 Pengertian Hukum Wadh'i
Kata al-wadh` merupakan masdar dari wadha`a, dapat diartikan dengan
penurunan, penjatuhan, pukulan, pemalsuan, atau rekayasa, pengarangan
dan peletakan. Dalam definisi hukum syara’, kata al-wadh`yang mewakili
hukum wadh`I,berarti peletakan, yakni peletakan sesuatu menjadi hukum
syara’ Berbagai literatur usul fikih berbahasa Indonesia menerjemahkan al-
wadh` dengan kata "ketetapan".

Dalam bahasa Indonesia, selain makna hukum juga bisa diartikan dengan
“tatakan”, yang dekat maknanya dengan kata peletakan. Al-wadh` juga
dapat dimaknai dengan ukuran. Denganpemaknaan ini, maka dapat
dipahami bahwa hukum wadh`i merupakan tatakan atau ukuran bagi hukum
taklifi. Al-wadh`dapat dimaknai dengan tatakan dan model selain karena
maknanya dekat, juga fungsi hukum al-wadh`i adalah tatakan dan ukuran
bagi hukum taklifi.
Dan Sesungguhnya Allah SWT menjadikan syari’at itu kabar
gembira dan kemudahan bagi hambanya, dari keadaan yang
lemah, dan segala urusan yang darurat. Hukum
wadh’Isebagaimana telah disebutkan dalam kitab Al-wadhih,
fiiUsulil Fiqih,yang ditulis olehMuhammad Sulaiman Abdullah
alAssqar. Bahwasanya Allah SWT dalam kitabnya, dengan
menjadikan sebuah perintah, menjadi tanda atas perintah yang
lainnya.

Pada dasarnya, Hukum wadh’i merupakan Ilmu yang

mendefinisikan hukum Islamyaitu usul fikih. Dalam usul fikih,
hukum didefinisikan sebagai khitabullah al-muta’alliq bi af’ali
almukallafin bil iqtidha’ aw al-wadh (titah Tuhan yang

yang merupakan hasil perbuatan manusia, maksudnya
timbulnya suatu sebab dikarenakan perbuatan manusia,
seperti perjalanan jauh) pada bulan puasa menimbulkan
sebab bolehnya berbuka puasa.

Bila kita perhatikan mengenai hubungan sebab dengan
