Understanding Legal Antropology

 Secara garis besar, ilmu antropologi terbagi menjadi 4 cabang ilmu yang
saling berkaitan, yaitu: Antropologi sosial-budaya, Antropologi biologis,
Linguistik, Arkeologi
 Anthropology is divided into 4 interrelated branches of science, namely:
Socio-cultural anthropology, Biological anthropology, Linguistics, Archaeology

 Sedangkan antropologi hukum adalah cara cara masyarakat dalam proses

penyelesaian perselisihan mengingat bahwa hukum bagian dari budaya maka
didalam budaya selalu ada proses penyelesaian menurut cara masing
masing.
 Meanwhile, legal anthropology is the way society in the process of resolving
disputes considering that law is part of the culture, so in culture there is
always a process of settlement according to their respective ways.

 Secara ilmiah, antropologi hukum, adalah bidang antropologi di mana fokusnya pada
aspek normatif kehidupan budaya dan biologis manusia yang didasarkan pada dua
elemen hukum yakni kekuasaan dan hukuman. Antropologi hukum juga dapat
ditemukan didalam agama, perilaku dan Kebiasaan.
 Scientifically, legal anthropology, is the field of anthropology in which the focus is on
normative aspects of human cultural and biological life that are based on the two
elements defined by law, power and punishment, and while the focus is on modern legal
issues that are at the heart of current anthropology, it cannot be neglected. The broader
background of anthropology in general, and thus, anthropology of law will find itself
embedded in more general topics of anthropology such as religion, behavior and habits.

Metode pendekatan Antropologi hukum seperti :
1. Metode Historis, yaitu mempelajari manusia melalui sejarah. Kebiasaan yang ada
dalam masyarakat menjadi adat, kemudian menjadi hukum adat, hukum adat
dipertahankan oleh penguasa dan kemudian menjadi hukum negara. Metode
Historis mempelajari perilaku manusia dan budaya hukumnya dengan kacamata
sejarah. Perkembangan karakteristik budaya merupakan awal budaya masyarakat.

Metode pendekatan Antropologi hukum seperti :

3. Metode Deskriptif Perilaku, yaitu mempelajari prilaku manusia dan budaya
hukumnya melalui hukum yang nyata tanpa melihat aturan hukum ideal. Metode
ini disertai dengan metode kasus. Metode Deskriptif Perilaku menggambarkan
perilaku manusia dan budaya hukumnya termasuk melukiskan/menggambarkan
perilaku nyata jika mereka sedang berselisih/bersengketa. (melihat sistem hukum
mana yang digunakan (hukum adat atau hukum Negara)

through real laws without looking at the ideal rule of law. This method is
accompanied by a case method. Descriptive Methods of Behavior describe human

kasus-kasus yang terjadi terutama kasus perselisihan. Metode Studi Kasus
mempelajari kasus-kasus hukum dan penyelesaiaannya yang berkembang dalam
masyarakat dimana penyelesaian sengketa melalui pengadilan merupakan alternatif
terakhir. Biasanya mempelajari kasus-kasus perselisihan kelompok masyarakat,
latar belakang kultur yang menyebabkannya dan rencana solusi penyelesaiannya
