Abstract
The current adverse effects of the health insurance system in Korea are
considered to be problems that arise from an insufficient reflection of the notion of
respecting human rights. The ethical principles most commonly suggested and used in
public health are the 4 principles suggested by Beauchamp and Childress in 1994.
From the perspective of the community, these 4 principles of medical ethics can be
expanded to resolve problems surrounding existing social systems from a socialistic
standpoint. This article describes a flexible, easy-to-use model for incorporating the 4
medical ethics principles into the National Health Insurance System (NHIS). First, the
principle of respect for autonomy involves respecting the decision-making capacities
of autonomous medical consumers and providers and enabling individuals to make
reasoned and informed choices. Second is the principle of good practice.The
government and medical institu- tions should act in a way that benefits the health care
consumers.The principle of prohibiting bad practice involves avoiding causing health
problems.The National Health Insurance Corpora- tion and health care providers
should not harm the health care consumers. Finally, the principle of justice is
concerned with distributing benefits, risks, and costs fairlythat is, the notion that
patients in similar positions should be treated in a similar manner. If these problems
are solved, health system quality could be better and more accessible and
sustainable.The ethical assess- ment of the NHIS could be a trial to match the 4
medical ethics principles and the NHIS. It can be applied internationally to relevant
policy makers in different settings.

The health insurance system of Korea developed into a whole-nation system in
a short period of time by the supplementation of various models used in developed
countries. The health insur- ance system is strengthening its role in improving
national health levels and acting as a social safety net. However, there are still
inadequacies in satisfying the various desires of the public and medical providers.
Currently, the challenges to the health insurance system are as follows: first, there are
drastic increases in national medical costs because of the rapid aging of
society,increases in requests for a better quality of life, and developments in medical
technology such as expensive new medicines and equipment. Second, there are
criticisms leveled at the health insurance systems role as a social safety net because
of the low protection rate, criticisms of various restrictions, and the existence of a
considerable number of blind spots with regard to medical security. Third, requests
for health insurance are becoming diversified, with continual suggestions for medical
industrialization, allowing profit-making corporations, and revitalizing private
insurance, for example. Finally, there are requests for financial stability measures to
ensure long-term stability for health insurance finances.1
These problems in the health insurance system have been pointed out many
times in many reports. However, when suggesting opinions regarding the reform of
the existing health insur- ance system, there are only suggestions of issues and
methods for a resolution; when there is a divide among the stakeholders, the problem
remains unsolved.2 Although the health insurance system has grown in terms of
quantity and structural reform thus far, in the future, there should also be qualitative
growth, with a complete system put in place. To accomplish this, stakeholders in the
health insurance area must move away from their interests to discover a common
value and better the system gradually to achieve it.
How can we find the value that should be pursued by the health insurance
system so that it grows in maturity while maintaining the social insurance values of
social solidarity and prepar- ing for risk? The current adverse effects of the health
insurance system are considered to be problems that arise from an insufficient
reflection of the notion of respecting human rights. Therefore, if the problems
regarding health insurance are examined from an ethical perspective, a solution could
be suggested.3

The ethical principles most commonly suggested and used in the public health
area are the 4 principles4 suggested by Beauchamp and Childress in1994: the
principle of autonomy, principle of prohibiting bad practice, principle of good
practice, and principle of justice. These principles, which are known as the 4
principles of medical ethics,5 have been used as criteria in resolving individual ethical
problems. From the perspective of a community, these 4 principles of medical ethics
notions can be expanded to resolve problems surrounding existing social systems
from an individualistic and socialistic standpoint.6

