Motif atau alasan yang mendasari Ferdy Sambo membunuh Nofriansyah Yosua Hutabarat alias
Brigadir J masih menjadi misteri setelah majelis hakim Pengadilan Negeri (PN) Jakarta Selatan
menjatuhkan vonis hukuman pidana mati kepada bekas inspektur jenderal Polri itu, Senin (13/2).
Ketua majelis hakim Wahyu Iman Santoso menyatakan motif pembunuhan Yosua tidak terkait
dengan kekerasan seksual yang dialami Putri Candrawathi, istri Ferdy Sambo.
Kesimpulan itu diketahui berdasarkan pemeriksaan dalam persidangan yang telah bergulir sejak
Oktober tahun lalu.
"Berdasarkan uraian pertimbangan tersebut di atas, dengan demikian motif adanya kekerasan
seksual yang dilakukan oleh korban Nofriansyah Yosua Hutabarat terhadap Putri Candrawathi tidak
dapat dibuktikan menurut hukum," ungkap hakim Wahyu saat membacakan pertimbangan perkara
Ferdy Sambo, PN Jakarta Selatan, Senin (13/2).
Menurut hakim, motif pembunuhan tersebut lebih karena ada perasaan sakit hati Putri terhadap
perbuatan atau sikap Yosua. Namun, hakim tidak mengungkapkan gamblang perbuatan Yosua
dimaksud.
"Sehingga motif yang lebih tepat menurut majelis hakim adanya perbuatan atau sikap korban
Nofriansyah Yosua Hutabarat, di mana perbuatan atau sikap korban Nofriansyah Yosua Hutabarat
tersebut yang menimbulkan perasaan sakit hati yang begitu mendalam terhadap Putri Candrawathi,"
kata hakim.
Dalam persidangan, hakim mengungkapkan tidak ada bukti valid mengenai pelecehan atau
kekerasan seksual yang dilakukan Yosua terhadap Putri.
Relasi kuasa menjadi pertimbangan hakim dalam perkara ini. Hakim mengacu pada Peraturan
Mahkamah Agung (Perma) Nomor 3 Tahun 2017 tentang Pedoman Mengadili Perkara Perempuan
yang Berhadapan dengan Hukum.
Dalam kondisi ini, menurut hakim, Putri memiliki posisi dominan dibandingkan Yosua karena yang
bersangkutan merupakan istri dari seorang jenderal polisi bintang dua dan berlatar belakang
pendidikan dokter.
Sementara Yosua hanya lulusan SLTA dan berpangkat Brigadir yang ditugaskan sebagai ajudan
Sambo untuk membantu Putri baik sebagai sopir maupun tugas lain.
"Sehingga dengan adanya ketergantungan relasi kuasa dimaksud sangat kecil kemungkinannya
kalau korban Nofriansyah Yosua Hutabarat melakukan pelecehan seksual atau kekerasan seksual
terhadap Putri," tutur hakim.
Terlebih, hakim menilai tidak ada fakta yang mendukung Putri mengalami gangguan stres pasca-
trauma atau post traumatic stress disorder akibat pelecehan seksual atau perkosaan. Hakim juga
menyoroti proses pemulihan korban pelecehan atau kekerasan seksual yang seharusnya butuh waktu
lama.
Tindakan Putri bertemu dengan Yosua sesaat setelah pengakuan kekerasan seksual terjadi menurut
hakim tidak masuk akal.
"Bahwa dari pengertian gangguan stres pasca-trauma atau post traumatic stress disorder dan
tahapan proses pemulihan korban kekerasan seksual di atas, perilaku Putri yang mengaku sebagai
korban justru bertentangan dengan profil korban menuju pemulihan," pungkas hakim.
Pembunuhan terhadap Yosua terjadi pada Jumat, 8 Juli 2022 di rumah dinas Sambo nomor 46 di
Kompleks Polri, Duren Tiga, Jakarta Selatan.
Sambo divonis dengan pidana mati karena dinilai terbukti melakukan pembunuhan berencana dan
tanpa hak melakukan perbuatan yang menyebabkan sistem elektronik tidak berfungsi sebagaimana
mestinya.
Sambo dinilai terbukti melanggar Pasal 340 KUHP jo Pasal 55 ayat 1 ke-1 KUHP dan Pasal 49 jo
Pasal 33 UU ITE jo Pasal 55 ayat 1 ke-1 KUHP.

