BAB VII
PENDAFTARAN DAN KEBANGSAAN PESAWAT UDARA
Pasal 24

Setiap pesawat udara yang dioperasikan di Indonesia wajib mempunyai tanda pendaftaran
Pesawat udara sipil yang dapat didaftarkan di Indonesia harus memenuhi ketentuan
sebagai berikut:

a. tidak terdaftar di negara lain; dan

b. dimiliki oleh warga negara Indonesia atau dimiliki oleh badan hukum Indonesia;

c. dimiliki oleh warga negara asing atau badan hukum asing dan dioperasikan oleh warga
negara Indonesia atau badan hukum Indonesia untuk jangka waktu pemakaiannya
minimal 2 (dua) tahun secara terus-menerus berdasarkan suatu perjanjian;

d. dimiliki oleh instansi pemerintah atau pemerintah daerah, dan pesawat udara tersebut
tidak dipergunakan untuk misi penegakan hukum; atau

e. dimiliki oleh warga negara asing atau badan hukum asing yang pesawat udaranya
dikuasai oleh badan hukum Indonesia berdasarkan suatu perjanjian yang tunduk pada
hukum yang disepakati para pihak untuk kegiatan penyimpanan, penyewaan, dan/atau
perdagangan pesawat udara.
Pasal 26

(1) Pendaftaran pesawat udara sebagaimana dimaksud dalam Pasal 25 diajukan


oleh pemilik atau yang diberi kuasa dengan persyaratan:

a. menunjukkan bukti kepemilikan atau penguasaan pesawat udara;


b. menunjukkan bukti penghapusan pendaftaran atau tidak didaftarkan di
negara lain;
c. memenuhi ketentuan persyaratan batas usia pesawat udara yang
ditetapkan oleh Menteri;
d. bukti asuransi pesawat udara; dan
e. bukti terpenuhinya persyaratan pengadaan pesawat udara.

(2) Pesawat udara yang telah memenuhi persyaratan sebagaimana dimaksud pada
ayat (1) diberi sertifikat pendaftaran.

(3) Sertifikat pendaftaran sebagaimana dimaksud pada ayat (2) berlaku selama 3
(tiga) tahun.
Pasal 28
(1) Setiap orang dilarang memberikan tanda-tanda atau mengubah identitas pendaftaran
sedemikian rupa sehingga mengaburkan tanda pendaftaran, kebangsaan, dan bendera
pada pesawat udara.

(2) Setiap orang yang mengaburkan identitas tanda pendaftaran dan kebangsaan
sebagaimana dimaksud pada ayat (1) dikenakan sanksi administratif berupa:
a. peringatan; dan/atau
b. pencabutan sertifikat.

Pasal 29
Pesawat udara yang telah memiliki tanda pendaftaran sebagaimana dimaksud dalam Pasal
24 dapat dihapus tanda pendaftarannya apabila:
a. permintaan dari pemilik atau orang perseorangan yang diberi kuasa dengan ketentuan:
1) telah berakhirnya perjanjian sewa guna usaha;
2) diakhirinya perjanjian yang disepakati para pihak;
3) akan dipindahkan pendaftarannya ke negara lain;
4) rusak totalnya pesawat udara akibat kecelakaan;
5) tidak digunakannya lagi pesawat udara;
6) pesawat udara dengan sengaja dirusak atau dihancurkan; atau
7) terjadi cedera janji (wanprestasi) oleh penyewa pesawat udara tanpa putusan
pengadilan.
b. tidak dapat mempertahankan sertifikat kelaikudaraan secara terus menerus selama 3
(tiga) tahun.
Pasal 30
Ketentuan lebih lanjut mengenai tata cara dan prosedur pendaftaran dan
penghapusan tanda pendaftaran dan tandakebangsaan Indonesia serta
pemberian sanksi administratif diatur dengan Peraturan Menteri.

Pasal 31
Proses sertifikasi pendaftaran pesawat udara sebagaimana dimaksud dalam
Pasal 26 ayat (2) dan penghapusan tanda pendaftaran sebagaimana
dimaksud dalam Pasal 29 dilaksanakan oleh lembaga penyelenggara
pelayanan umum.

Pasal 32
Proses sertifikasi pendaftaran pesawat udara sebagaimana dimaksud dalam
Pasal 31 dikenakan biaya.

