SEA EMPLOYMENT AGREEMENT AS A SHIP’s CREW

kerja laut kedua belah pihak antara lain :

Selanjutnya dalam hal ini disebut sebagai PIHAK II (KEDUA).
Here in after in this matter referred to as THE PARTY II.

Kedua belah pihak dengan ini menerangkan terlebih dahulu hal-hal sebagai berikut:
Both Parties hereby prior stated the following matters:

1. Pihak I (PT ……..) sesuai Akte perusahaan bergerak di bidang Perekrutan

Penempatan tenaga kerja awak kapal, atas dasar Perjanjian Kerjasama dan Surat
Kuasa Penunjukan Keagenan yang telah ditunjuk oleh perusahaan kapal untuk
merekrut Kru Indonesia.
The Party I (PT ………) in according to the certificate of the company engaged in the
recruitment of ship crew placement based on the Cooperation Agreement and the
Authority for Appointment of Agency appointed by ship company to recruit the
Indonesian Crew.

1. GILONTAS OCEAN PANAMA, S.A berkedudukan di Puerto De Vacamonte,

Ciudad De Panama, Telephone 507.251.7994/8254, adalah perusahaan pemilik kapal
dan atau yang ditunjuk oleh beberapa perusahaan pelayaran berbendara asing
beroperasi di laut lepas atau wilayah laut Internasional, untuk selanjutnya disebut
GOP.
GILONTAS OCEAN PANAMA, S.A having its domiciled at Puerto De Vacamonte,
Ciudad De Panama, Telephone 507.251.7994/8254 is a ship owner company and/or
who appointed by some of foreign shipping companies operate in High sea or
International sea territory, herein after referred to as GOP.

2. Pihak II (Kru) adalah seorang Awak Kapal Perikanan (AKP) yang telah memenuhi
persyaratan berusia minimum 18 (delapan belas) tahun, kelengkapan dokumen
sebagai pelaut dan pengalaman serta keterampilan dasar di atas kapal nelayan lokal
Indonesia dan atau kapal nelayan berbendera asing lainnya.

 THE PARTY II (Crew) is a Ship’s Crew who has fulfilled the minimum age of 18
(eighteen) years, document complete requirement as a sailor and experiences and
basic skill above and/orIndonesian local fishing boats and / or other foreign-flagged
fishing vessels.

Sehubungan hal-hal tersebut di atas, kedua belah pihak telah sepakat untuk mengadakan
perjanjian kerja laut pada kapal-kapal nelayan yang beroperasi di Luar negeri sesuai masa
kontrak yang ditentukan dengan pasal-pasal sebagai berikut :
In accordance with such matters above, both parties have agreed to enter into sea work
agreements on fishing vessels operating overseas with a contract period determined by the
following articles:

Pasal/Article 1
Persyaratan Dasar Rekrutment/ Basic Recruitment Requirements

1. Pihak II menyatakan bersedia dan sanggup bekerja sebaik-baiknya sebagai AKP pada
kapal-kapal yang ditunjuk oleh pihak I.
THE PARTY II willing and able to work as well as possible as a crew on appointed
ships by THE PARTY II.

2. Pihak II setuju dan siap untuk ditempatkan/dimutasikan ke kapal lain selama masa
kontrak kerja sesuai kebutuhan perusahaan atau pengaturan kerja Pihak I.
Party II agrees and is ready to be placed / transferred to other vessels during the
employment contract period in accordance with the needs of the company or the
work arrangements of Party I.

3. Pihak II harus mematuhi seluruh peraturan kerja perusahaan yang ditetapkan di atas
kapal dan peraturan di pangkalan lokasi kerja, termasuk peraturan hukum negara
setempat.
Party II must comply with all company work regulations established on board and
regulations at the work location base, including local country law.

