A. Istilah Hukum Acara Pidana

Istilah Hukum Acara Pidana dapat disebut juga sebagai “hukum pidana Formal”, maksudnya untuk
membedakan dengan “hukum pidana materil”. Adapaun dimaksud dengan “hukum pidana materil” atau
aturan-aturan hukum pidana sebagaimana dalam kitab undang-undang hukum pidana (KUH Pidana)
adalah berisi petunjuk dan uraian tentang delik/tindak pidana/perbuatan pidana/peristiwa pidana/, yaitu
peraturan tentang syarat-syarat atau unsur-unsur dapat tidaknya seseorang dijatuhi tindak pidana
(hukuman) dan aturan tentang pemidanaan,yaitu mengatur kepada siapa dan bagaimana pidana itu
dijatuhkan, sedangkan”hukum pidana formil” adalah KUHAP adalah mengatur bagaimana negara melalui
alat-alatnya melaksanakan haknya untuk memidana dan menjatuhkan pidana, jadi berisi acara pidana.

isi keputusan ituharus dilaksanakan. Selanjutkan dikatakan, bahwa ketentuan itu dibuat dengan tujuan
untuk dapat menyelenggarakan penegakan dan kepastian hukum, menghindari timbulnyatindakan”main
hakim sendiri” didalam masyarakat yang bersifat tindakan sewenang-wenang.