Pasal 33
Ketentuan lebih lanjut mengenai lembaga penyelenggara pelayanan umum,
serta proses dan biaya sertifikasi diatur dalam Peraturan Menteri.

Pasal 27

(1) Pesawat terbang, helikopter, balon udara berpenumpang, dan kapal udara
(airship) yang telah mempunyai sertifikat pendaftaran Indonesia diberikan
tanda kebangsaan Indonesia.

(2) Pesawat terbang, helikopter, balon udara berpenumpang, dan kapal udara
yang telah mempunyai tanda pendaftaran Indonesia dan tanda kebangsaan
Indonesia wajib dilengkapi dengan bendera Negara Kesatuan Republik
Indonesia.

(3) Pesawat udara selain pesawat terbang, helikopter, balon udara


berpenumpang, dan kapal udara dapat dibebaskan dari tanda kebangsaan
Indonesia.

(4) Setiap orang yang melanggar ketentuan sebagaimana dimaksud pada ayat
(2) dikenakan sanksi administratif berupa:
a. peringatan; dan/atau
b. pencabutan sertifikat.
CASR 47 - AIRCRAFT REGISTRATION – Requirement –
47.5 Eligibility for registration
An aircraft shall be eligible for registration in Indonesia only when the aircraft is:
a. Not registered in other country, and
b. Owned by Indonesian citizen or Indonesian legal entity, or
c. Owned by a foreign citizen or foreign legal entity and operated by an
Indonesian citizen or Indonesian legal entity for a minimum utilization
period of 2 (two) years continuously based on an agreement/contract, or
d. Owned by government agency or regional government and the aircraft is
not utilized for law enforcement mission, or
e. Owned by a foreign citizen or foreign legal entity whose aircraft is in
possession of an Indonesian legal entity based on an agreement/contract
subject to the law agreed upon by the parties for purposes of aircraft
storage, hire/rental, and/or commerce.
f. All duties due and payable under the laws of Indonesia in respect of the
importation of the aircraft into Indonesia have been paid,
g. All insurance required by Article 62 of Aviation Law No. 1 Year 2009 have
been covered.

47.7 Applicant
Applicant who wishes to register an aircraft in Indonesia must be an Indonesian
Citizen or Legal Body under the Law of the Republic of Indonesia.

47.9 Evidence of ownership


a. Each person who submits an application for aircraft registration under
this part shall also submit the required evidence of ownership.
b. The evidence of ownership may be in the form of Bill of Sale or Grant
Certificate/Document or other form as acceptable by Director General.

47.11 Appointment to act on behalf of more than one owner


If an aircraft is owned by more than one person, it must be appointed
one to act on their behalf in order to register the aircraft.

Pasal 26
(1) Pendaftaran pesawat udara sebagaimana
dimaksud dalam Pasal 25 diajukan oleh pemilik atau yang
diberi kuasa dengan persyaratan:
a. menunjukkan bukti kepemilikan atau penguasaan
pesawat udara;
b. menunjukkan bukti penghapusan pendaftaran atau
tidak didaftarkan di negara lain;
c. memenuhi ketentuan persyaratan batas usia
pesawatudara yang ditetapkan oleh Menteri;
d. bukti asuransi pesawat udara; dan
e. bukti terpenuhinya persyaratan pengadaan pesawat
udara.

Asuransi dalam Pengoperasian Pesawat Udara
Pasal 62

(1) Setiap orang yang mengoperasikan pesawat udara wajib mengasuransikan:


a. pesawat udara yang dioperasikan;
b. personel pesawat udara yang dioperasikan;
c. tanggung jawab kerugian pihak kedua;
d. tanggung jawab kerugian pihak ketiga; dan
e. kegiatan investigasi insiden dan kecelakaan pesawat udara.

(2) Setiap orang yang melanggar ketentuan sebagaimana dimaksud pada ayat (1)
dikenakan sanksi administratif berupa:
a. peringatan;
b. pembekuan sertifikat; dan/atau
c. pencabutan sertifikat.

(3) Ketentuan lebih lanjut mengenai wajib asuransi dalam pengoperasian pesawat
udara dan pemberian sanksi administratif sebagaimana dimaksud pada ayat
(2) diatur dengan Peraturan Menteri.

