Sehubungan dengan Surat I Menteri Perdagangan RI dengan Nomor 1895/M-

DAG/SD/12/2010 tanggal 28 Desember 2010 perihal Penerimaan CO Form E Baru, dapat
disarnpaikan hal-hai sebagai berikut
1 Menterl Pendagangan RI menyampalkan kepada Menteri Keuangan bahwa Second
Protocol To Amend The Agreement On Trade in Goods Of The Framework Agreement On
Comprehensive Economic Co-Operation Between The Association of The Southeast
ASEAN Nations and The People's Republic of China telah ditandatangani tanggal 29
Oktober 2010 di Hanoi yang pada intinya mengatur beberapa perubahan terrnasUk
diantaranya perubahan Operational Certification Procedures (OCP) ACFTA dengan
mengakomodir kebutuhan dunla usaha di ASEAN dan China untuk serta beberapa
perubahan ketentuan lainnya deism OCR
2. Beberapa perubahan dalam OCP yang termasuk dalam Perubahan Protokol iersebut
antara lain sebagai berikut :
(a) Movement Certificate
Dalam OCP yang baru diatur mekanisme prosedur baru yang dikenal sebagai
Movement Certificate yaitu dimungkinkannya Form E untuk diterbitkan oleh Negara SKA
pengekspor yang kedue (intermediate exporting party/member state) berdasarkan SKA
yang diterbitkan oleh negara anggota pengekspor partama. Mekanisme ini dikenal
dalam skema FTA lainnya sebagai back-to-beck, namun dalarn OCP ACFTA
sebelumnya tidak diperbolehkan menggunakan mekanisme seperti itu.
(b) Verification Visit
Dalam OCP yang saat ini diberlakukan, tidak dimungkinkan untuk rnelakukan verification
visit yaitu pelaksanaan verifikasi etas barang impor dengan mengadakan kunjungan ke
negara pengekspor apabila hasil dan retroactive check dianggap tidak memuaskan,
namun dalam OCP yang baru telah diatur hal tersebut.
(c) Third Party Invoicing
OCP yang baru juga mengatur tentang dimungkinkannyl keterlibatan pihak ketiga
dalam transaksi yang menggunakan Form E, dimana transaksi tersebut menggunakan
invoice yang diterbitkan oleh perusahean yang beriokasi di negara-negara anggoth
ACFTA atau negara ketiga yang bukan anggota ACFTA untuk kepentingan porusahaan
pengekspor yang beriokasi di negara anggota ACFTA. Mekenisme ini dikenal sebagai
Third Party / Country invoicing dan telah diberiakukan untuk FTA lainnya.
(d) Perubahan Definisi Issuing Authority
Dalam OCP sebelumnya, definisi Issuing Authority hanya mencakup pemerintah
(Government) saja, sedangkan daiam OCP yang baru mengatur secara lebih luas yaltu
yang dimakaud dengan Issuing Authority tidak hanya mencakup Government saja,
melaitikan juga pihak lain yang secara peraturan peruncianOrt domestik diberikan
kewenangan untuk menerbitkan Form E..

Dad nisi waktu penerbitan, dalam OCP sebelumnya Form E rianya bisa ansronkari
saat ekspor atau segera setelahnya (at the time of exportation or soon thereafter),
sementara dalam OCP yang baru diatur bahwa Form E dapat diterbitkan sebeluM atau
(prior to or at the time of shipment), atau tidak melebihi 3
sampai dengan pengapalan
(tiga hari) setelah pengapalan (no later than three days from the date of shipment).
(f) Format Form E
Dalam OCP sebelumnya, Form E yang diterbitkan berjumlah 4 (empat) Iembar yaitu 1
sedangkan dalam OCP yang baru diatur
(satu) Form E asli dan 3 (tiga) carbon copies,
Form E hanya terdiri dari dari 3 (tiga) Iembar yaitu 1 (satu) Form E asii dan 2 (dua)
carbon copies, dengan peruntukan sebagai berikut : Iembar anti diserahkan kepada Bea
Cukai di negara pengimpor, sementara 2 (dua) Iembar salinan masing-masing tetap
dipegang oleh issuing Authority dan eksportir di negara asal.
3 Berdasarkan informasi Menteri Perdagangan, Indonesia baru akan mengimplementasikan
perubahan OCP setelah diselesaikannya proses ratifikasi protokol yang saat ini rnasih
berlangsung. Namun sesuai kesepakatan dalam Pertemuan ke-36 ASEAN China Trade
Negotiating Committee pada tanggal 1-2 Desember 2010 di Luang Prabang, Laos, negara-
negara peserta ACFTA yang belum meratifikasi protokol agar dapat menerima impor
barang yang ditengkapi CO Form E dengan Format baru, namun untuk ketentuan Iainnya
akan diberlakukan.setelah proses ratifikasi selesai.

4. Berdasarkan hal-hal diatas, sementara menunggu diselesaikannya proses
Protokol ACFTA dan diterbitkannya perubahan Peraturan Menteri Keuangan tentang
ACFTA serta datam rangka menjamin kelanearan proses !moor ekspor maka :
(a) Terhitung mulal tanggal 1 Januari 2011, Impor dalam rangka skema ACFTA dapat
menggunakan Form E lama atau Form E baru sebagaimana tertampir, dengan catatan
apabila menggunakan Form E baru make yang diserahkan kepada Bea Cukal di negara
pengimpor hanya Form E Iembar ask, sebagaimana dijelaskan dalam Butir 2 (f) diatas.
(b) Ketentuan lainnya dalam OCP yang baru, antara lain sebagaimana tercantum datam
butir 2 (a) sampai dengan 2 (a) diatas, belum diberlakukan sampai dengan
diselesaikannya proses ratifikasi protokol yang akan diinformasikan lebih lanjut.