4. Pihak II dalam hal ini akan dipekerjakan pada :

Pasal/Article 2
Masa Kontrak Kerja/ Employment Contract Period

1. Pihak II menyetujui masa kontrak kerja AKP perjanjian adalah selama 2 (dua) tahun
dan perpanjangan 1(satu) tahun, terhitung sejak tanggal keberangkatan dari Indonesia
hingga tanggal meninggalkan lokasi kerja.
Party II agrees that the contract period of the AKP work agreement is 2 (two) years
and/or an extension of 1 (one) year, from the date of departure from Indonesia to the
date of leaving the work location

2. Setelah masa kontrak perjanjian berakhir apabila kedua pihak masih saling

 membutuhkan bisa melakukan perpanjangan atas dasar kesepakatan bersama antara
Perusahaan kapal dan Pihak II, dan wajib menginformasikan kepada Pihak I.
After the contract period agreement expires if both parties still need each other to
make extensions on the basis of a mutual agreement between the ship company and
Party II, and must inform Party I.

Pasal/Article 3
Jam Kerja & Jam Istirahat / Working & Rest Hours Conditions

Pihak II memahami bahwa tidak ada jadwal kerja standar di atas kapal penangkap
ikan karena kegiatan penangkapan ikan berfluktuasi berdasarkan tangkapan dan
seringkali mengharuskan awak kapal untuk melakukan pekerjaan yang menuntut fisik
dan berat selama berjam-jam.
Jam istirahat minimum tidak akan kurang dari 10 jam dalam periode 24 jam; dan
rata-rata 77 jam per minggu selama seluruh durasi perjalanan memancing. Waktu
istirahat minimum 10 jam per hari dapat dikurangi menjadi tidak kurang dari enam
jam selama penangkapan ikan aktif dan pengolahan ikan, namun awak kapal harus
menerima waktu istirahat kompensasi sesegera mungkin. Ketika permintaan pada
kapal penangkap ikan mungkin memerlukan variasi dari jadwal istirahat yang
diusulkan, variasi tersebut harus wajar dan periode istirahat kompensasi akan tersedia
bagi awak kapal sesegera mungkin. Jam istirahat didefinisikan sebagai jam di luar
jam kerja di mana awak kapal tidak melakukan aktivitas terkait pekerjaan yang
ditugaskan oleh petugas di atas kapal.
Jika jam istirahat minimal di atas kapal, Pihak II bertanggung jawab untuk memberi
tahu personel darat Pihak I melalui metode komunikasi yang sesuai.
Party II understands that there is no standard work schedule on board a fishing
vessel as fishing activities fluctuate based on catch and ofter require crew member to
perform physically demanding and strenuous work for long hours.
Minimum hours of rest will not be less than 10 hours in any 24-hour period; and
average 77 hours per week over the entire duration of the fishing trip. The minimum
period of 10 hours of rest per day may be reduced to no less than six hours during
active fish catching and fish processing, however the fisher shall receive
compensatory periods of rest as soon as practicable. When demand on the fishing
vessl may require variation fromthe proposed rest schedule, such variations shall be
reasonable and compensatory periods of rest will be made avaiable to fishers as
soon as practicable. The resting hours are defined as the hours outside of work hours
that crew members are not conducting any work-related activities assign by the
officers onboard.
If rest hours are minimal on board the vessel, Party II shall have responsibility to
inform Party I’s on land personel via appropriate communication method.

Pasal/Article 4
Gaji dan Bonus / Salary and Bonus

1. Pihak II menyetujui gaji yang diterima selama perjanjian kerja ini adalah :
Party II approves the salary received during this work agreement is :
a. Tahun ke-1/ The First year : ........................./bulan-month.
b. Tahun ke-2/ The Second year : ........................./bulan-month.
c. Tahun ke-3/ Perpanjang-Extension : ........................./bulan-month.

2. Pihak II yang telah menyelesaikan masa kerja mencukupi 3 (tiga) tahun akan
mendapat Bonus finish kontrak sebesar : US 1,500 (Seribu lima ratus dollar US).
Party II who has completed a sufficient working period of 3 (three) years will receive
a Contract Finish Bonus of: US 1,500 (One thousand five hundred US dollars).

Pasal/Article 5
Ketentuan Pembayaran Gaji / Salary Payment Conditions

1. Pembayaran gaji dibagi menjadi dua bagian yaitu :

Salary payment is divided into two parts, namely :

a. Sebagian gaji sebesar US 100/bulan dibayar kepada pihak II di lokasi kerja

saat kapal bersandar di pangkalan.
Part of the salary of US 100/month is paid to Party II at the work site when
the ship is docked at the base.
b. Sisa gaji bulanan ditransfer ke rekening Bank sesuai yang ditunjuk oleh Pihak
II, proses pembayaran dilakukan setiap awal bulan berikutnya.
The remaining monthly salary is transferred to the Bank account as
designated by the Party II, the payment process is carried out at the
beginning of the following month.