Principle of Respecting Autonomy
When viewed in the light of the principle of respecting autonomy, all humans
have autonomy. This means that they have a natural given human right and the right
to achieve what is most desirable for themselves. Most situations in modern society
demonstrate that respecting rather than ignoring the autonomy of a person enhances
that persons kindness. Even in regard to sat-isfaction, if there is no large difference in
results, people are more satisfied in making their own choices and deciding on an
action rather than following orders. In this way, autonomy itself is kindness and
furthermore can become the foundation to produce more kindness.
A health insurance system that can maximize the protection of this autonomy
of the patient and the autonomy of the medical provider according to the principle of
respecting autonomy could be considered.6 The medical consumers autonomy
involves strengthening the self-determination capability with respect to the health of
the people. To achieve this, health care information should be provided to people
systematically. This is needed to enhance health care and electronic records of the
health care information system. With respect to autonomy of medical providers, it is
neces-sary to strengthen their autonomy. We should reconsider stakeholders
autonomy during decision-making processes of benefit package coverage rate and
medical insurance fee.
The principle of good practice requires respect for the autonomy of other
individuals and requires us not to cause damage to others. More than just avoiding
damage to others, this prin-ciple requires the active helping of others. Thus, it has
more meaning than the principle of prohibiting bad practice. This principle of good
practice is composed of 2 principles: one is active good practice, and the other is
utility. Active good practice requires the provision of a benefit to others, whereas the
principle of utility requires a balance between loss and gain. There are risks in the
creation of a gain or in the elimination and prevention of a bad practice. Thus, it is

important in the principle of good practice to maintain a balance between loss and
gain.
The principle of good practice was deduced from the long-held belief that it is
a professional responsibility in medicine to provide medical benefit to patients. It
aims to avoid bad practice as much as possible and expand good practice by
considering the well-being of all contractors. The principle of good practice includes
the principle of prohibiting bad practice, in that it excludes bad practice. In terms of
the principle of good practice, the health insurance system must enhance public health
and quality of life and improve the quality of medicine and the effectiveness of the
national health management system.6

and sustainability of costs in the health system.
Additionally, the Ministry of Health and Welfare and the National Health
Insurance Corporation are in charge of operating the health insurance finances under
the current NHIS. Hence, rational and effective management of finances is required to
prepare the foundation for sufficient insurance payment to the public and the
promotion of public health. Transparent opera- tion of the Ministry of Health and
Welfare and all other committees and decision-making pro- cesses is necessary for the
effective management of health insurance finances.

Discussion
Medical security refers to securing the necessary medical services for all
members of a country regardless of their socioeconomic status.7 It is a very
comprehensive notion that includes removal of economic walls in receiving medical
service, guarantees for necessary service, pre- vention of moral laxity, supplying
suitable medical services, providing nonmedical health ser- vices, and liberation from
anxiety regarding health.8-11 From these notions of medical security, it becomes
clear that the government has the responsibility to achieve the principle of justice.
The equity in health of our country can be improved by relieving the health-
level gap that exists between socioeconomic classes, divided according to income and
education levels. Relieving the gaps in health levels to secure equity in health can be
achieved by heightening the security of necessary medical services.12 Security in
health insurance is a notion that can be shown by the official amount supported by the
government in insurance payments13 and can also be represented as an extension of
the applicable population and the scope of payment.
The principle of justice can be seen as the correct method to distribute social
burdens and benefits as well as status.14 Aristotle proposed a formal principle of
justice, stating that equals should be treated equally and unequally, but when there
is no practical standard in distributing the appropriate amount to each individual, a
formal principle is of no use. Thus, a practical distribution criterion that justifies
inequality, that is a practical principle of justice, is necessary.

