 Definisi Hukum Pidana

Hukum pidana adalah hukum yang mengatur
tentang suatu perbuatan yang dilarang yang
disertai ancaman atau sanksi, kapan dan dalam hal
apa larangan itu dijatuhkan dan dengan cara
bagaimana pengenaan pidana tersebut.

Hukum Pidana merupakan hal yang mengatur
tentang pelanggaran serta kejahatan terhadap
kepentingan umum dan perbuatan itu diancam
dengan hukuman pidana yang merupakan suatu
penderitaan.
Satochid Kartanegara:
Hukum pidana adalah peraturan-peraturan yang
mengandung larangan maupun keharusan terhadap
pelanggarannya yang diancam dengan hukuman dan
mengatur hak negara untuk menghukum seseorang
yang melakukan perbuatan yang dilarang.
Hukum pidana adalah aturan-aturan hukum yang
mengikat kepada suatu perbuatan yang memenuhi
syarat tertentu suatu akibat yang berupa pidana.

Adl: Sekumpulan peraturan hukum yang
dibuat oleh negara yang isinya berupa
larangan maupun keharusan, sedang bagi
pelanggar larangan dan keharusan
tersebut dikenakan sanksi yang dapat
dipaksakan oleh negara.

ASAS LEGALITAS…???
“Tiada suatu perbuatan dapat dipidana kecuali atas kekuatan aturan pidana dalam
perundang-undangan yang telah ada sebelum perbuatan dilakukan (Pasal 1 Ayat
(1) KUHP)”

Makna Asas Legalitas:

1. Tidak ada suatu perbuatan yang dapat dipidana (dihukum) apabila

perbuatan tersebut tidak diatur dalam suatu peraturan perundang-
undangan terlebih dahulu.
2. Untuk menentukan adanya tindak pidana,tidak boleh
menggunakan analogi.
3. Undang-undang hukum pidana tidak boleh berlaku mundur/surut.
