SURAT AKUAN KEBENARAN POTONGAN GAJI PEMBELI/PEMINJAM

1. PERAKUAN PEMBELI / PEMINJAM

Saya dengan ini bersetuju supaya gaji saya dipotong untuk dibayar kepada (nama organisasi)
bagi bayaran seperti ternyata di Bahagian Tiga (3) dalam surat kebenaran ini dan lain-lain bayaran atau perubahan yang diarahkan oleh organisasi dari semasa ke semasa.
Potongan ini akan dibuat kepada I Destinasi Sdn. Bhd. (IDSB) yang bertanggungjawab mengendalikan pengutipan potongan gaji.
Persetujuan saya ini juga adalah keizinan saya yang dikehendaki di bawah undang-undang bertulis mengenai potongan gaji dan/atau buruh terpakai dan keizinan ini
termasuk memberi kuasa kepada majikan saya untuk mengubah dan/atau meminda potongan gaji ini selaras dengan undang-undang bertulis.
Persetujuan ini laku sehingga kebenaran ini saya tarik balik secara bertulis dan pembatalan potongan ini akan dilaksanakan setelah disahkan oleh organisasi bahawa saya
adalah bebas dari sebarang hutang atau tunggakan ansuran pinjaman dan lain-lain bayaran atau perubahan yang diarahkan. Saya maklum bahawa urusan potongan gaji ini
ialah suatu kemudahan membayar dan saya masih bertanggungjawab terhadap bayaran-bayaran yang tidak dijelaskan kepada organisasi tersebut.
Saya juga membenarkan pihak organisasi atau majikan menyemak maklumat potongan gaji dan maklumat lain saya. Sebagai balasan bagi yang tersebut di atas, saya
dengan ini menyelamatkan Kerajaan Malaysia dan IDSB dari kerugian dan saya tidak akan membuat tuntutan terhadap mereka, tidak akan menuntut daripada mereka, atau
tidak akan mendakwa mereka, di atas apa-apa kerugian yang mungkin berlaku selepas apa-apa jumlah telah dipotong dari gaji saya dan dihantar kepada IDSB atas
permintaan saya.
Saya dengan ini mengizinkan IDSB mengenakan caj proses dan penyediaan potongan gaji sebanyak 2% daripada jumlah potongan gaji bulanan saya sehingga tamat
bayaran / penyelesaian pembiayaan sepertimana yang terdapat di dalam perjanjian pembiayaan.
Saya mengakui telah membaca dan memahami implikasi surat kebenaran ini dan semua pekeliling, arahan dan aturan-aturan yang mengawalselia urusan potongan gaji
ini yang dikeluarkan oleh Kerajaan dan IDSB dari masa ke semasa. Ungkapan "organisasi" termasuk bank-bank.

telah membuat pembayaran sepertimana butiran yang dinyatakan di sini dan juga di dalam Surat Penyelesaian Pinjaman/Pembiayaan dari institusi berkenaan
yang disertakan bersama surat ini. Saya juga bersetuju tidak akan membuat sebarang tuntutan/tindakan terhadap Bank dalam bertindak mengikut arahan saya
di sini kecuali jika tuntutan / tindakan tersebut timbul kerana tindakan, kelalaian, keingkaran, kecuaian dan / atau salah laku pihak Bank dan / atau mana-mana
pekerja, wakil dan ejennya.

I also agree that the balance amount of the above financing (after deduction) will be paid by the Bank to me through the bank account which I have specified
above. I also expressly agree that this authorization is an irrevocable approval if the redemption amount has been paid to any third party on my behalf by the
Bank, and I will pay the whole redemption amount to the Bank if I were to withdraw/ cancel the Facility. /

Saya juga bersetuju bahawa baki amaun pembiayaan di atas (selepas potongan) akan dibayar oleh Bank kepada saya melalui akaun bank sepertimana
dinyatakan di atas. Saya juga dengan ini bersetuju bahawa kebenaran ini adalah kebenaran tidak boleh batal sekiranya amaun tebus hutang telah pun dibayar
kepada mana-mana pihak ketiga bagi pihak saya oleh Bank dan saya akan membayar kesemua amaun tebus hutang tersebut kepada Bank jika saya
membatalkan Kemudahan tersebut.

OPTION TO MAINTAIN THE SAME MONTHLY PAYMENT, IN THE EVENT OF BASE RATE (BR) ADJUSTMENT/ PILIHAN UNTUK
MENGEKALKAN PEMBAYARAN BULANAN YANG SAMA, SEKIRANYA BERLAKU PERUBAHAN KADAR ASAS

I hereby agreed to maintain the same monthly payment throughout the financing tenure in the event of Base Rate (BR) is adjusted upward or downward of
which the last instalment will vary (higher or lower) against the final due amount. It must be paid OR the bank will refund to me if the final due amount is
lower than the normal monthly instalment. / Saya dengan ini bersetuju untuk mengekalkan bayaran bulanan yang sama sepanjang tempoh pembiayaan
sekiranya Kadar Asas dinaikkan atau diturunkan di mana bayaran bulanan terakhir akan berbeza (lebih tinggi atau lebih rendah) berbanding dengan

RHB PERSONAL FINANCING-i
TERMS & CONDITIONS (VARIABLE RATE)
Valid as of [30 June 2021]

1. DEFINITIONS

The following words and expressions have the following meaning: -

(a) “Commodity Trading Approval Letter” means the letter of approval from the Bank pursuant to
the commodity trading taking effect based on Customer’s application for the Facility.

(b) “Bank” means RHB ISLAMIC BANK BERHAD (Registration No. 200501003283 (680329-V)), a
licensed Islamic financial institution incorporated in Malaysia and having its registered office at
Level 10, Tower One, RHB Centre, Jalan Tun Razak, 50400 Kuala Lumpur, Malaysia.

(c) “Bank’s Selling Price” means the Bank’s Selling Price as defined in Clause 5(g) below.

(d) “Customer” means the person to whom the Facility is granted by the Bank upon these terms and
conditions.

(e) “Event of Default” means any of the events set out in Clause 30 below.

(f) “Facility” means the principal sum of the Personal Financing-i facility approved by the Bank in the
Commodity Trading Approval Letter subject to these terms and conditions.