Penjelasan pasal 62

Huruf c
Yang dimaksud dengan “pihak kedua” adalah orang atau badan
hukum yang mempunyai hubungan langsung dengan kegiatan
pengoperasian pesawat udara dengan suatu ikatan hukum.

Huruf d
Yang dimaksud dengan “pihak ketiga” adalah orang atau badan hukum
yang tidak mempunyai hubungan langsung dengan kegiatan
pengoperasian pesawat udara dengan suatu ikatan hukum, tetapi
mendapat akibat dari pengoperasian pesawat udara tersebut.

Wajib Asuransi
Pasal 179
Pengangkut wajib mengasuransikan tanggung jawabnya terhadap
penumpang dan kargo yang diangkut sebagaimana dimaksud dalam Pasal
141, Pasal 143, Pasal 144, Pasal 145, dan Pasal 146.

Pasal 141
(1) Pengangkut bertanggung jawab atas kerugian penumpang yang
meninggal dunia, cacat tetap, atau luka-luka yang diakibatkan kejadian
angkutan udara di dalam pesawat dan/atau naik turun pesawat udara.

Pasal 143
Pengangkut tidak bertanggung jawab atas kerugian karena hilang atau
rusaknya bagasi kabin, kecuali apabila penumpang dapat membuktikan
bahwa kerugian tersebut disebabkan oleh tindakan pengangkut atau orang
yang dipekerjakannya.

Pasal 144
Pengangkut bertanggung jawab atas kerugian yang diderita oleh
penumpang karena bagasi tercatat hilang, musnah, atau rusak yang
diakibatkan oleh kegiatan angkutan udara selama bagasi tercatat berada
dalam pengawasan pengangkut.

Pasal 145
Pengangkut bertanggung jawab atas kerugian yang diderita oleh pengirim
kargo karena kargo yang dikirim hilang, musnah, atau rusak yang
diakibatkan oleh kegiatan angkuta udara selama kargo berada dalam
pengawasan pengangkut.

Pasal 146
Pengangkut bertanggung jawab atas kerugian yang diderita karena
keterlambatan pada angkutan penumpang, bagasi, atau kargo, kecuali
apabila pengangkut dapat membuktikan bahwa keterlambatan tersebut
disebabkan oleh faktor cuaca dan teknis operasional.

Pasal 148

Tanggung jawab pengangkut sebagaimana dimaksud dalam


Pasal 141 sampai dengan Pasal 147 tidak berlaku untuk:

a. angkutan pos;
b. angkutan penumpang dan/atau kargo yang
dilakukan oleh pesawat udara negara; dan
c. angkutan udara bukan niaga.

A Certificate of Registration (C of R) is an evidence that an
aircraft is registered in the Civil Aircraft Register of a country.

47.23 Certificate of registration

a. An aircraft may be registered only by and in the legal name of its owner.

b. Certificate of registration is not evidence of ownership of aircraft in any


proceeding in which ownership by a particular person is in issue. The
Director General does not issue any certificate of ownership or endorse
any information with respect to the ownership on a Certificate of
Registration. The Director General issues a Certificate of Registration to
the person who appears to be the owner on the basis of the evidence of
ownership submitted pursuant to Section 47.9 with the application for
aircraft registration, or record at the Civil Aircraft Register.

c. In this part, “owner” includes a buyer in possession or person in


accordance with paragraph 47.11.

47.21 Application for registration

Application for registration of an aircraft in Indonesia shall be made


in a form as prescribed by the Director General.

Submits an evidence of ownership as required on paragraph 47.9.

47.14 Temporary registration mark


(a) Temporary registration marks are issued by the Director General
for temporary display on aircraft during flight, for the purpose-
(1) New aircraft produce by Indonesian Manufacturer for
production test flight, demonstration, marketing, or
delivery flight;
(2) Delivery of aircraft into Republic of Indonesia.
(b) A temporary registration mark shall remain valid for the period of
validity specified in the certificate and such period shall not
exceed three months;
(c) A temporary registration mark is not valid for revenue flight.

Temporary C of R is issued for an aircraft which have a pending item to a specific requirement
such as custom clearance, radio permit etc. A permanent C of R will be issued for the aircraft
when the pending item is CLOSED.

