Beberapa prinsip yang harus diperhatikan dalam asas ini :

• Ketentuan yang didapati dalam aturan hukum tetap berlaku kecuali

yang diatur khusus dalam aturan hukum khusus tersebut

• Ketentuan-ketentuan lex specialis harus sederajat dengan ketentuan-

ketentuan lex generalis (undang-undang dengan undang-undang);

• Ketentuan-ketentuan lex specialis harus berada dalam lingkungan

hukum (rezim) yang sama dengan lex generalis. Kitab Undang-
Undang Hukum Dagang dan Kitab Undang-Undang Hukum Perdata
sama-sama termasuk lingkungan hukum keperdataan
LEX POSTERIOR DEROGAT LEGI PRIORI

• Peraturan yang sederajat, peraturan yang paling

baru melumpuhkan peraturan yang lama

• Peraturan yang telah diganti dengan peraturan

yang baru, secara otomatis dengan asas ini
peraturan yang lama tidak berlaku lagi.

Tiada suatu peristiwa dapat dipidana selain dari kekuatan ketentuan

Asas legalitas yang mengandung tiga pengertian, yaitu:

digunakan analogi
• Aturan-aturan hukum pidana tidak berlaku surut