(g) “Specified Commodity” means any commodity as determined by the Bank which is halal and is
in compliance with Shariah principles on an “as is where is” basis, without any representations or
warranties from the Bank as to the quality, condition, quantity and description and without liability
on the part of the Bank for any loss, damage or deterioration (save where such loss, damage or
deterioration is attributable to the act, omission, default, negligence and/or misconduct on the part
of the Bank and/or any of its employees, representatives and agents).

(h) “Statement of Account” means the statement setting out the Facility details which is sent to the
Customer on an annual basis.

(i) “Stamp Duty” means the tax levied on the documentation for the Facility as stated in the Stamp
Act 1949 and will be debited from the Facility prior to the disbursement of the Facility.

(j) “Trading Fee” means the fee charged by a commodity broker to execute transactions pursuant
to commodity trading as set out in Clause 5 below. The amount will be debited from the Facility
prior to the disbursement of the Facility.

3. Facility
(a) This is the Personal Financing-i facility (“PF-i” or “Facility”) offered to the Customer.

(b) The details of the Facility will be specified in the message sent via Short Messages Service
(SMS) to the Customer and/or the Commodity Trading Approval Letter that will be delivered to
the Customer, upon the Bank’s approval of the Customer’s application for the Facility and,
where applicable, upon disbursement of the Facility.
4. Purpose
(a) The Facility is to be utilised for the personal use of the Customer.

(b) The Customer agrees that the Facility must not be utilised for any non-halal goods or services.

5. Mode of Financing
(a) The Facility is in accordance with Shariah contract of Commodity Murabahah via Tawarruq
arrangement and Wakalah where the Customer will appoint the Bank as its sole and exclusive
agent to deal with the Specified Commodity as an underlying transaction as agreed.
(b) Upon approval of the Facility, the Bank shall make an offer via issuance of SMS or on-screen
approval notification to Customer. The offer will state the amount of the Facility approved, the
Bank’s selling price of the Specified Commodity, the Tenure, the Profit Rate and the monthly
payments for the Customer’s acceptance.
(c) The Customer’s reply to the Bank’s offer via SMS or on-screen approval notification will be
construed as follows:
(i) by replying “YES” to the SMS or giving thumb prints during on-screen approval notification
which signifies that the Customer accepts the Facility offered and wishes to proceed with
the transaction; OR
(ii) by replying “NO” to the SMS or clicking “NO” for on-screen approval notification which
signifies that the Customer rejects the Facility offered and does not wish to proceed with
the transaction
Note*: A “YES” signifies the Customer’s acceptance of the Bank’s offer contained in the SMS
or Approval Letter that will be sent to the Customer upon approval of the Facility, and will, upon
disbursement of the Facility, constitute a debt payable on the part of the Customer in the form
of the Bank’s Selling Price. The Customer agrees to pay the Bank’s Selling Price in the amount/
rate/tenure/monthly payment as contained in the SMS and/or in the manner as contained in the
Approval Letter.
(d) If the Customer does not reply to the SMS sent by the Bank within the same day (during the
Bank’s business hour), a follow up SMS will be sent to remind the Customer to accept or reject
the offer of the Facility. If there is no response from the Customer, the Customer’s application
will be cancelled automatically (21) twenty one days after the approval date.

(e) Upon approval of the Facility and the Customer’s acceptance of the Facility offered, the Bank
will be appointed as the Customer’s agent (Wakil) to deal with the Specified Commodity and/or
the Bank may delegate its rights and duties as such agent herein to any third party under
Agency (Wakalah) contract to act on Customer’s behalf for the commodity trading transaction.

(f) The Bank will initiate commodity trading with a commodity broker (“Broker A”) for the purchase
of the Specified Commodity on immediate payment terms. The purchase price will be
equivalent to the amount of the Facility approved

(g) Upon the Bank taking delivery of the Specified Commodity from Broker A, the Bank will issue
an offer to sell the Specified Commodity at a marked-up price and on deferred payment basis
(“Bank’s Selling Price”) to the Customer. The Bank (acting as the Customer’s agent) will accept
the offer made and delivery of the Specified Commodity on the Customer’s behalf.

(h) The Bank, still acting as Customer’s agent, will then sell the Specified Commodity to a
commodity broker (“Broker B”) in the sum equivalent to the amount of the Facility approved.
The proceeds from the sale to Broker B will be dealt with in accordance with Clause 10(b)
below.

(i) An SMS will be sent to notify the completion of the trading process of the Specified Commodity
and disbursement of the Facility Amount.

(j) Issuance of the Commodity Trading Approval Letter to the Customer is inclusive evidence of
the completion of the trading process of the Specified Commodity and disbursement of the
Facility.

6. Right and Obligation

The Bank may:

(a) perform any of its obligations and responsibilities through its personnel or agents;

(b) refrain from doing anything which would or might in its opinion be contrary to any law of any
jurisdiction or any directive of any agency of any state or otherwise render it liable to any
person and may do anything which is in its opinion necessary to comply with any such law or
directive;

(c) assume that no Event of Default has occurred unless an officer of the Bank, while active on
the account of the Customer, acquires actual knowledge to the contrary;

(d) rely on any communication or document believed by it to be genuine;

(e) rely as to any matter of fact which might reasonably be expected to be within the knowledge
of the Customer on a statement by or on behalf of the Customer;

(f) assume that any person notified to it by the Customer as duly authorized to take any action
contemplated by the Facility remains so authorized until it has received written notice to the
contrary from the Customer; and

(g) act as it deems fit to assist the Customer in selling the Commodity to the Broker B.
The Customer:

(a) is liable for the sale and purchase contract entered into by the Bank as its agent in accordance
with these terms and conditions, save and except for any actions, claims, demands, liabilities,
losses, damages, costs and expenses which arise from the act, omission, default, negligence
and/or misconduct on the part of the Bank and/or any of its employees, representatives and
agents; and

(b) is to indemnify the Bank against all losses, claims, actions, proceedings, damage, costs and
expenses whatsoever brought or claimed by any party and/or incurred or sustained by the Bank
as a result of:
(i) the buying and selling of the Specified Commodity under any transaction as the Customer’s
agent; or
(ii) a breach by the Customer of any of his/her/their obligations under the Facility,
save and except where such losses, claims, actions, proceedings, damage, costs and
expenses are attributable to the act, omission, default, negligence and/or misconduct on the
part of the Bank and/or any of its employees, representatives and agents. This indemnity
will survive termination of these terms and conditions.
7. Ceiling Profit Rate
The Ceiling Profit Rate is : 18.00% p.a. (applicable for Civil Sector & Pensioner)
: 24.00% p.a. (applicable for Private Sector)
The Selling Price* is calculated based on the Ceiling Profit Rate.

