 ABSTRAK

Minuman keras beralkohol yang dikenal oleh sebagaian kalangan komonitas local

yang disebut dengan Sopi merupakan salah satu jenis minuman yang diolah dan

diproduksi secara tradisional menggunakan pengetahuan yang diwariskan secara turun

temurun sejak dari zaman dahulu hingga sekarang ini. Penggunaan dan pemanfaatan

Sopi dalam kehidupan sehari-hari masyarakat Fakfak terus terjadi hingga sekarang ini.

Secara etimologi, Kata Sopi berasal dari bahasa Belanda zoopje yang berarti alkohol cair

atau minuman beralkohol lokal, Sopi tergolong dalam minuman keras lokal masyarakat

yang mendapatkan banyak pertentangan dan perdebatan terkait dengan peredarannya

di tengah masyarakat. Di Kabupaten Fakfak Sopi dijadikan sebagai alasan pemicu tindak

kriminal sehingga Sopi harus dimusnahkan dan disita oleh pihak keamanan yang

berwajib guna penegakan hukum yang dilakukan oleh Pihak Kepolisian yang mengacu

pada ketentuan sebagaimana diatur dalam Pasal 204 Ayat (1) KUHP jo pasal 71 Ayat (2)

Undang-undang nomor 18 tahun 2012 tentang Pangan dan pihak Kepolisian Resor Fakfak

telah melakukan berbagai upaya baik melakukan sosialisasi terkait dampak dan bahaya

terkait miras local jenis sopi .

Penulis akan menganalisa mengenai upaya penegakan hukum tindak pidana

penjualan miras local ( sopi) yang dilakukan oleh Satuan reserse narkoba polres fakfak

dan bagaimana penerapan ancaman hukuman bagi para produsen dan penjual minuman

keras local sebagaimana diatur dalam pasal 204 Ayat (1) KUHP jo pasal 71 Ayat (2)

Undang-undang nomor 18 tahun 2012 tentang Pangan.

 ABSTRACT
Alcoholic liquor known by some local community groups called Sopi is a type of drink
that is processed and produced traditionally using knowledge that has been passed down from
generation to generation from ancient times to the present. The use and use of Sopi in the daily
life of the Fakfak people continues to this day. Etymologically, the word Sopi comes from the
Dutch language zoopje which means liquid alcohol or local alcoholic drink. Sopi is classified as
a local community liquor which has received a lot of controversy and debate regarding its
circulation in society. In Fakfak District, Sopi was used as an excuse for triggering criminal acts
so that Sopi had to be destroyed and confiscated by the security forces for the sake of law
enforcement carried out by the Police referring to the provisions stipulated in Article 204
Paragraph (1) of the Criminal Code in conjunction with Article 71 Paragraph (2) of Law
number 18 of 2012 concerning Food and the Fakfak Resort Police have made various efforts to
socialize the impacts and dangers related to the local sopi type alcohol.
The author will analyze the efforts to enforce the law on the crime of selling local
liquor (sopi) carried out by the Fakfak Police Drug Investigation Unit and how to apply the
threat of punishment for local liquor producers and sellers as stipulated in Article 204
Paragraph (1) of the Criminal Code in conjunction with Article 71 Paragraph (2) of Law
number 18 of 2012 concerning Food.
