Terkait dengan keterlambatan pengambilan barang import bersama dijelaskan sebagai berikut :

 Saya tidak pernah memberikan informasi alamat e-mail wuhibezemime@gmail.com kepada

pengirim, terkait bisnis dengan pengirim saya menggunakan alamat e-mail
wibowowadudi@gmail.com, terhadap salah pengimputan alamat e-mail tersebut silahkan
cek kepada pengirim.
 Menurut Informasi dari PT Mitrarejeki Investa, Notice Of Arrive pernah dikirim kepada saya
sekitar tanggal 20 Juni 2021 melalui email wuhibezemime@gmail.com, karena itu bukan
alamat e-mail saya, maka NOA tersebut tidak pernah sampai kepada saya. Disamping itu PT
Mitrarejeki Investa juga tidak pernah mengkonfirmasi saya melalui hand phone terkait NOA
yang telah dikirim waulupun nomor hand phone saya tersedia di dalam BL.
 NOA baru saya terima tanggal 30 Juli 2021, dengan melalui inisiatif sendiri mencari alamat
PT Mitrarejeki Investa melalui geogle. Alamat PT Mitrarejeki Investa yang tercatat di BL di Jl.
Abdul Muis No.13 selama ini tidak dapat dihubungi, sehingga saya tidak dapat melakukan
sesuau lebih jauh.
 Setelah saya NOA diterima tanggal 30 Juli 2021, saya langsung melakukan pengurusan
dokumen impor, pengurusan memerlukan waktu karena ada proses reddres dan pengurusan
barang karena sudah masuk lelang di bea cukai.
 Terhadap permasalahan di atas, maka saya mengajukan sebagai berikut :
 Saya tidak bersedia membayar demurrage dari tanggal 23 Juli 2021 sampai 30 Juli
2021 karena saya tidak pernah menerima NOA dan itu terjadi bukan karena saya
 Tanggal 1 Agustus 2021 s/d tanggal 2021 merupakan masa pengurusan
 Demurrage yang bersedia saya bayar adalah tanggal 15 Agustus 2021 sampai dengan
tanggal pengambilan barang.
 Terhadap biaya storage yang lebih besar akibat permasalahan ini biarkan menjadi tanggung
jawab saya

Regarding the delay in collecting imported goods together, it is explained as follows:

 I have never provided information on the e-mail address of wuhibezemime@gmail.com to

the shipper, related to business with the shipper I use the e-mail address of
wibowowadudi@gmail.com, for the wrong input of the e-mail address, please check with
the shipper.

 According to information from PT Mitrarejeki Investa, Notice of Arrival (NOA) was sent to
me around June 20, 2021 via email wuhibezemime@gmail.com, because it was not my e-
mail address, so the NOA never reached me. Besides that, PT Mitrarejeki Investa also never
confirmed me via mobile phone regarding the NOA that had been sent even though my
mobile number was available in the BL.

 I just received NOA on July 30, 2021, through my own initiative to find the address of PT
Mitrarejeki Investa through Google. The address of PT Mitrarejeki Investa which is registered
in BL on Jl. Abdul Muis No.13 has not been contacted so far, so I can't do anything further.

• After receiving my NOA on July 30, 2021, I immediately took care of the import documents,
the processing takes time because there is a reddress process and the goods are processed
because they have entered the auction at customs.

• Regarding the problems above, I propose the following:

  I am not willing to pay the demurrage from 23 July 2021 to 30 July 2021 because I never
received NOA and it happened not because of me
 August 1, 2021 to August 14, 2021 is 14 Days Free Demurrage
 The demurrage that I am willing to pay is August 15, 2021 until the date of collection of
goods.

• For larger storage costs due to this problem, let it be my responsibility

kepada shipping company / HMM di China sebagai e-mail resmi PT Mahatani Pertiwi
Sejahtera selaku penerima barang. Karena alamat e-mail tersebut digunakan agent
shipping company di Jakarta untuk memberikan Notice Off Arrival (NOA) kepada PT
Mahatani Pertiwi, sementara selama saya berhubungan bisnis dengan kamu, saya selalu
menggunakan alamat e-mail : wibowowadudi@gmail.com, dan tidak pernah
memberikan alamat e-mail lainnya. Mohon dapat diklarifikasi terkait di atas.

 Informasi dari Shipping Company / HMM di China , kamu telah melakukan input alamat
e-mail wuhibezemime@gmail.com dalam system, sehingga untuk memberikan
informasi Notice Of Arrival (NOA) kepada consignee, agent di Jakarta / PT Mitrarejeki
Investa menggunakan e-mail tersebut. Karena alamat e-mail tersebut bukan alamat e-
mail saya maka NOA tidak pernah saya terima.