2. Gaji Pihak II mulai diperhitungkan sejak tanggal keberangkatan dari Indonesia

menuju lokasi kerja, hingga hari terakhir tanggal kepulangan dari lokasi kerja
kembali ke Indonesia, terkecuali bila terjadi pelanggaran kontrak kerja.
The salary of the Party II begins to be calculated from the date of departure from
Indonesia to the work location, until the last day of the return date from the work
location back to Indonesia, unless there is a violation of the employment contract.

3. Apabila terjadi pelanggaran sepihak sebelum masa kontrak kerja berakhir, atas
permintaan Pihak II tidak mau melanjutkan perkerjaan dengan maksud ingin tetap
bertahan di darat menunggu sampai jadwal pemulangan, maka konsekuensi aturan
kerja adalah gaji dihitung sampai hari terakhir bekerja dengan menyampaikan Surat
Pengunduran Diri (Tidak Finish Kontrak) sebagai dasar pernyataan.
If a unilateral violation occurs before the term of the employment contract expires at
the request of Party II itself does not want to continue work with the intention of

Pasal/Article 6
Ketentuan Sanksi Pelanggaran Kontrak Kerja / Salary Payment Conditions

1. Pihak II memahami syarat dan ketentuan kontrak apabila Pihak II atas kemauan
sendiri tidak dapat menyelesaikan pekerjaan sebelum berakhirnya masa kontrak
dengan mengajukan Surat Pengunduran Diri (Tidak Menyelesaikan Kontrak) sebagai
dasar permohonan, maka Pihak II setuju untuk menanggung biaya pemulangan
sebagai berikut:
Party II understands the terms and conditionsof the work contract if Party II of his
own free will cannot finish work before the end of the work contract period by
submitting a Resignation Letter (Not Finish the Contract) as the basis for the

 request, then Party II agrees to bear the repatriation costs as follows:

a. Masa kerja kurang dari 1 (satu) tahun Pihak II menanggung biaya tiket
keberangkatan dan pemulangan ke Negara asal.
Work period of less than 1 (one) year Party II covers the cost of departure
and return tickets to country of origin.
b. Masa kerja kurang dari 2 (dua) tahun Pihak II menanggung biaya tiket
pemulangan ke Negara asal.
The working period is less than 2 (two) years. Party II covers the cost of
returning tickets to country of origin.

Pasal/Article 7
Tanggung Jawab Para Pihak / The responsibilities of the parties

 Tanggung jawab Pihak I/ perusahaan kapal sebagai berikut :

Responsibilities of Party I / ship companies are as follows:

1. Menanggung biaya-biaya proses keberangkatan Pihak II ke Negara penempatan

lokasi kerja berupa Visa, Tiket pesawat Internasional, Vaksin Kuning, Asuransi dan
biaya pemulangan kembali ke Negara asal bila Pihak II menyelesaikan tugas sesuai
masa kontrak kerja.
Bear the costs of the process of departure of Party II to the country of placement of
the work location in the form of Visa, International airplane ticket, Yellow Vaccine,
Insurance and the cost of repatriation to the country of origin if Party II completes
the assignment according to the work contract period.

2. Menyediakan makanan dan tempat tidur yang layak Pihak II selama bekerja.
Providing adequate food and bedding for Party II while working.

3. Bertanggung jawab atas keselamatan kerja Pihak II selama bekerja.

Responsible for the safety of the work of Party II while working.

4. Menyedikan persediaan obat-obatan medis yang diperlukan selama bekerja.

Menjamin semua biaya perawatan medis dan pengobatan dalam hal apabila Pihak II
terjadi kecelakaan kerja menyebabkan cedera atau sakit.
Providing medical supplies that are needed during work. Cover all costs of medical
care and medication in the event that Party II has an occupational accident causing
injury or illness.

