 KELOMPOK 1 : Arbitrase

Menurut undang-undang nomor 30 tahun 1999 tentang arbitarse dan alternatif

penyelesaian senketa umum pasal 1 angka 1, arbitarse adalah: "cara penyelesaian
suatu sengketa perdata di luar peradilan umum yang di dasarkan pada perjanjian
arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa.

"Dasar hukum berarbitrase adalah dasar hukum yang dipergunakan seseorang untuk
dapat mengelesaikan perselisihanya melalui arbitrase, baik dalam kerangka arbitrase
nasional, maupun internasional.
 Badan Arbitrase Syariah Nasional (BASYARNAS)
merupakan badan yang dapat menyelesaikan
sengketa perdata/muamalat Islam dengan
memutuskan suatu keputusan hukum atas masalah
KELOMPOK 2 : yang dipersengketakan.

Basyarnas Pembatalan keputusan arbitrase dapat dilakukan

sesuai dengan Undang-Undang No, 30 tahun 1999
tentang arbitrase dan alternatif penyelesaian
sengketa.
 KELOMPOK 3 : Pilihan Penyelesaian Sengketa

Alternative Dispute Resolution (ADR) merupakan suatu pranata penyelesaian

sengketa di luar pengadilan, yang mekanismenya berdasarkan sebuah kesepakatan
dari para pihak dengan mengesampingkan penyelesaian sengketa secara litigasi di
pengadilan, pelembagaan arbitrase dan ADR diatur dalam UU No. 14 Tahun 1970
tentang Ketentuan-Ketentuan Pokok Kekuasaan Kehakiman.

Alternative penyelesaian sengketa terdiri dari pengelesaian di luar pengadilan

dengan menggunakan metode konsultasi, negosiasi, mediasi, konsiliasi, atau
penilaian ahli
 KELOMPOK 4 : Konsultasi

KonsultasiKonsultasi merupakan Ada tiga unsur di dalam konsultasi,

proses dalam suasana kerja sama dan
hubungan antar pribadi dengan tujuan
memecahkan suatu masalah dalam
lingkup professional dari orang yang
meminta konsultasi.
yaitu klien, orang yang minta
konsultasi, dan konsultan. Dalam
proses konsultasi akan melibatkan
tiga pihak, gaitu konselor, konsultee,
dan konseli atau pihak ketiga
 KELOMPOK 5 : Negosiasi

Negosiasi merupakan komunikasi langsung yang di desain untuk mencapai

kesepakatan pad saat kedua pihak memiliki kepentingan yang sama atau berbeda.
Cara penyelesaian ini sangat cocok untuk masyarakat bisnis indonesia. Mayoritas
pengusaha indonesia adalah pengusaha kecil dan menengah.

Jadi jika ada permasalahan sebelum di bawa ke ranah pengadilan, lebih baik di
selesaikan dengan kekeluargaan terlebih dahulu, hal ini karena akan tetap terjaga
hubungan baik antara keduanya.