Note*: Selling Price * consists of Purchase Price + Total Profit Amount


8. Effective Profit Rate
PF-i: Base Rate (BR)<+spread or – spread > % p.a based on daily rest.
The monthly payment is calculated based on the Effective Profit Rate.
Subject to Clause 20 below, the Bank will grant Ibra’ (rebate) on the difference between the
amount of profit based on Effective Profit Rate and Ceiling Profit Rate (if any). The Ibra’ will be
granted if the Effective Profit Rate is lower than Ceiling Profit Rate.
9. Profit Calculation Method
Reducing balance is a method of computing profit portion on the principal balance that reduces
the calculated payments made.

From the total payment made per transaction, the hierarchy of deduction is in accordance to
the following sequences;
(i) principal portion.
(ii) any related fees (if any), and
(iii) profit portion

10. Disbursement

(a) The Facility will be available for disbursement upon completion of the financing processes and
fulfilment of the conditions precedent as stated in Clause 28 below to the Bank’s satisfaction.

(b) The disbursement of the Facility will be made in one lump sum pursuant to the sale of the
Specified Commodity to Broker B. Subject to any agreed deduction with the Bank, the
proceeds will be:

(i) deposited directly into the Customer’s account; or

(ii) as authorised by the Customer and agreed to by the Bank, be disbursed to the list of payees
as agreed.

Such disbursement will be deemed to be a full disbursement under the Facility.

(c) Disbursement account

(i) For PF-i for Private Sector / Pensioner:


The Customer must open and maintain a deposit account with the Bank. The Customer
agrees that the disbursement of the Facility will be made directly into such account.

(ii) For PF-i for Civil Sector:


The Customer has the option to open and maintain a deposit account with the Bank or to
specify his/her account with other financial institutions, into which the disbursement of the
Facility will be made.

11. Condition for Disbursement

(a) The Facility will be available for utilisation subject to the conditions precedent as stated in
Clause 28 having been fulfilled to the Bank’s satisfaction.

(b) If the Customer fails to comply with any of the conditions precedent and the Shariah principles,
the Customer will not be entitled to utilise the Facility and the Bank may recall the Facility with
prior written notice to the Customer. In such event, the Customer is to reimburse and/or
indemnify the Bank for all costs and expenses (including legal costs and expenses) incurred
by the Bank in connection with the approval and/or grant of the Facility to the Customer.
12. Pre and Post Disbursement Cancellation

(a) The Bank may, with prior written notice to the Customer, cancel the Facility offered, at any
time before or after disbursement, if there is any breach of Shariah principles, material
omission of facts or misrepresentation of any material facts, that may change the
creditworthiness of the Customer and/or the Customer’s ability to perform his/her obligation.

(b) If the Customer wishes to cancel the Facility, the Customer must settle the indebtedness,
including all fees, costs, Trading Fee, takaful contribution (if applicable) and Stamp Duty, in
full.

(c) In each of these events, the full amount of the Bank’s Selling Price and all monies outstanding
under the Facility together with compensation thereon (if any) and all other monies relating
thereto will become immediately due and payable by the Customer.

13. Debt Consolidation

The Customer agrees that any additional fees/costs/charges arises from the settlement made
through the proceeds from the approved financing amount to the respective banks/financial
institutions/creditors concerned, will be borne by Customer.
14. Account

For payment via Standing Instructions:

The Customer irrevocably and unconditionally authorises the Bank at any time and from time to
time to debit his/her account with the Bank for any payment due under or pursuant to the Facility,
including payment of the monthly payment.

For monthly payment via Standing Instructions, the Customer agrees and authorizes the Bank to
set-off the Standing Instruction account manually even though the auto-deduction does not take
place due to insufficient balance in the account. A manual deduction will be used to set-off against
the debt owed by the Customer and prior notice of seven (7) days will be given to the Customer of
such manual set-off from the Standing Instruction account together with the reason(s) for such set-
off.

The Customer agrees not to cancel/terminate the Standing Instructions account as long as there
is debt owed by the Customer under the Facility.
15. Takaful

(a) The Customer must take up a personal Takaful plan to secure the payment under the Facility
either from a Takaful operator listed on the Bank’s panel of Takaful operators or from any other
legitimate Takaful operator of his/her choice.

(b) The contribution payable will be deducted from the Facility amount prior to disbursement of the
Facility only if the Takaful operator is listed in the Bank’s panel.

(c) If the Customer opts for Takaful coverage from the Bank’s non-panel Takaful operator, the
Customer must provide proof of coverage on the financing approved. The Customer is to bear
the Takaful cost at his/her own expenses. The Takaful cost will not be deducted from the
amount of the Facility.
16. Method Of Payment Of Bank’s Selling Price (monthly payment)

Monthly Payments amount shall consist of the principal amount and profit margin. Monthly Payments
amount and Monthly Due Date will be notified to the Customer in a manner which shall be
determined by the Bank upon disbursement of the Facility.
Monthly Payments and the duration for payment of the Bank’s Selling Price may vary according to
the changes of BR and subsequently the Effective Profit Rate set out in Clause 8 from time to time
and incidental costs charged, provided that the Bank’s Selling Price shall remain unchanged.
Currently, the Bank’s BR is at 2.50% per annum. In the event of the said variation, the Bank will give
prior notice to the Customer for a period of not less than seven (7) calendar days and they shall
become effective on the corresponding date of the subsequent months.
At the discretion of the Bank, a notice of such additions or amendments or variations may be
affected by:-

i. Displaying the same at the premises of the Bank or its branch offices or by mailing the
aforesaid notice to the Customer, or
ii. By sending notice of the same by SMS or electronic mail to the Customer or by posting the
notice of the same on RHB PF-i For Private Sector, Civil Sector and Pensioner website, or
iii. By letter delivered by hand.