5. Pihak I/ Perusahaan kapal tidak menanggung biaya pengobatan akibat penyakit

bawaan Pihak II: kanker, tumor, hernia, penyakit menular: HIV, biaya perawatan
rumah sakit akibat tindakan criminal: perkelahian, bunuh diri.
Party I / ship company does not cover medical expenses due to congenital diseases
Party II: cancer, tumors, hernias, infectious diseases: HIV, hospital treatment due to
criminal acts: fighting, suicide.

6. Menjamin hak-hak gaji dan Asuransi Pihak II sesuai kesepakatan perjanjian kerja.
Guarantee the rights of salaries and II Party Insurance in accordance with the work
agreement.

7. Memberikan bantuan komunikasi apabila Pihak II mengalami kesulitan selama masa
kerja, agar permasalahan yang dihadapi dilaporkan dan diselesaikan oleh perusahaan
kapal, nakhoda kapal, Pihak I.
Kontak akan diberikan setelah kedatangan untuk memungkinkan Pihak II
menghubungi jika mereka memiliki keluhan yang tidak dapat diselesaikan di kapal.
Providing communication assistance if Party II experiences difficulties during the
working period, for problems encountered to be reported and resolved by the ship
company, the ship's captain, Party I.A contact will be given at after arrival to able
allow Party II to contact if they have any complaint or grievance that cannot be
resolve on the ship.

8. Apabila Pihak II mengalami kecelakaan kerja dan atau hingga menyebabkan

kematian, maka perusahaan kapal harus segera memberitahukan insiden kepada
Pihak I dan memberikan semua dokumen yang diperlukan untuk mengurus
pengklaiman Asuransi Pihak II.
If Party II suffers an occupational accident and / or causes death, the ship company
must immediately notify the incident to Party I and provide all the documents needed
to take care of claiming Party II Insurance.

9. Apabila terjadi musibah kematian pihak II, maka jenazahnya dikuburkan / dikremasi
dengan layak di negara setempat atau di negara terdekat dengan wilayah operasi
kapal. Dan jika keluarga menginginkan jenazah untuk dipulangkan ke Indonesia,
maka perusahaan kapal harus memulangkan sepanjang keadaan memungkinkan
seluruh biaya pemulangan ditanggung oleh perusahaan pemilik kapal.
In the event of death of the Party II, the body is properly buried / cremated in the
local country or the country closest to the area of operation of the ship. And if the
family wants the body to be repatriated to Indonesia, the ship company must
repatriate as long as the circumstances permit, all repatriation costs be borne by the
ship owner's company.

 Tanggung jawab Pihak II sebagai berikut :

Responsibilities of Party II as follows:

1. Menyelesaikan pekerjaan dengan baik sesuai jabatan dan tanggung jawab hingga
masa perjanjian kerja berakhir.
Complete the work properly according to position and responsibilities until the work
agreement period ends.

2. Tunduk dan patuh sepenuhnya kepada peraturan dan aturan kerja yang telah
diaturkan oleh perusahaan kapal dan Kapten Kapal :
Subject to and fully comply with the rules and work rules that have been regulated by
the ship company and the Ship Captain.
a. Tidak boleh melakukan tindakan-tindakan diskriminasi seperti perkelahian,
memprovokasi pihak lain, pengancaman, penindasan, penganiayaan kepada
sesama.
Must not commit acts of discrimination such as fighting, provoking others,
threatening, oppression, persecution to others
b. Tidak melakukan aksi mogok kerja/ Not carrying out strike action.
c. Tidak melarikan diri atau meninggalkan kapal/ mess tanpa seijin pemilik
kapal atau kapten kapal.
Not escape or leave the ship / mess without the permission of the ship owner

d. Tidak boleh pindah/mutasi kapal atas kemauan sendiri tanpa ijin pemilik
kapal atau kapten kapal.
Must not move / transfer the ship on their own accord without the permission
of the ship owner or captain of the ship.

3. Pihak II wajib menangung sendiri biaya pengobatan medis atas segala penyakit yang
timbul bukan akibat dari kecelakaan kerja seperti penyakit bawaan (kanker, tumor,
hernia, dsb), penyakit menular HIV, pengobatan medis akibat perkelahian, bunuh
diri.
Party II must self-support the cost of medical treatment for all diseases arising not
resulting from occupational accidents such as congenital diseases (cancer, tumors,
hernias, etc.), HIV transmitted diseases, medical treatment due to fights, suicide.