the distribution of public medical services and medical resources, the right to
minimum medical treatment is acknowledged, and effective resources distribution is
attempted. The right to minimum medical treatment refers to equal opportunity to
access, where no one should be hindered from receiving medical service. A general
definition of equal opportunity to access means that all have access to all medical ser-
vices that are provided for all, whereas a limited definition of equal opportunity to
access means that all citizens have a right to a minimum level of medical service. In
other words, equal oppor- tunity to access does not mean the right to actually receive
medical service but to provide equal opportunity regarding public medicine.
If the practical principle of justice for equal distribution deals with providing
equal opportu- nity regarding public medicine, the government is responsible for
satisfying the basic medical needs of all citizens and should guarantee universal
access to essential areas for individual health and for those in need of medical
services as a result of a disaster.
The principle of respecting autonomy means to respect people above all, and
to be autonomous means to have the ability to decide regarding ones own self and to
formulate and carry out ones own plans and policies.15 Independent people can be
seen to have the ability to act on their own principles and values. Hence the people of
our country need to improve their health care ability actively so as to
maintain/improve their own health. They should develop not only a healthy lifestyle
but also the ability to engage in various decision-making processes regarding health
care. To participate, individuals have to equip themselves with the ability to
understand information clearly regarding their own health and actually participate in
important decisions regarding their own body.
The ability to decide regarding expenditures related to health care should also
be strength- ened. Because they are direct contributors to health insurance finances,
citizens need to take responsibility, along with the government and insurers, to
effectively manage and operate the finances they pay and to be more active in their
participation. The people are not the actual man- agers of health insurance finances.
However, to reduce public medical costs and their own health insurance burden, they
can directly/indirectly participate in the retrenchment and asset manage- ment of
health insurance finances and realize practical participatory justice.

making regarding their own health. Moreover, to maintain/improve their own health,
people can actively participate in health- related policies. Beneficial political
decisions for health maintenance can be an opportunity to enhance the health level of
the entire society as well as promote communal kindness.

Efek buruk dari system jaminan kesehatan di Korea saat ini merupakan
masalah-masalah yang muncul oleh karena tidak cukup refleksi dari gagasan untuk
menghormati hak asasi manusia. Prinsip-prinsip etik yang paling sering digunakan
dalam kesehatan masyarakat ada 4 prinsip yang dikemukakan oleh Beauchamp dan
Childress pada tahun 1994. Dari perspektif masyarakat, keempat prinsip dari etika
kedokteran ini dapat diperluas untuk menyelesaikan masalah di seputar sistem sosial
dari sudut pandang sosial. Artikel ini menggambarkan sebuah contoh yang mudah
digunakan dan fleksibel untuk menggabungkan keempat prinsip etika kedokteran
kedalam Sistem Jaminan Kesehatan Nasional. Pertama, prinsip menghargai otonomi
melibatkan penghormatan kapasitas konsumen medis dan tenaga kesehatan dalam
pengambilan keputusan dan memungkinkan seseorang untuk membuat pilihan yang
beralasan. Kedua, prinsip beneficence. Pemerintah dan institusi medis harus bertindak
dengan cara yang menguntungkan konsumen medis. Ketiga, prinsip non-maleficence
berkaitan dengan menghindari hal yang dapat menimbulkan masalah kesehatan.
Perusahaan jaminan kesehatan nasional dan penyedia pelayanan kesehatan seharusnya
tidak boleh membahayakan konsumen medis. Terakhir, prinsip Justice berkaitan
dengan distribusi manfaat, risiko dan biaya secara adil. Yang berarti bahwa pasien
yang memiliki kondisi yang sama harus diperlakukan pula dengan cara yang sama.
Apabila masalah-masalah ini dapat diselesaikan, kualitas sistem kesehatan dapat
menjadi lebih baik, lebih mudah diakses dan akan berkelanjutan. Penilaian etik dari
sistem jaminan kesehatan nasional dapat percobaan untuk mencocokkan keempat
prinsip etika kedokteran dengan sistem jaminan kesehatan nasional. Hal ini dapat
diterapkan secara internasional kepada pembuat kebijakan untuk membuat kebijakan
yang sesuai dalam berbagai macam keadaan yang berbeda.