For PF-i for Civil Sector:
In the event of customers opted to maintain the same monthly payment when BR is adjusted
upward or downward, the final payment will varies (increase or decrese) of which any excess
amount against the normal payment amount, it must be paid by customer (through salary
deduction) OR the bank will refund to customer if the final payment is lower than the normal
monthly payment, as to offset any differential sum due to the event of changes to BR. The monthly
salary deduction will continue after maturity date until the outstanding amount is fully paid.
The first payment to the Bank shall be made in accordance to the specified Monthly Due Date
after the proceeds from sales to Broker B, subject to any agreed deduction is deposited into the
account of the Customer and the subsequent monthly payments shall be paid on the
corresponding date of the subsequent months until the Bank’s Sale Price is paid in full.
For PF-i for Civil Sector, the monthly payment shall be made through deduction of salary and
only deemed to have been paid upon receipt of payment by the Bank and not when the deduction
of salary is being made. Without prejudice to this clause, Customer shall be responsible to directly
make payments to the Bank:
a) Until the salary deduction takes effect; and/or
b) If salary deducted is not being received by the Bank due to whatever reasons; and/or
c) If the amount received via the salary deduction is less than the actual monthly payment.
Should there occur any non-payment, insufficient or shortfall in monthly payment for reasons
(including but not limited to) of insufficient fund, the Customer shall immediately pay the monthly
payment or shortfall amount directly to the Bank, upon notification of the same from the Bank.
In the event of accounts still with outstanding balance at the end of financing tenor due to upward
or downward adjustment to the BR, customers are required to make lump sum settlement at the
end of financing tenor. If customers are not able to make full settlement in such event, recovery
process will be initiated on affected accounts, but with continuous monthly salary deduction.

17. Prepayment

Any payment that exceed monthly payment or any prepayment in parts will be deemed to be
advance payment. Such amount of advance payment if sufficient to cover the monthly payment(s)
will extend the next scheduled monthly due date to a later date.

18. Early Settlement

The Customer may at any time make early settlement the whole of the Bank’s Selling Price
subject to rebate (“Ibra’‟), PROVIDED THAT prior written notice of at least one (1) month prior to
the intended date of early settlement is given in advance to the Bank.

19. Compensation (Ta’widh) Payable on the Facility

The Customer is liable to pay the Bank compensation as follows:

(1) for any failure on the Customer’s part to pay the payment due under the Facility from the date
of disbursement until the date of maturity of the Facility, at the rate of one percent (1%) per
annum:
(a) on the overdue amount, in the case of any default of scheduled payments; or

(b) on the outstanding balance of the Facility, in the case of any default causing the Facility to
be terminated or brought to court for judgement prior to the expiry of the Facility;
Compensation Charges = Overdue Amount x 1% (Compensation Rate for Late Payment) x
(No. of Days Overdue/365)
2) for any failure on the Customer’s part to pay any amount due under the Facility and which failure
continues beyond the Tenure of the Facility or after judgement is obtained (whichever is earlier),
at such rate per annum as determined and notified by the Bank from time to time (before as well

as after judgement). The applicable compensation rate will not at any time exceed the prevailing
Bank Negara Malaysia’s Islamic Interbank Money Market Rate on the total outstanding balance
of the Facility calculated on daily rest basis; or
3) by any other method approved by the Shariah Advisory Council of Bank Negara Malaysia.

The amount of such compensation shall not be compounded


The compensation that has been declared shall be paid by the Customer after and before the court
decision or court order.

20. Rebate (Ibra’)

(a) The Bank shall grant rebate (“Ibra”) on any amount payable by the Customer in respect of any
payment due under the Facility in any of the following situations:

(i) any early settlement or early redemption by the Customer including prepayment;

(ii) any settlement of the Facility due to any financing restructuring exercise by the Customer;

(iii) any settlement by the Customer upon occurrence of the Event of Default; and

(iv) any settlement by the Customer in the event of termination or cancellation of the Facility before
the expiry of the Facility period.

(v) If the Facility is based on variable rate, on the difference between the Ceiling Profit Rate and
Effective Profit Rate when the Effective Profit Rate is lower than the Ceiling Profit Rate.

(b) Rebate (Ibra’) = *Remaining Unearned Profit – Early Settlement Charges (if any) as determined
and notified by the Bank.

*Remaining Unearned Profit is equal to unrealized profit at the time of full settlement

(c) The calculation of rebate (Ibra’) shall be made in accordance with any rules, regulations and/
or directives (whether or not having the force of law) required of or imposed upon the Bank from
time to time and at any time by Bank Negara Malaysia or any other authority having jurisdiction
over the Bank.

The rebate (Ibra’) shall only be deemed granted upon receipt of the settlement sum as determined
by the Bank.

21. Appointment of Collection Agent

The Bank has the right to appoint an agent of its choice to collect all and any sums due to the Bank
from the Customer under the Facility by giving prior notice of at least seven (7) calendar days.
22. Fees, Cost and Other Expenses

All charges, legal and professional fees, stamp duties and present and future taxes, which are
payable in connection with the Facility and which are payable not due to the act, omission, default,
negligence and/or misconduct on the part of the Bank and/or any of its employees, representatives
and agents, including service charge, withholding or other deductions whatsoever, and the Bank’s
solicitors fees on a solicitor-client basis, are to be borne and paid by the Customer.

For PF-i for Civil Sector, collection fee of 2% will be charged on the monthly payment. Hence, the
actual total salary deduction amount will be higher than the monthly payment.

23. Information Disclosure

The Bank shall have the right to disclose and obtain any information relating to the Customer,
and/or any person providing security (ies) for the Facility to:

a) Bank Negara Malaysia, the Central Credit Bureau, Cagamas Berhad and such other
authorities as may be authorized by law to obtain such information;
b) its auditors, legal counsel and other professional advisers;
c) Companies which are now or in future may be within the RHB Banking Group;
d) Dishonoured Cheques Information System;
e) pursuant to any subpoena or other legal provisions or in connection with any legal action
suit or proceeding relating to the Facility;
f) pursuant to any law; and
g) any potential assignee, participant in the secondary debt market, novatee of the Bank’s right
in relation to the Customer or other person proposing to enter into any contractual
arrangement which requires the disclosure of such information.
24. Consent Clause

The Customer consents to, and authorizes RHB Banking Group (which shall include the Bank’s
holding company, subsidiaries and associated companies and their respective directors, officers,
employees and agents to disclose, share and/or verify information or documents pertaining to the
Customer, the Customer’s affairs, account(s) and/or facility(ies) to and/or with any of the following
parties including:

