ANALISIS HUKUM SISTEM PENGELOLAAN PEKERJA OUTSOURCING

DI SULAWESI SELATAN

Abstract

Penelitian ini bertujuan untuk mengetahui untuk mengetahui pengetahuan dan pemahaman hukum
pekerja outsourcing, serta mengetahui sistem pengelolaan outsourcing menurut ketentuan dalam UU
ketenagakerjaan.
Metode penelitian ini adalah penelitian hukum normatif dengan analisis kajian adalah deskriptif kualitatif,
melalui proses reduksi data, penyajian data, dan penarikan kesimpulan. Pengumpulan data dilakukan
dengan menggunakan metode observasi, dokumentasi, dan wawancara mendalam.
Hasil penelitian menunjukkan bahwa secara hukum ketenagakerjaan dalam sistem pengelolaan
outsourcing belum dijalankan secara maksimal. Hal itu tercermin dari pernyataan-peryataan responden
yang menunjukkan bahwa hak dan kewajiban sebagai pekerja outsourcing tidak sesuai dengan ketentuan
yang diatur dalam undang-undang ketenagakerjaan, baik perlindungan secara ekonomi maupun
perlindungan yang terkait dengan perlindungan kerja. Perjanjian kerja sama antara penerima jasa pekerja
dengan pihak penyedia tanaga kerja belum menunjukkan bentuk perjanjian yang memenuhi standar
perjanjian seperti yang diatur dalam undang-undang ketenagakerjaan, sehingga secara hukum pihak
pekerja outsourcing berada dalam posisi yang lemah.
Dari hasil penelitian tersebut disarankan, perlu dilakukan sosialisasi bagi pekerja-pekerja outsourcing dan
perlunya dibentuk pengawas ketenagakerjaan yang membidani pemberdayaan pekerja outsourcing.

Abstarct

This study aims to find out to find out the knowledge and understanding of legal
outsourcing workers, as well as knowing the outsourcing management system according to
the provisions in the labor law.
The method of this research is normative legal research with analysis of the study is
descriptive qualitative, through the process of data reduction, data presentation, and
conclusion drawing. Data collection is done using the method of observation,
documentation, and in-depth interviews.
The results of the study show that the labor law in the outsourcing management system has
not been carried out optimally. This is reflected in the statements of respondents which
indicate that the rights and obligations as outsourcing workers are not in accordance with
the provisions stipulated in labor laws, both economic protection and protection related to
employment protection. Collaborative agreements between recipients of workers' services
and those of labor providers have not yet shown the form of agreement that meets the
standards of the agreement as stipulated in the labor law, so that legally the outsourcing
workers are in a weak position.
From the results of these studies, it is suggested that there should be socialization for
outsourcing workers and the need to establish labor inspectors who are responsible for
empowering outsourcing workers.