4. Pihak II setuju untuk dipindahkan di pelabuhan mana pun untuk bergabung dengan
kapal mana pun yang dimiliki yang dioperasikan atau dikelola oleh Pihak I, asalkan
ketentuan upah dan masa kerjanya tetap sama dengan kapal sebelumnya tempat ia
dipindahkan dan pekerjan tidak melebihi persyaratan awal yang disepakati, kecuali
Kapten dan Pihak II setuju bersama untuk perpanjangan masa kontrak.
Party II agrees to be transferred at any port to join any vessel owned operated or
managed by Party I, provided always that his rate of wages and term of service
maintains the same as previous vessel that he was transferred from and the total
service doesn’t exceed that original agreed terms, unless the Captain and Party II
mutually agree to the extension of the contract period.

Pasal/Article 8
Hak-hak Para Pihak / Rights of The Parties

 Hak-hak Pihak I/ perusahaan kapal sebagai berikut :

Reights of Party I / ship companies are as follows:

Pihak I/Perusahaan kapal berhak pada setiap waktu menegur dan atau hingga
mengakhiri hubungan kerja perjanjian ini, karena alasan yang mendesak umpamanya:
The PARTY I/ Ship company has the rights at any time reprimand and/or terminate
this employment contract, because of urgent reasons like:
a. Pihak II kurang cakap, berkelakuan buruk, lengah atau lalai dalam kewajiban,
tidak patuh / melawan perintah atasan kapal atau melakukan perbuatan yang
merugikan pihak I.
THE PARTY II is not competent, misbehave, careless or negligent in
obligations, disobeying / against the orders of the superior of the ship or
committing an act that is harmful to THE PARTY I.
b. Bila Pihak II melakukan perbuatan-perbuatan yang bertentangan dengan
hukum pidana atau peraturan pemerintah setempat, maka ia akan diturunkan
di tempat pelabuhan di mana peristiwa itu terjadi dan diserahkan kepada
pihak yang berwajib.
In the event THE PARTY II commits actions that are contrary to criminal
law or local government regulations, then Party II will be dropped off at the
port where the event occurred and submit to the authorities.

 Hak-hak Pihak II sebagai berikut :
Reights of Party II as follows:

a. Pihak II berhak penuh atas pembayaran gaji sesuai isi perjanjian kerja.
Party II is entitled toreceive salaries according to the contents of the work
agreement.
b. Pihak II berhak atas Asuransi, jaminan keselamatan kerja.
Party II is entitled to insurance, and work safety guarantee.

Pasal/Article 9
Jaminan Asuransi / Insurance Guarantee

1. Pihak I wajib mengasuransikan Pihak II selama kontrak kerja.

Party I must insure Party II during the employment contract.

2. Hal-hal yang termasuk dalam pertanggungan oleh asuransi meliputi :

Matters covered by insurance cover :
a. Meninggal dunia akibat kecelakaan kerja minimal santunan Rp150,000,000
(Seratus Lima Puluh Juta Rupiah).
Passed away due to working accident shall be given compensation in the
amount of Rp, 150,000,000 (One hundred fifty million Rupiah)
b. Meninggal dunia akibat jatuh ke laut minimal santunan Rp150,000,000
(Seratus Lima Puluh Juta Rupiah).
Death due to falling into the sea with a minimum compensation of
Rp150,000,000 (One Hundred Fifty Million Rupiah).
c. Meninggal dunia akibat sakit minimal santunan Rp150,000,000 (Seratus Juta
Rupiah).
Passed away due to illness shall be given compensation in the amount of Rp,
150,000,000 (One hundred million Rupiah).
d. Cacat tetap akibat kecelakaan kerja santunan ditetapkan sesuai persentase
kehilangan anggota tubuh.
Permanent defect due to working accident the amount of compensation shall
be determined according to percentage of body apart.
e. Biaya perawatan rumah sakit akibat kecelakaan kerja.
Cost of hospital care due to working accident.