(a) any companies within RHB Banking Group, whether within or outside Malaysia, for the purpose
of cross-selling, marketing and promotions of products and/or services of the RHB Banking
Group and/or assisting such companies to assess the Customer’s credit worthiness and/or the
Customer’s eligibility to obtain and/or maintain banking or other credit facilities, except if the
Customer has chosen not to allow RHB Banking Group to make any disclosure under this sub-
clause (a);

(b) any authorities/regulators/parties as may be required or authorised by law or regulations or by


court of law to obtain such information or documents;

(c) any party(ies) providing security for purposes of facility(ies) granted to the Customer, agents of
the RHB Banking Group, including vendors, merchants and/or third party service providers in
connection with any products and/or services being provided by the RHB Banking Group
wherever applicable;

(d) auditors, legal counsels and/or other professional advisers rendering professional services to
the RHB Banking Group in connection with these terms and conditions and/or any action or
proceeding for the recovery of monies due and payable by the Customer, wherever applicable;

(e) Bank Negara Malaysia, Cagamas Berhad, credit bureaus and/or credit reporting agencies,
fraud prevention agencies, debt collection agencies and industry/financial related associations,
as may be required or authorised by law or regulations or by court of law to obtain such
information and documents; and

(f) any potential assignee or other person proposing to enter into any contractual arrangement
with any company within the RHB Banking Group, which requires the disclosure of such
information and documents and such disclosure is to be made on a need-to-know basis.

25. Amendments and/or Additional Terms

(a) The Bank may vary any of the terms and conditions of the Facility and these terms and
conditions by giving notice of such variation to the Customer not less than twenty one (21)
calendar days before the effective date of such variation, provided that such variation is
subject to and is in compliance and in conformity with Shariah principles.
(b) Such notice will state the reason(s) for such variation and such variation will become effective
on the date specified in such notice. On and after the effective date, the variation will be
deemed to have been made and are to be read and construed as having formed part of these
terms and conditions at the time of execution.
(c) Notice of such variation may be effected by:
(i) displaying such notice at the premises of the Bank or its branch offices; or
(ii) mailing such notice to the Customer; or
(iii) sending such notice by SMS or electronic mail to the Customer; or

(iv) posting such notice on the Bank’s website or internet site.

Such notice i s deemed received by or communicated to the Custom er:


(i) in the case of displaying or posting of such notice at the Bank's premises or on the
Bank's website or internet site, as the case may be, on the date of such posting;
(ii) in the case of mailing of such notice, by second (2nd) day after dispatch, unless there is
contrary evidence that such notice was in fact not delivered; or
(iii) in the case of delivery by SMS or electronic mail, at the time such notice is sent by the
Bank to the Customer, unless the Bank has received a delivery error message.

26. Notification on Changes in Employment

(1) For PF-i for Civil Sector:

The Customer must immediately inform the Bank of the following changes in the Customer’s service:

(a) the Customer’s resignation or retirement from the service with the Government of Malaysia
(“Government”);

(b) the Customer’s termination from the service with the Government; or

(c) the Customer’s transfer to another Government’s department;

(d) the Customer’s resignation or transfer into a new company;

(e) if there is any disruption in the monthly auto salary deduction for any reason whatsoever.

For circumstances (a), (b), (d) and (e) above, the Customer agrees to make the monthly payments
(which were previously made via i.Destinasi Sdn. Bhd. (IDSB) and/or Biro Perkhidmatan Angkasa)
directly to the Bank.

(2) For PF-i for Pensioner:

(a) The Customer must immediately inform the Bank if the Customer ceases to be entitled to the
pension for any reasons whatsoever.

(b) In such circumstances the Customer agrees to make the monthly payments directly to the Bank.

(c) Unless due to the act, omission, default, negligence and/or misconduct on the part of the Bank
and/or any of its employees, representatives and agents, the Customer is to fully indemnify the
Bank from and against any expense, loss, damage or liability which the Bank may incur or suffer
under or in connection with any claims, demand or action taken by Jabatan Perkhidmatan Awam
or Jabatan Hal Ehwal Veteran or any other agencies of the Government in relation to, in connection
with or arising from the Facility.

27. Representations and Warranties

The Customer represents and warrants to the Bank that:

(a) the Customer has full legal right, authority, power and capacity to accept the Facility and to
perform his/her obligations in accordance with these terms and conditions;

(b) (i) the Customer is under the service of, and is permanently employed by, the Government
(for PF-i for Civil Sector application) or;
(ii) the Customer is entitled to pensions from Jabatan Perkhidmatan Awam or Jabatan Hal
Ehwal Veteran, as the case may be (for PFi for Pensioner application);

(c) these terms and conditions constitute the legal, valid and binding obligations enforceable
against the Customer in accordance therewith;

(d) all consents, authorisations and approvals which are required or advisable to be obtained in
connection with the acceptance, delivery, legality or enforceability of these terms and
conditions and the use of the Facility have been obtained and are in full force and effect;

(e) no law, regulation, order or decree of any governmental authority, agency or court to which the
Customer is subject is or may be breached, contravened or deemed defaulted due to the
Customer’s acceptance and delivery of the Commodity Trading Approval Letter with these
terms and conditions nor the Customer’s fulfilment of these terms and conditions.;

(f) the Customer is not in default under any agreement to which the Customer is a party or by
which the Customer may be bound and no litigation, arbitration or administrative proceedings
are presently, current or pending or threatened against the Customer;

(g) all information furnished by the Customer to the Bank in connection with the Facility are true
and correct and there has been no omission, which would render the information inaccurate or
misleading; and

(h) the Customer is not a bankrupt and there are no bankruptcy proceedings currently pending or
threatened against the Customer.

28. Conditions Precedent

The Facility will be made available for the Customer’s utilization upon the fulfilment of the
following conditions precedent:

(a) the Customer shall have passed the Bank’s internal credit evaluation and clearance to the
Bank’s satisfaction;

(b) all documents which are required under these terms and conditions and/or such other
documents as may be required by the Bank and/or its solicitors for or in connection with the
Facility having been provided and/or executed by the Customer and, where applicable, duly
stamped and registered at such registries as the Bank may deem necessary or expedient

(c) the Customer having paid all fees or charges payable or agreed to be paid by the Customer
to the Bank for or in connection with the Facility;

(d) Customer is required to open a deposit account and execute a standing instruction
authorizing the Bank to debit Customer’s deposit account towards the payment of the
Monthly Payments and any other payment due under or pursuant to the Facility (for non-
corporate package).

