akan menjawab secara tertulis terhadap setiap permintaan untuk klarifikasi
sepanjang permintaan tersebut diterima dalam jangka waktu pemberian penjelasan
yang disebutkan di jadual SPSE 4.3. Pokja akan membagikan jawaban klarifikasi
kepada semua peserta melalui SPSE 4.3.
Selain itu, permintaan untuk klarifikasi dapat diajukan pada saat rapat penjelasan
sesuai jadual yang tertera di bawah ini (LDP 7.4). Pokja akan mengunduh berita
acara rapat penjelasan melalui SPSE 4.3. Surat undangan rapat penjelasan dapat
ditemukan di bagian “informasi tambahan” di SPSE 4.3

Local Drinking Water Construction Implementing Services (Code SI
008) Non-Small Business Qualification with Sub-Qualification Grade
M2;
b) ISO 9001:2015 Certificate (Quality Management System);
c) OHSAS 18001 Certificate or SMK3 Certificate;
d) ISO 14001:2015 Certificate (Environment Management System
Standard);
e) A valid of NPWP (Tax ID Number) and annual tax report of 2019 year,
f) Notarial deed of company establishment (include revisions, if any);
g) In case of a Joint Venture, a letter of intent to form a Joint Venture or
Joint Venture agreement;
h) Document to support qualification evaluation such as Audited financial
statements of 2015 to 2019, the evidence sheet of experience the contracts
of similar size and nature, the evidence sheet of experience the
construction experience in Key Activities.
And for the Foreign Bidders shall submit with its Bids the following additional
documents:
a) ISO 9001:2015 Certificate (Quality Management System);
b) OHSAS 18001 Certificate or Occupational Health and Safety
Management System; or SMK3 Certificate
c) ISO 14001:2015 Certificate (Environment Management System
Standard);
d) Proof of country of incorporation wherein the firm is registered;

For foreign applicant, the following documents are not required to submit along
with the bids, but to be submitted prior to contract signing if the bidder is
declared to be the winner:
e) Proof of Foreign Construction Service Representative License submitted
no later than 14 (fourteen) calendar days since the Letter of Acceptance
of the Goods/Service Provider (SPPBJ) and prior to the contract signing.
In case the Foreign Construction Services Business Enterprise who is
selected as the winner fail to submit proof of Foreign Construction
Service Representative License before the deadline specified, then the
Foreign Construction Service Business Enterprise may be canceled as the
winner of the tender;
f) Foreign Construction Services Business Enterprise is strongly encouraged
to conduct business cooperation with national companies in the form of
partnerships, subcontracts and others in case the national companies have
the capability in the field concerned. If there is a cooperation, the proof of
business cooperation with the national company shall be submitted no
later than 14 (fourteen) calendar days since the Letter of Acceptance of
the Supplier / Service Provider (SPPBJ) and prior to the signing of the
contract.
Untuk peserta asing, dokumen berikut tidak harus disampaikan bersamaan dengan

diserahkan paling lambat 14 (empat belas) hari kalender sejak
dikeluarkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dan
sebelum penandatangan kontrak, Apabila Badan Usaha Jasa Konstruksi
Asing yang ditunjuk sebagai pemenang tidak dapat menyerahkan bukti
Ijin Perwakilan Jasa Konstruksi Asing sebelum batas waktu yang
ditentukan maka Badan Usaha Jasa Konstruksi Asing tersebut dapat

Subject to the succeeding sentences, any bid not accompanied by an irrevocable
and callable bid-security shall be rejected by the Employer (The Working Unit) as
nonresponsive. If a Bidder submits a bid security that (i) deviates in form, amount,
and/or period of validity, or (ii) does not provide sufficient identification of the
Bidder (including, without limitation, failure to indicate the name of the Joint
Venture or, where the Joint Venture has not yet been constituted, the names of all
future Joint Venture Partners), the Working Unit shall request the Bidder to submit
a compliant bid security within 7 days of receiving such a request (This request
will be issued by the Working Unit only if the original Bid Security has been
received by the Working Unit before the deadline for bid submission). Failure to
provide a compliant bid security within the prescribed period of receiving such a
request shall cause the rejection of the Bid.

Scanned copy of the bid security must be included in the bid delivered through
SPSE 4.3. If there is discrepancy between scanned copy and the original bid
security, the original governs.

ITB 20.2 The written confirmation of authorization to sign on behalf of the Bidder shall
consist of/in the form of: An organizational document, board resolution or its
equivalent, or power of attorney specifying the representative’s authority to sign
the Application on behalf of, and to legally bind, the Applicant. If the Applicant is
an intended or an existing Joint Venture, the power of attorney should be signed
by all partners and specify the authority of the named representative of the Joint
Venture to sign on behalf of, and legally bind, the intended or existing Joint
Venture. If the Joint Venture has not yet been formed, also include evidence from
all proposed Joint Venture partners of their intent to enter into a Joint Venture in
the event of a contract award.
IKP 20.2
Surat kuasa untuk bertanda tangan atas nama Peserta harus mencantumkan/berupa
: Dokumen resmi perusahaan, keputusan Dewan (Dewan Komisaris/Direksi) atau
yang setara, atau surat kuasa yang menentukan wewenang perwakilan untuk
menandatangani Aplikasi atas nama, dan mengikat secara hukum, Peserta. Jika
Peserta adalah Joint Venture yang direncanakan atau yang sudah ada, surat kuasa
harus ditandatangani oleh semua mitra dan menyebutkan wewenang perwakilan
dari Joint Venture untuk menandatangani atas nama, dan mengikat secara hukum,
Joint Venture. Jika Joint Venture belum terbentuk, sertakan juga bukti dari semua
mitra Joint Venture yang diusulkan mengenai niat mereka untuk melakukan Joint
Venture jika mereka terpilih menjadi pemenang kontrak.
ITB 20.2 The Bidder shall submit an acceptable authorization within 7 (Seven) days.

the Bid Document is in accordance with the instructions for using the SPSE
application on the LPSE website. The bidders are invited although it is not
mandatory for bidder to attend the bid opening. After downloading the submitted
bids, the procurement committee will prepare the minute of bid opening to be
signed by the committee and the bidders who attend it.

ITB 34.1 The Employer does not intend for the contractor to execute any specific elements
of the Works through nominated subcontractors.

ITB 40.1 Standstill provisions shall apply. The duration of standstill period will be 5 (five)
calendar days from the date of notice of intention for award of contract.
The Employer shall, at the start of the standstill period, notify in writing each
Bidder that submitted a bid, of its intention to award a contract to the successful
Bidder at the end of standstill period. The notification using the form included in
Section 9 (Contract Forms) shall include the following information:

ITB 43.2 Within 28 days of receipt of notification of award from the Employer or any
extended date as advised by the Employer’s notification to the winning Bidder,

performance security form included in Section 9 (Contract Form), or another form
acceptable to the Employer.