3. Hal-hal yang tidak termasuk dalam pertanggungan Asuransi/ perusahaan kapal /

Pihak I adalah :
Matters which are not included in the insurance coverage /ship company / Party I
are:

a. Biaya perawatan medis sakit bukan akibat kecelakaan kerja.

The cost of medical care for illness that is not due to work accidents
b. Kecelakaan cedera atau meninggal akibat perbuatan disengaja seperti
perkelahian, bunuh diri, dan kondisi force majeure bencana alam, peperangan
dan pembajakan.
Accident injury or death due to intentional acts such as fighting, suicide, and
force majeure conditions of natural disasters, warfare and piracy.

 Pasal/Article 10
Pemutusan Perjanjian Kerja / Termination of Employment Agreement

1. Dalam hal kontrak kerja tidak terpenuhi, Pihak II atas permintaannya sendiri ingin
dipulangkan atau tidak dapat melanjutkan pekerjaannya sebelum masa kontrak
berakhir, Pihak II harus memberitahukan Nakhoda Kapal 30 (tiga puluh) hari
terlebih dahulu dengan mengajukan surat pengunduran diri sebagai dasar
permohonan. Dengan demikian berlaku ketentuan pasal 6 (ayat 1).
In the event that the employment contract is not fulfilled, Party II, upon his own
request, wants to be repatriated or unable to continue his work before the contract
period expires, Party II must notify the Captain of the Ship 30 (thirty) days in
advance by submitting a resignation letter as a basis for application. Thus the
repatriation applies according to article 6 (paragraph 1).

2. Apabila melalui pertimbangan Kapten kapal/ perusahaan kapal Pihak II dinilai

kurang cakap, berkelakuan buruk, lengah atau lalai dalam kewajiban, tidak patuh /
melawan perintah atasan kapal atau melakukan perbuatan yang merugikan pihak I
atau terjadi gangguan kesehatan sehingga kondisi fisik tidak mendukung untuk tetap
melanjutkan pekerjaan.
Dalam hal pemutusan kontrak kerja sepihak, sanksi administratif pemulangan berlaku
sesuai dengan pasal 5 (ayat 3) dan pasal 6 (ayat 1).

considered incompetent, misbehaving, negligent or negligent in obligations,

work .
In the case of termination of a unilateral work contract, the administrative sanction
of repatriation applies in accordance with article 5 (paragraph 3) and article 6
(paragraph 1).

Pasal/Article 11
Keadaan Darurat / Force Majeur

1. Kondisi force majeure adalah suatu kondisi jika terjadi bencana alam,
kecelakaan/musibah di laut, perang atau pembajakan.
Force majeure is a condition in the event occur are natural disaster, accident/
disaster at sea, war or hijack.

2. Dalam kondisi force majeure, Pihak I harus bertanggung jawab menjaga keselamatan
Pihak II kembali ke pangkalan.
In the event of force majeure, Party I must responsible to keep safety of THE PARTY
II back to port.

Pasal/Article 12
Ketentuan Lain / Other Provisions
1. Apabila terjadi perselisihan antara Pihak II dengan pemilik kapal atau kapten kapal
maka akan diselesaikan bersama-sama dengan Pihak II secara musyawarah.
In the event occurs conflict between Party II with ship owner or ship captain so as

 2. Dalam hal terjadi perselisihan atau ketidaksepakatan antara Pihak II dan Pihak I
dalam kontrak ini yang tidak dapat diselesaikan, hal ini harus diserahkan kepada
otoritas dan atau pengadilan yang berwenang di Indonesia.
In the event of any dispute or disagreement between Party II and Party I regarding
the interpretation and or application of the term of this contract, which cannot be
settled, this shall referred to the appropriated authorities and or court in Indonesia.

3. Bilamana di kemudian hari karena sesuatu hal dipandang perlu untuk mengadakan
perubahan-perubahan/penambahan dalam perjanjian kerja laut ini. Maka hal
sedemikian dapat dilakukan atas kehendak persetujuan kedua belah pihak.

4. Perjanjian kerja ini brakhir dengan sendirinya jika karena keadaan atau situasi darurat

disetujui oleh kedua belah pihak. Dibuat 2 (dua) rangkap masing-masing materai dan
mempunyai ikatan hukum yang sama.