(e) Customer is required to sign an irrevocable letter to the respective Employer as the
instruction to deduct monthly salary and remit the same to the Bank as Monthly Payment
(for corporate package).

(f) Jabatan Perkhidmatan Awam or Jabatan Hal Ehwal Veteran, as the case may be, having
confirmed on the crediting of the Customer’s pension payment into the Customer’s account
maintained with the Bank (for PF-i for Pensioners application);

(g) no Event of Default or no event which with the giving of notice or lapse of time or both would
constitute an Event of Default has occurred or is continuing;

(h) no extraordinary circumstances or change of law or other governmental action has occurred
which makes it improbable that the Customer will be able to observe or perform the
covenants and obligations under the Facility; and

(i) search results on the Customer at the Director-General of Insolvency’s Office are
satisfactory to the Bank.

29. Affirmative Covenant

During the Tenure of the Facility, the Customer will:

(a) punctually pay, discharge or otherwise satisfy at or before maturity or before they become
delinquent, as the case may be, the monthly payment of the Bank’s Selling Price and all of
his/her indebtedness and other obligations of whatever nature;

(b) perform any and all of his/her obligations under the Facility;

(c) take all steps as may be necessary to ensure that there is no material adverse effect on his/her
financial position;

(d) furnish to the Bank all information reasonably required by the Bank in relation to the Customer;
and

(e) notify the Bank of the occurrence of an Event of Default or any event of default in relation to
any of the Customer’s other indebtedness.

30. Event of Default

The full amount of the Bank’s Selling Price and all monies outstanding under the Facility together
with compensation thereon (if any) and all other monies relating thereto will become immediately
due and payable by the Customer upon the occurrence of any of the following events:

(a) the Customer defaults in the monthly payment(s) of the Bank’s Selling Price or in the payment
of any money payable to the Bank after the same shall have become due, whether formally
demanded or not;

(b) the Customer defaults under any other material provision under these terms and conditions
which is not capable of remedy or which, being capable of remedy, is not remedied within
fourteen (14) days after being required to do so by the Bank;

(c) any representation, warranty or condition made or implied by the Customer is incorrect or
misleading in any material respect;

(d) any other event or series of events whether related or not has or have occurred which in the
opinion of the Bank (which opinion shall be final and binding) could or might materially or
adversely affect or prejudice the Customer’s ability or willingness to comply with all or any of
the Customer’s obligations under the Facility;

(e) the Customer commits any act of bankruptcy or becomes bankrupt or dies or becomes insane;

(f) any of the material documents given to the Bank is or becomes for any reason whatsoever
invalid or unenforceable;

(g) if the Bank considers, based on satisfactory evidence, that the Facility or Customer’s position
in relation to the payment of the Facility to be in jeopardy;

(h) the Applicants commits or committed an act of fraud or misconduct; or

(i) all or any part of the Facility is utilised for any non-halal goods or services.

The Bank may arrange under its collection and recovery initiative to visit the Customer at the
Customer’s workplace in the course of collecting outstanding debts or dues when the Customer
becomes uncontactable either by telephone, via face-to-face contact, through other forms of
communication and is not responding to the recovery actions.

31. Bank’s Right to Commence Legal Proceeding Concurrently

Upon the occurrence of an Event of Default, the Bank may exercise all or any of the remedies
available whether by these terms and conditions, by statute or otherwise and may exercise such
remedies concurrently, including pursuing a civil suit to recover all monies due and owing to the
Bank

32. Legal And Incidental Expenses

(a) The Customer is to pay all legal fees and incidental expenses in connection with the
preparation, stamping and registration of any security documents required by the Bank in
connection with the Facility.

(b) If any money payable under the Facility is required to be recovered through any process of law
or placed in the hands of solicitors for collection, the Customer is liable to pay the Bank’s
solicitors’ fees (on a solicitor and client basis) and any other fees and expenses incurred in
respect of such collection.

33. Waiver and Indulgence

These terms and conditions may be waived by the Bank in whole or in part with or without
conditions and without affecting the rights of the Bank under these terms and conditions. Any failure
by the Bank to enforce any of these terms and conditions or any restraint, delay or indulgence
granted by the Bank to the Customer are not to be construed as a waiver of any of the Bank’s
rights under these terms and conditions.

34. Credit Facilities to Connected Parties

(a) The granting of the Facility by the Bank to the Customer is upon the condition that, by doing
so, the Bank will not contravene any applicable laws, legislations or regulations.

(b) The Customer declares to the Bank that:

(i) the Customer is not related to/a guarantor to/in control of/controlled by any of the directors,
controlling shareholders, officers, Shariah Committee of the RHB Banking Group and their
respective close relatives (spouse and dependents of the spouse, child (including
step/adopted child) and spouse of the child, parent and brother or sister and their
spouses);

(ii) none of the directors, controlling shareholders, officers, Shariah Committee of the RHB
Banking Group and their respective close relatives is a director, partner, executive officer,
agent or guarantor in the Customer’s firm/partnership/company/legal entity and/or
subsidiaries/entities controlled by the Customer.

(c) The Customer must notify the Bank if any part of the declaration above is incorrect at any time
throughout the duration of this Facility. If any connected party relationship is established or
discovered subsequently, the Bank may terminate the Facility immediately and the full amount
of the Bank’s Selling Price and all monies outstanding under the Facility together with
compensation thereon (if any) and all other monies relating thereto will become immediately
due and payable by the Customer.

35. Anti-Money Laundering and Anti-Terrorism Financing Proceeds of Unlawful
Activities Act 2001 (Act 613)

During the Tenure of the Facility, the Customer will ensure that he/she has never and will not:

(a) engage, directly or indirectly, in a transaction that involves proceeds of any unlawful activity;

(b) acquire, receive, possess, disguise, transfer, convert, exchange, carry, dispose, use, remove
from or bring into Malaysia proceeds of any unlawful activity; or

(c) conceal, disguise or impede the establishment of the true nature, origin,
location, movement, disposition, title of rights with respect to, or ownership of, proceeds
of any unlawful activity

36. Duty to Verify Statements of Accounts/Certificate of Bank

The Customer must verify all Statements of Accounts sent to the Customer by the Bank and
within 14 calendar days revert to the Bank in the event of any discrepancy in such Statements of
Accounts, failing which they will be deemed to be conclusive and binding against the Customer.
A statement by the Bank and signed by any of its officers as to the amount outstanding will, save
for manifest errors, be final and conclusive on the Customer.