Prinsip-prinsip tersebut, yang diketahui juga sebagai 4 prinsip etika
kedokteran, telah digunakan sebagai kriteria untuk memecahkan masalah etika
seseorang. Walaupun tidak memiliki urutan tata cara penerapannya, prinsip-prinsip
tersebut dapat membantu para dokter dan tenaga kesehatan lain untuk membuat
keputusan berdasarkan isu moral yang muncul saat bekerja. Dari perspektif
masyarakat, keempat prinsip etika kedokteran dapat diperluas untuk memecahkan
masalah di sekitar sistem sosial yang telah ada, dari sisi individual maupun sisi
masyarakat. Artikel ini menggambarkan sebuah contoh yang mudah digunakan dan
fleksibel untuk menggabungkan keempat prinsip etika kedokteran ke dalam Sistem
Jaminan Kesehatan Nasional. Tujuan artikel ini adalah untuk membuat Sistem
Jaminan Kesehatan Nasional secara lebih dapat ditransfer secara international dan
relevan terhadap para pembuat kebijakan dalam berbagai macam keadaan yang
berbeda.

Prinsip Beneficence
Berdasarkan prinsip ini, kita perlu memberikan dorongan atau insentif kepada
seseorang yang berhasil menjaga kesehatan diri mereka sendiri dan berperilaku hidup
sehat. Fungsi perusahaan jaminan kesehatan nasional harus dievaluasi kembali.
Mereka harus menghadirkan elemen kompetisi agar dapat secara efektif bekerja
sebagai sebuah perusahaan. Sebuah kebijakan untuk mempromosikan perkembangan
teknologi medis juga diperlukan. Panduan praktik klinis juga harus direvitalisasi dan

Bila standar untuk keadilan klasik seperti kemampuan, kinerja, usaha yang
diberikan, dan kebutuhan untuk penerapan distribusi sumber daya dan pelayanan
medis yang nyata, dan kontraindikasi yang muncul diantara standar yang diterapkan.
Namun umumnya dalam distribusi pelayanan medis dan sumber daya medis,
pengakuan pada hak untuk perawatan medis minimal, dan usaha distribusi sumber
daya yang efektif. Hak atas perawatan medis minimum mengacu pada kesempatan
untuk masuk, dimana tidak ada yang terhalangi untuk mendapatkan pelayanan medis.
Definisi umum tentang kesempatan yang sama untuk mengakses pelayanan medis
untuk semua orang yang disediakan. Sedangkan definisi yang terbatas pada
kesempatan yang sama untuk mengakses bahwa semua warga negara memilki hak
atas tingkat pelayanan medis minimum. Dengan kata lain, kesempatan yang sama
untuk mengkses tidak hanya hak untuk benar-benar menerima pelayanan medis
namun memberikan kesempatan yang sama mengenai pengobatan publik.
Jika praktik prinsip peradilan untuk kesepakatan distribusi yang sama dengan
pemberian kesempatan yang sama mengenai pengobatan umum, pemerintah
bertangggung jawab untuk memenuhi kebutuhan medis untuk semua warga negara
dan harus menjamin akses universal ke daerah lain bagi individu atau yang
membutuhkan layanan medis.

Kemampuan untuk memutuskan mengenai pengeluaran yang berkaitan dengan
perawatan kesehatan juga harus diperkuat. Karena mereka terlibat langsung terhadap
keuangan asuransi kesehatan, setiap warga perlu bertanggung jawab bersama
pemerintah dan perusahaan asuransi, agar dapat mengelola dan mengoperasikan
keuangan yang mereka bayar. Masyarakat sebenarnya tidak mengelola keuangan
asuransi kesehatan. Namun untuk mengurangi biaya publik medik dan beban asuransi
kesehatan mereka sendiri, mereka bisa secara langsung atau tidak langsung
berpartisipasi dalam penghematan dan pengelolaan keuangan asuransi kesehatan dan
mewujudkan keadilan yang pratisipatif secara klinis.
Kesimpulan
Kami melakukan penilaian etika NHIS di Korea berdasarkan pada 4 prinsip yang
disarankan oleh Beauchamp dan Childress pada tahun 1994: Prinsip otonomi,
beneficence, non-maleficence, justice. Melalui analisis, penyeselesaian masalah yang
disarankan untuk identifikasi dalam NHIS di Korea. Selain itu, disarankan agar etika
perspektif dapat digunakan sebagai kerangka penilaian dalam Kebijakan Kesehatan
Masyarakat Nasional.
