentukan dan mempunyai kekuatan dalam kaidah-kaidah
hukum positif dalam konkretisasi oleh hakim melalui semua keputusannya

Hakim Pengadilan mengambil suatu keputusan dalam sidang pengadilan dengan mempertimbangkan
beberapa aspek yaitu, sebagai berikut:
1. Kesalahan pelaku tindak pidana
2. Motif dan tujuan dilakukannya suatu tindak pidana
3. Pandangan masyarakat terhadap tindak pidana yang dilakukan oleh pelaku
4. Sikap dan tindakan pelaku sesudah melakukan tindak pidana
5. Pengaruh pidana terhadap masa depan pelaku pidana
6. Riwayat hidup dan keadaan sosial ekonomi
7. Sikap batin pelaku tindak pidana
8. Cara melakukan tindak pidana

Hakim memiliki fungsi yaitu memberikan keputusan mengenai perkara

yang telah diajukan di dalam perkara pidana. Tidak hanya itu saja,
dalam menentukan hal tersebut disampingnya terdapat bukti yang
menurut undang-undang juga ditentukan dari keyakinan hakim yang
dilandasi oleh integritas moral yang baik
PUTUSAN HAKIM DALAM PENGADILAN
PUTUSAN AKHIR
Putusan akhir adalah putusan yang mengakhiri pemeriksaan di persidangan,
baik telah melalui semua tahapan pemeriksaan maupun yang tidak atau belum
menempuh semua tahapan pemeriksaan. Putusan yang dijatuhkan sebelum
tahap akhir dari tahap-tahap pemeriksaan, tetapi telah mengakhiri pemeriksaan
yaitu: putusan gugur, putusan Verstek yang tidak diajukan verzet, putusan
tidak menerima, dan putusan yang menyatakan pengadilan agama tidak
berwenang memeriksa

Putusan sela adalah putusan yang dijatuhkan masih dalam proses
pemeriksaan perkara dengan tujuan untuk memperlancar jalannya
pemeriksaan. Putusan sela tidak mengakhiri pemeriksaan, tetapi akan
berpengaruh terhadap arah dan jalannya pemeriksaan. Putusan sela
dibuat seperti putusan biasa, tetapi tidak dibuat secara terpisah,
melainkan ditulis dalam berita acara persidangan saja