37. Set Off/Combination or Consolidation of Accounts

(a) The Bank may, by giving seven (7) days’ prior written notice to the Customer, combine or
consolidate all or any of the Customer’s accounts and liabilities with and to the RHB Banking
Group up to the principal portion only for non-Islamic account(s) anywhere whether in or
outside Malaysia, whether alone or jointly with any other person and may transfer or set off
any sums in credit in such accounts in or towards settlement of any of the Customer’s
liabilities, whether actual or contingent, primary or collateral, despite that the credit balances
on such accounts and the liabilities on any other accounts may not be expressed in the same
currency and the Bank is authorised to effect any necessary conversions at the Bank’s own
rate of exchange then prevailing.

(b) In addition to the above, the Bank may debit any of the Customer’s accounts (whether in credit
or debit) with the Bank for all payments due and payable by the Customer howsoever to the
Bank by giving seven (7) days’ prior written notice to the Customer together with the reason(s)
for the set-off. However, the seven (7) days prior written notice to the Customer may not be
applicable for Standing Instructions accounts. It is the responsibility of the Customer to ensure
a sufficient balance is maintained in the Standing Instructions account for the purpose of
payment of the debt owed by the Customer.

38. Suspense Account

Any money received by the Bank in respect of the Facility may be kept to the credit of a suspense
account for so long as the Bank thinks fit without any obligation in the meantime to apply the same
or any part thereof on or towards settlement of any liabilities due by the Customer to the Bank.

39. Notices & Service of Legal Process

(a) Any notice, demand, statement or other communication to be given under these terms and
conditions and all other communications between the parties with respect to these terms and
conditions must be in writing and may be given or sent by:

(i) hand;
(ii) ordinary post, certificate of post, registered post or other fast postal service; or
(iii) facsimile or other electronic media,

to the other party and at the addresses or facsimile transmission numbers set out in application
or the last known address of the parties or such other person, addresses or facsimile transmission
numbers as either party may give notice to the other.

(b) In the case of the Bank, all notices, demands, statements or other communication to be given to
the Bank must be addressed to RHB Customer Contact Centre and will only be deemed to have
been received at the time of actual receipt by the Bank.

(c) In the case of the Customer, all notices, demands, statements or other communication to be given
to the Customer is deemed to have been received by the Customer at the times stated below:

(i) by hand, at the date of dispatch;


(ii) by ordinary post, certificate of posting, registered post or other fast postal service, by second
(2nd) day after dispatch, unless there is contrary evidence that such notice, demand, statement
or communication was in fact not delivered;
(iii) by facsimile transmission or other electronic media, at the time of transmission, unless there is
contrary evidence that such notice, demand, statement or communication was in fact not
delivered;
(iv) by SMS, on the day that such notice, demand, statement or communication is sent via SMS,
unless the Bank has received a delivery error message.

(d) Without prejudice to any other forms of service allowed in law, the service of any writ, summons,
statement of claim or any legal process in respect of or arising out of the Facility may be
effected on the Customer by forwarding a copy of the writ, summons, statement of claim or
other legal process by prepaid registered post (or such other mode as stipulated by law) to the
Customer’s address stated in application or to the last known address of the Customer.

(e) In proving the giving of such notices, demands, statements or other communication it will be
sufficient to show:

(i) in the case of delivery by hand, acknowledgement of receipt by the addressee; or


(ii) in the case of delivery by ordinary post, registered post or other fast postal service, that the
notices, demands, statements or other communication has been duly addressed and posted,
unless there is contrary evidence that such notice, demand, statement or communication was
in fact not delivered; or
(iii) in the case of delivery by certificate of posting, the acknowledgement issued by or at the post
office that the notices, demands, s tat em en ts or other communication has been duly
posted, unless there is contrary evidence that such notice, demand, statement or
communication was in fact not delivered; or
(iv) in the case of delivery by facsimile transmission or other electronic media (including SMS), no
delivery error message is received.

(g) No change in the address for service will be effective or binding on either party unless that party
has given to the actual notice of the change of address for service. Nothing done in reliance of
this Clause 39 will be affected or prejudiced by any subsequent change in the address for service,
of which the other party has no actual knowledge of at the time the act or thing was done or
carried out.

(h) All notices, claims, statements, or other communications must be in English or Bahasa Malaysia.

(i) Despite the above, the Customer authorises the Bank to rely upon and act on any instruction,
notice or communication from the Customer made by telephone, facsimile or SMS to the Bank and
the Customer is to indemnify and release and hold the Bank harmless against all actions, suits,
proceedings, costs, claims, demands, charges, expenses, losses and liabilities (unless due to the
act, omission, default, negligence and/or misconduct on the part of the Bank and/or any of its
employees, representatives and agents) in consequence of, or in any way related to the Bank
having relied upon or acted in good faith in accordance with the Customer's telephone, facsimile
or SMS instruction, notice or communication.

40. Under Foreign Exchange Notices:

40.1 RHB Banking Group (“Bank”) has the right to suspend my application without the approval
letter from BNM if my allowable utilized amount has exceeded the stipulated aggregate
threshold per calendar year.

40.2 Resident refers to:


i. A citizen of Malaysia, excluding a citizen who has obtained permanent resident
status in a country or a territory outside Malaysia and is residing outside Malaysia;
ii. A non-citizen of Malaysia who has obtained permanent resident status in Malaysia
and is ordinarily residing in Malaysia; \
iii. A body corporate incorporated or established, or registered with or approved by any
authority, in Malaysia;
iv. An unincorporated body registered with or approved by any authority in Malaysia;
or
v. The Government or any State Government

40.3 Domestic Ringgit borrowing/financing refers to:


Any borrowing/financing in Ringgit obtained by a resident from another resident (including
individuals, corporations and financial institutions) in the form of credit facility, financing
facility, trade guarantee or guarantee for payment of goods, redeemable preference share,
Islamic redeemable preference share, corporate bond or sukuk other than:
i. Trade credit terms extended by a supplier for all types of good or services;
ii. Forward contract with a licensed onshore bank excluding a contract that involves
the exchanging or swapping of Ringgit or foreign currency debt obligation with
another foreign currency debt obligation or the exchanging or swapping of foreign
currency debt obligation with a Ringgit debt obligation;
iii. Performance guarantee or financial guarantee;
iv. Operational leasing facility;
v. Factoring facility without recourse;
vi. A credit facility or financing facility obtained by a resident individual from a resident
to purchase one residential property and one vehicle; or
vii. Credit card and charge card facility obtained by a resident individual from a
resident.