Temporary C of R : are as specified on the certificate BUT not more than 3 months. Temporary
C of R is not valid after permanent C of R is issued.

47.14 Temporary registration mark


(b) A temporary registration mark shall remain valid for the period of
validity specified in the certificate and such period shall not exceed
three months;

Permanent C of R (usually called as “C of R”): are as specified on the certificate BUT not more
than 3 years.

47. 25 Duration of Certificate of Registration.


A certificate of Registration shall remain valid for the period of validity specified
in the Certificate and such period shall not exceed three years from the date of
initial issue or previous renewal of the certificate.

47.25 Duration of Certificate of Registration

Each Certificate of Registration issued under this subpart will be effective until
such period stated on certificate, unless:

a. The registration is canceled upon written request from the holder of


certificate, or authorized person, under the following conditions:
1. Lease agreement has terminated,
2. Termination of agreement as agreed upon by the parties,
3. Intention to register into other country,
4. Aircraft total loss during accident,
5. Aircraft is permanently withdrawn from use,
6. Aircraft is intentionally scrapped or destroyed,
7. Ownership of the aircraft is transferred.

b. Breech of contract (non-performance) by lessee of aircraft without any


court’s decision,

c. Certificate of Airworthiness can not be maintained continuously for more


than three years.
✓ REVISION/REPLACEMENT of C OF R
Revision or Replacement of C of R will be made when :
-The ownership of the aircraft is transferred
-Address of the aircraft’s owner is changed
-The certificate is lost, stolen or mutilated

47.27 Change of ownership of aircraft

a. Where there is a change in the ownership of a registered aircraft, the Certificate of


Registration shall thereupon be deemed to be canceled and certificate holder or
authorized person shall forward the followings to the Director General:
1. Application for the change of ownership, setting out the full name and address of
the new owner and date of change of ownership,
2. Evidence of Ownership,
3. In case of leased aircraft, the lease agreement shall be amended to reflect the new
ownership;

b. When all requirements for the owner change has properly been fulfilled, the previous
Certificate of Registration shall be returned to Director General, a new Certificate of
Registration shall be issued and the appropriate entry shall be made in the Civil Aircraft
Register.

Revision or Replacement of C of R will be made when :
-The ownership of the aircraft is transferred
-Address of the aircraft’s owner is changed
-The certificate is lost, stolen or mutilated

47.29 Change of address


In case of change to owner permanent address, the holder of a Certificate of
Registration shall notify the Director General with evidence of registration of the
new address. A revised Certificate of Registration shall be issued as necessary.

47.33 Renewal or replacement of certificate


If a Certificate of Registration is lost, stolen, or mutilated, the holder of the
Certificate of Registration may apply to the Director General for a new certificate.

Cancellation of C of R , also called as “DEREGISTRATION” will be done on request or without
request from the owner or operator

a. The registration is canceled upon written request from the holder of


certificate, or authorized person, under the following conditions:
1. Lease agreement has terminated,
2. Termination of agreement as agreed upon by the parties,
3. Intention to register into other country,
4. Aircraft total loss during accident,
5. Aircraft is permanently withdrawn from use,
6. Aircraft is intentionally scrapped or destroyed,
7. Ownership of the aircraft is transferred.

47.31 Cancellation of certificate for export purpose

a. The holder of a Certificate of Registration who wishes to cancel the


certificate for the purpose of export must submit to the Director General a
written request and describes the aircraft by registration mark, make and
model, serial number, and the country to which the aircraft will be
exported,

b. Director General will notify the cancellation to the country to which the
aircraft is to be exported.

All registered aircraft will be listed and published in a yearly basis on the “Indonesia Civil Aircraft Register”.

CASR 47.3 Register of civil aircraft


The register of civil aircraft shall be established and maintained by the
Director General. The Director General shall record in the register the
following informations in respect of each civil aircraft registered in
Indonesia:

2. RESPONSIBILITY
The Head of Production Certification Section of SDAP is responsible for
maintaining the aircraft registration files. Access to the computer file for
addition or modification of data, shall be limited to authorized persons
only.
4. REPORTS OF CIVIL AIRCRAFT REGISTER DATA
Reports of Civil Aircraft Register data is made in a form of Indonesia Civil
Aircraft Register which is published in yearly basis.
