Di dalam suatu perkara perdata, pihak penggugat akan
mengajukan gugatan ke pengadilan negeri. Ketentuan
pengajuan gugatan diatur dalam pasal 118 Reglemen
Indonesia yang Diperbaharui (HIR).
Di dalam artikel Format Surat Gugatan dijelaskan bahwa
secara garis besar surat gugatan biasanya berisi antara
lain :
1. Identitas para pihak (Persona Standi in Judicio)
2. Posita
3. Petitum
 Rekonvensi adalah gugatan
balik yang diajukan oleh
tergugat baik lisan maupun
REKONVENSI
tertulis terhadap gugatan pokok
yang diajukan oleh penggugat.