Domestic Ringgit borrowing/financing’ above shall also exclude the borrowing/financing in


Ringgit of a resident entity from another resident entity within its group of entities with
parent-subsidiary relationship, the borrowing/financing obtained from its direct
shareholder, and any facility including credit facility or financing facility which is used for
sundry expenses or employee' expenses only

40.4 In the event there are changes to the circumstances and/or details contained in this
declaration and undertaking, the Customer is to update the Bank of the changes
immediately, failing which the Bank may proceed to take any actions that the Bank deems
fit with further notice.

41. Independent Legal/Shariah Advice and Reference to Shariah Advisory Council of Bank
Negara (“SAC”)

The Customer is responsible for assessing the terms in these Terms and Conditions and shall seek
own independent legal and/or Shariah advice. The Customer also agrees that the Facility granted
or to be granted to the Customer are in conformity with the Shariah principles stated in these Terms
and Conditions and confirm that it would not have and will not raise, any objections as to matters
of Shariah compliance in respect of the Facility. In the event any Shariah compliance related issue
or objection is raised, the parties agree to refer such issues or objections to SAC for a ruling which
decision (in respect of such Shariah compliance related issues or objections) will be final and
binding against the parties.

RHB MERDEKA CAMPAIGN FOR PF/-i PRODUCTS

1. RHB Bank Berhad (Registration No.: 196501000373 (6171-M) and RHB Islamic Bank Berhad
(Registration No.: 200501003283 (680329-V); both, collectively will be referred to as “RHB”, unless
stated otherwise, are organizing RHB Merdeka Campaign for PF/-i Products 2021 (“the
Campaign”), which commences from 1st July 2021 to 30th Sept 2021 (both dates inclusive) (“the
Campaign Period”).

ELIGIBILITY

2. This Campaign is only open to RHB Personal Financing/-i (PF/-i) new and existing customers who
applies for PF/-i during the Campaign Period based on the mechanics and criteria set out herein
(“Eligible Persons” or each, an “Eligible Person”).

3. The following persons are NOT eligible to participate in the Campaign:-

a. Permanent and/or contract employees of RHB Banking Group, including their respective
immediate family members, meaning parents, spouses, children and siblings;
b. Any person(s) or customer(s) who is (are) in default of Personal Financing or Personal
Financing-i facilities granted by RHB at any time during the Campaign Period, subject to RHB’s
discretion;
c. Any RHB customer who has committed or suspected to have committed any fraudulent or
wrongful acts in relation to his/her RHB Personal Financing/-i facility.

4. All Eligible Person must abide by the Terms and Conditions imposed and shall not be entitled to
any claims or compensation against RHB for any losses or damages suffered or incurred by the
eligible customers as a result of any alteration, modification or extension from the Campaign.

GENERAL TERMS & CONDITIONS

8. By participating in the Campaign, the Eligible Person (s):-

i. Agrees to be bound by the Terms and Conditions of the Campaign;

ii. Agrees to access RHB’s Website to view the Terms and Conditions and undertakes to be kept
up-to-date on any change or variation to the Terms and Conditions;

iii. Agrees that RHB’s decision on all matters relating to the Campaign, shall be final, conclusive and
binding against them. If there is any further dispute, please refer to RHB Contact Centre at 03-
9206 8118 or the Ombudsman for Financial Services (OFS);

iv. Agrees to discontinue any further participation in this Campaign by informing RHB if any future
modifications of these Terms and Conditions are unacceptable;

v. Agrees that by providing the personal information, the Eligible Person (s) consents to RHB
processing their personal information for any and/or all of the following purposes (“Purpose”),
if applicable:

a. Administering this Campaign and contacting the Eligible Person (s) in relation to the same;
b. Cross-selling, marketing and promotions of products and/or services of RHB and its strategic
alliances; or
c. Other related and legitimate business purposes.

vi. Agrees that the Eligible Person (s) personal information may be disclosed to other companies
within the RHB (which shall include its holding company, subsidiary(s), and any associated
company(s), including any company as a result of any restructuring, merger, sale or acquisition),
service providers, and vendors and any of their respective agents, servants and/or such persons,
whether located within or outside Malaysia for the Purpose, if applicable, subject at all times to
any laws (including regulations, standards, guidelines and/or obligations) applicable to RHB; and

vii. Agrees that it is necessary for RHB to process the Eligible Person (s) personal information for
the Purpose, without which the Eligible Person (s) will not be able to participate in this
Campaign. The Eligible Person (s) may exercise their options in respect of receiving marketing
materials (including cross selling, marketing and promotions as described above) by contacting
us on the contact provided below.

viii. May request for correction (if their personal information is inaccurate, out-dated, incomplete,
etc.), access to (a prescribed fee may be charged), or deletion (if the Eligible Person no longer
have any existing products/services with RHB Banking Group) of the Eligible Person personal
information or limit the processing thereof at any time hereafter by submitting such request via

ix. RHB reserves its right to:-

a. Disqualify any and all entries from any Eligible Person (s) in the Campaign and prohibit that
person from further participating in the Campaign in the event that there is suspicion that the
Eligible Person (s) tampered with or benefited from the tampering of the regulations of the
Campaign or the Terms and Conditions stated herein;

b. Cancel, terminate or suspend the Campaign with sufficient prior notice. Any cancellation,
termination or suspension of the Campaign by RHB shall not entitle the Eligible Person (s) to
any claim or compensation against RHB for any loss or damage incurred by the Eligible Person
(s)as a direct and indirect result of such cancellation, termination or suspension;

c. Add, delete, suspend or vary the Terms and Conditions contained herein, either wholly or in
part at its discretion by way of posting on RHB website and/or other means of communication
that may be deemed appropriate by RHB with sufficient prior notice.

x. RHB shall not be liable for any default in respect of the Campaign due any act of God, war (whether
declared or undeclared), strike, riot, civil commotion, and act of terrorists which are not
attributable to the act, omission, default, negligence and/or misconduct on the part of RHB and/or
any of its employees, representatives and agents.

xi. In the event of any inconsistency between these Terms and Conditions and any other brochure,
marketing or promotional materials relating to the Campaign, these Terms and Conditions shall
prevail.