Sedangkan Putri divonis penjara 20 tahun dan dinilai terbukti secara sah dan meyakinkan bersalah
turut serta melakukan pembunuhan berencana terhadap Yosua sebagaimana diatur dan diancam
dalam Pasal 340 KUHP jo Pasal 55 ayat 1 ke-1 KUHP.
Putusan tersebut dijatuhkan oleh ketua majelis hakim Wahyu Iman Santoso dengan anggota Morgan
Simanjuntak dan Alimin Ribut Sudjono.
Sambo dan Putri bakal memanfaatkan waktu tujuh hari untuk pikir-pikir mengajukan banding.

The motives or reasons underlying Ferdy Sambo's murder of Nofriansyah Yosua Hutabarat alias
Brigadier J are still a mystery after the panel of judges at the South Jakarta District Court sentenced
the former inspector general of the National Police to death penalty, Monday (13/2) ).
The chairman of the panel of judges, Wahyu Iman Santoso, stated that the motive for killing Yosua
was not related to the sexual violence experienced by Putri Candrawathi, Ferdy Sambo's wife.
This conclusion is known based on examination in the trial that has been rolling since October last
year.
"Based on the description of the considerations above, thus the motive for the sexual violence
committed by the victim Nofriansyah Yosua Hutabarat against Princess Candrawathi cannot be
proven according to law," said judge Wahyu when reading out the considerations in the case of
Ferdy Sambo, South Jakarta District Court, Monday (13/2 ).
According to the judge, the motive for the murder was more because Putri had hurt feelings about
Joshua's actions or attitude. However, the judge did not clearly reveal what Joshua's actions meant.
"So that the more appropriate motive according to the panel of judges was the actions or attitudes
of the victim Nofriansyah Yosua Hutabarat, where the actions or attitudes of the victim Nofriansyah
Yosua Hutabarat caused such deep feelings of hurt towards Princess Candrawathi," said the judge.
During the trial, the judge stated that there was no valid evidence regarding the sexual harassment
or violence committed by Yosua against Putri.
Power relations are the judge's consideration in this case. The judge referred to Supreme Court
Regulation (Perma) Number 3 of 2017 concerning Guidelines for Trying Cases of Women in
Conflict with the Law.
In this condition, according to the judge, Putri has a dominant position compared to Joshua because
she is the wife of a two-star police general and has a medical background.
While Yosua only graduated from high school and held the rank of Brigadier who was assigned as
Sambo's adjutant to help Putri both as a driver and in other tasks.
"So with the dependence on power relations referred to it is very unlikely that the victim
Nofriansyah Yosua Hutabarat committed sexual harassment or sexual violence against Putri," said
the judge.
Moreover, the judge considered that there were no facts that supported Putri having post-traumatic
stress disorder due to sexual harassment or rape. The judge also highlighted the recovery process
for victims of sexual harassment or violence, which should take a long time.
According to the judge, Putri's action to meet with Yosua immediately after the confession of
sexual violence took place was unreasonable.
"That from the understanding of post-traumatic stress disorder and the stages of the recovery
process for victims of sexual violence above, Putri's behavior who claims to be a victim is contrary
to the victim's profile towards recovery," concluded the judge.
The murder of Yosua occurred on Friday, 8 July 2022 at the Sambo official residence number 46 at
the Police Complex, Duren Tiga, South Jakarta.
Sambo was sentenced to death because he was found guilty of premeditated murder and without
the right to commit an act that caused the electronic system to not function properly.
Sambo is considered proven guilty of violating Article 340 of the Criminal Code in conjunction
with Article 55 paragraph 1 1st of the Criminal Code and Article 49 in conjunction with Article 33
of the ITE Law in conjunction with Article 55 paragraph 1 of the 1st Criminal Code.
Meanwhile, Putri was sentenced to 20 years in prison and considered legally and convincingly
proven guilty of participating in the premeditated murder of Yosua as stipulated and threatened in
Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 1 of the Criminal
Code.
The decision was handed down by the chairman of the panel of judges Wahyu Iman Santoso with
members Morgan Simanjuntak and Alimin Ribut Sudjono.
Sambo and Putri will take seven days to consider filing an appeal.
