Makassar, October 15, 2014. In connection with the completion of the hearing of
decision verdict by the judges of the Makassar District Court for Tax Crimes in the
Regional Office of the Directorate General of Taxation (DGT) South Sulawesi, West
and Southeast with the accused BENNY I MANUHUA (President Director of PT
Printing and Publishing Sulawesi) herewith conveyed the following matters:
1. At the hearing on 15 October 2014 with the agenda of the hearing of the verdict,
the panel of judges of Makassar District Court stated that the defendant BENNY I
MANUHUA (President Director of PT Percetakan and Penerbitan Sulawesi) was
found guilty and sentenced to 10 months imprisonment and a fine of 1 billion
subsidies 4 months confinement. On the verdict, the defendant said he was still
thinking about appeals.
2. In the previous hearing on September 3, 2014 with the agenda of the hearing of the
demands, the Public Prosecutor filed a lawsuit requesting that the judge / judge of the
Makassar District Court decide that the defendant BENNY I MANUHUA (President
Director of PT Percetakan and Penerbitan Sulawesi) was legally and convincingly
proven is guilty of a criminal act in the Field of Taxation that intentionally fails to
submit an Income Tax Return (SPT) of Income Tax (PPh) and intentionally does not
deposit any tax which has been withheld or levied so that it can cause loss to the state
revenue violating Article 39 paragraph 1 letter b and g Law of the Republic of
Indonesia Number 6 Year 1983 regarding General Provisions and Tax Procedures as
amended by Law of the Republic of Indonesia Number 16 Year 2000 with the threat
of maximum sentence of 6 years, and impose a 1 year imprisonment and a fine of Rp
816.675.458 subsidair 6 months brackets an.
On this occasion also, the Directorate General of Taxation reminded that the
obligation of taxation is a state obligation that has been regulated in the 1945
Constitution. In addition, the tax function is to finance the continuity of the
Government of the Republic of Indonesia.
For people who are not obedient due to not knowing the obligations of taxation, the
Directorate General of Taxation will make an approach by actively going to do
education and counseling.

Jakarta, CNN Indonesia -- Pengadilan Pajak menolak permohonan banding Asian
Agri Grup terkait sengketa pajak anak perusahaannya PT Gunung Melayu dengan
Direktorat Jenderal Pajak Kementerian Keuangan. Majelis Hakim Pengadilan Pajak
menilai Direktorat Jenderal Pajak selaku terbanding telah melakukan perhitungan
dengan benar.
Max Darmawan, Kasubdit Banding dan Gugatan I Direktorat Keberatan Banding,
mengatakan, penolakan tersebut membuat perusahaan grup Asian Agri tersebut
diwajibkan membayar pajak yang masih harus dibayar sebesar Rp 204 miliar. Di
mana Rp 115,9 miliarnya merupakan nilai pokok pajaknya dan sanksinya bernilai Rp
88,1 miliar.
"Tapi putusan yang dibacakan baru satu dengan sanksi sebesar Rp 21,48 miliar. Nanti
total akan ada delapan putusan," kata Max kepada wartawan di Pengadilan Pajak
Kementerian Keuangan, Jakarta, Jumat (5/12).
Max menjelaskan, PT Gunung Melayu mengajukan banding karena menolak
dikatakan kurang bayar pajak. Putusan kurang bayar pajak tersebut telah berkekuatan
hukum tetap setelah divonis Mahkamah Agung tertanggal 18 Desember 2012.
"Mereka minta menjadi nihil, tidak ada kurang bayar," kata Max.
Keberatan diajukan terhadap Surat Ketetapan Pajak Kurang Bayar (SKPKB) atau
Surat Ketetapan Pajak Kurang Bayar Tambahan sejumlah total 8 SKPKB untuk Pajak
Pengahasilan (PPh) pasal 26 dan PPh Badan untuk periode 2002-2005.
Sidang vonis atas pengajuan banding PT Gunung Mas -satu dari 14 perusahaan dalam
group Asian Agri- sempat diskors untuk makan siang. Pembacaan putusan Pengadilan
Pajak dilanjutkan setelah makan siang. Saat ini sidang sengketa pajak masih
berlangsung.
Ketentuan mengenai kurang bayar dan sanksinya diatur berdasarkan Pasal 13 dan
Pasal 15 Undang-Undang Ketentuan Umum dan Tata Cara Perpajakan (KUP). Dalam
hal kurang bayar pajak, telah berkekuatan hukum tetap berdasar vonis kasasi
Mahkamah Agung tertanggal 18 Desember 2012.

Jakarta, CNN Indonesia - The Tax Court rejected the Asian Agri Group's appeal
regarding the tax dispute of its subsidiary PT Gunung Melayu with the
Directorate General of Taxes at the Ministry of Finance.
The Panel of Tax Court Judges assesses that the Directorate General of Taxes as
comparable has performed the calculations correctly.
Max Darmawan, Sub Directorate of Appeals and Claim I of the Appeal Complaint
Directorate, said the rejection made the Asian Agri group company obliged to pay the
accrued tax of Rp 204 billion. Where Rp 115.9 billion is the principal amount of taxes
and sanctions worth Rp 88.1 billion.
"But the verdict is read only one with a sanction of Rp 21.48 billion, there will be
eight verdicts in total," said Max told reporters at the Tax Court of the Ministry of
Finance, Jakarta, Friday (5/12).
Max explained, PT Gunung Melayu appealed for refusing to say less taxes. The
underpayment of the tax has been legally enforceable after being convicted by the
Supreme Court dated December 18, 2012.
PT Gunung Melayu filed an objection against the underpayment and the imposition of
sanctions for the underpayment of the tax.
The verdict on the appeal of PT Gunung Mas - one of 14 companies in the Asian Agri
group was suspended for lunch. The reading of the Tax Court decision continued after
lunch. Currently the tax dispute hearing is still ongoing.
The provisions concerning underpayment and sanctions are provided for under Article
13 and Article 15 of the General Provisions and Taxation Procedures Act (KUP). In
the case of underpayment of taxes, the legal force has remained based on the Supreme
Court appeal verdict dated December 18, 2012.