 Atas kondisi di atas menyebabkan saya terlambat melakukan pengurusan dokumen

impor, sehingga menyebabkan biaya demmurage dan biaya storage yang cukup besar
akibat kesalahan pihak lain. Oleh karena itu saya mengajukan pengurangan biaya diatas
karena bukan disebabkan kesalahan saya

 Apabila permohonan saya tidak dapat dipenuhi, saya akan menyiapkan langkah hukum
untuk penyelesaian kasus di atas. Hal ini bukan karena ketidakmapuan saya membayar
denda tetapi kepada etika bisnis.

Terkait dengan permintaan klarifikasi saya terkait e-mail sebelumnya bersama disampaikan
kesimpulan sebagai berikut :

• Terkait pertanyaan apakah saya pernah memberikan informasi alamat e-mail

uhibezemime@gmail.com kepada shipper sebagai e-mail resmi PT Mahatani Pertiwi Sejahtera
selaku penerima barang, tidak clear terjawab oleh kamu. Sampai hari ini saya tidak
mengetahui dan tidak mau tahu dari mana alamat e-mail tersebut.

• Saya sudah mengajukan pengurangan biaya demmurage, dan telah disetujui pengurangan
biaya demmurage sebesar 20%, pengurangan biaya ini menurut saya tidak significant, karena
harga barang sudah hamper sama dengan biaya yang harus dikeluarkan. Oleh karena berencana
untuk menyerah barang ini kepada bea cukai untuk di lelang saja apabila pihak shipper tidak
ikut mebantu penyelesaian di atas, mengingat kesalahan bukan dilakukan oleh saya.

• Keuangan perusahaan tidak mampu untuk membayar biaya sebesar itu, karena perusahaan
saya mempunyai usaha kecil menengah yang bergerak dalam bidang pemberdayaan hasil budi
daya petani bisnis untuk menghasilkan benih.

• Saya tidak masalah dengan kerugian akibat pembelian barang ini sebagai resiko dari suatu
bisnis, dan saya akan menyampaikan alasan kepada bea cukai mengapa barang tersebut tidak
kami ambil dari Pelabuhan.

Melanjutkan permohonan pengurangan demmurage atas BL No. : TSNA39476700 bersama ini

kami sampaikan beberapa hal sebagai berikut :

 PT Mahatani Pertiwi Sejahtera mengucapkan terima kasih atas pemberian keringan

biaya demmurage sebesar 20% kapada PT Mahatani Pertiwi Sejahtera yang telah
disampaikan e-mail sebelumnya, karena nilai demmurage cukup besar maka keuangan
perusahaan tidak sanggup untuk membayar biaya sebesar itu, karena perusahaan kami
 merupakan usaha kecil menengah yang bergerak dalam bidang pemberdayaan hasil
budi daya petani untuk menghasilkan benih.

 Disamping biaya demmurage, kami masih harus membayar biaya storage yang cukup
besar karena kondisi barang dalam posisi lelang di bea cukai dan masih diperlukan biaya
tambahan untuk pembatalan lelang akibat keterlambatan pemenuhan dokumen impor,
sehingga nilai total biaya impor sudah sama dengan harga barang.

 Dengan mempertimbangkan kondisi di atas dan kemampuan keuangan, maka kami

hanya sanggup membayar 50% dari total demmurage. Apabila disetujui kami akan bayar
tanggal 10 September 2021 dan kami minta waktu minggu untuk pengeluaran barang
dari Pelabuhan.

PT Mahatani Pertiwi Sejahtera would like to thank PT Mahatani Pertiwi Sejahtera for
providing a 20% demmurage fee waiver to PT Mahatani Pertiwi Sejahtera which has been
submitted by e-mail earlier, because the demmurage value is quite large, the company's
finances cannot afford to pay such a large fee, because our company is a business. small and
medium enterprises engaged in the empowerment of farmers' cultivation results to produce
seeds.

In addition to the demmurage fee, we still have to pay a large storage fee due to the
condition of the goods being auctioned at customs and additional fees are required for
cancellation of the auction due to delays in the fulfillment of import documents, so that the
total import cost is the same as the price of the goods.

Taking into account the above conditions and financial capacity, we are only able to pay 50%
of the total demurrage. If it is approved we will pay on September 10, 2021 and we ask for a
week to release goods from the port.
