PENDAHULUAN
 LATAR BELAKANG
Kesehatan merupakan hak asasi manusia, dimana dalam Pasal 25 Deklarasi Umum Hak Asasi
Manusia Perserikatan Bangsa-Bangsa menyatakan setiap orang berhak atas taraf hidup yang
memadai untuk kesehatan dan kesejahteraan diri serta keluarganya.
Menurut Undang-Undang Kesehatan No. 36 Tahun 2009 Bab III tentang Hak dan Kewajiban Pasien dalam
Pasal 8 menyatakan bahwa pasien mempunyai hak untuk memperoleh informasi tentang data kesehatan
dirinya termasuk tindakan dan pengobatan yang akan diterima maupun yang telah diterima oleh pasien dari
tenaga kesehatan merupakan salah satu kebutuhan yang perlu diketahui oleh pasien. Sesuai dengan Pasal
45 Undang-Undang Praktek Kedokteran No. 24 Tahun 2004 tentang Praktek Kedokteran memberikan
batasan minimal informasi yang selayaknya diberikan kepada pasien mengenai diagnosis dan tata cara
tindakan medis, tujuan tindakan medis yang dilakukan, alternatif tindakan lain dan resikonya, resiko
komplikasi yang mungkin terjadi dan prognosis terhadap tindakan yang dilakukan.a
TINJAUAN TEORI
 2.1 PENGERTIAN HAK
DAN KEWAJIBAN
A. Pengertian Hak
Banyak literature yang mendefiniskan hak asasi sebagai hak-hak dasar yang
dibawa manusia sejak lahir sebagai anugerah dari Tuhan Yang Maha Kuasa.
Definisi itu kurang tepat muncul pertanyaan penting. Hak adalah sesuatu yg
benar: kepunyaan, milik, kewenangan, kekuasaan untuk melakukan sesuatu
karena telah ditentukan oleh UU atau peraturan lain. Kekuasaan yang benar
untuk men-untut sesuatu atau kekuasaan yg benar atas sesuatu (Kamus Hukum,
1992: 154). Menurut Prof. Dr. Notonagoro, hak adalah kuasa untuk menerima
atau melakukan sesuatu yg semestinya diterima atau dilakukan semata-mata
oleh pihak tertentu dan tidak dapat dilakukan oleh pihak manapun juga yang pada
prinsipnya dapat dituntut secara paksa olehnya.
 B. Pengertian kewajiban

“
Kewajiban adalah sesuatu yg diwajibkan sesuatu yg harus dilaksanakan,
keharusan, pekerjaan (KBBI). UU RI No 39 Tahun 1999 Pasal 1 menyebutkan:
“HAM adalah seperangkat hak yang melekat pada hakikat dan keberadaan
“
manusia sebagai makhluk Tuhan Yang Maha Esa dan merupakan anugerah-Nya
yang wajib dihormati, dijunjung tinggi dan dilindungi oleh negara, hokum dan
Pemerintahaan, dan setiap orang demi kehormatan serta perlindungan harkat dan
martabat manusia.”
 Pengertian Pasien
Menurut Peraturan Menteri Kesehatan Republik Indonesia Nomor
269/Menkes/Per/III/2008 Pasien adalah setiap orang yang melakukan
konsultasi masalah kesehatan untuk memperoleh pelayanan kesehatan
yang diperlukan baik secara langsung maupun tidak langsung kepada
dokter atau dokter gigi.
Pasien adalah orang yang memiliki kelemahan fisik atau mentalnya
menyerahkan pengawasan dan perawatannya, menerima dan mengikuti
pengobatan yang ditetapkan oleh tenaga kesehatan yang dikemukakan
oleh Prabowo (dalam Wilhamda, 2011).
Sedangkan (Aditama, 2002) berpendapat bahwa pasien adalah
mereka yang diobati dirumah sakit. Menurut (Soejadi, 1996) pasien
adalah individu terpenting dirumah sakit. Berdasarkan pendapat dari
para ahli diatas dapat disimpulkan bahwa pasien adalah orang yang
memiliki kelemahan fisik atau mentalnya menyerahkan pengawasan dan
perawatannya, menerima dan mengikuti pengobatan yang ditetapkan

Pengertian
Perawat
Perawat (nurse) berasal dari bahasa latin yaitu kata nutrix yang berarti merawat atau memelihara. Menurut
Kusnanto (2003), perawat adalah seseorang (seorang profesional) yang mempunyai kemampuan, tanggung jawab
dan kewenangan melaksanakan pelayanan/asuhan keperawatan pada berbagai jenjang pelayanan keperawatan.
Wardhono (1998) mendefinisikan perawat adalah orang yang telah menyelesaikan pendidikan professional
keperawatan, dan diberi kewenangan untuk melaksanakan peran serta fungsinya. Perawat adalah suatu profesi
yang mempunyai fungsi autonomi yang didefinisikan sebagai fungsi profesional keperawatan. Fungsi profesional
yaitu membantu mengenali dan menemukan kebutuhan pasien yang bersifat segera. Itu merupakan tanggung
jawab perawat untuk mengetahui kebutuhan pasien dan membantu memenuhinya. Dalam teorinya tentang
disiplin proses keperawatan mengandung elemen dasar, yaitu perilaku pasien, reaksi perawat dan tindakan
perawatan yang dirancang untuk kebaikan pasien (Suwignyo, 2007). Perawat adalah seorang yang memiliki
kemampuan dan kewenangan melakukan tindakan keperawatan berdasarkan ilmu yang dimilikinya yang

Rumah Sakit menurut Peraturan Menteri Kesehatan Republik Indonesia
No.5/Menkes/pos15/2005 adalah, “Rumah Sakit adalah suatu sarana upaya
kesehatan dari pemerintah maupun swasta yang menyelenggarakan kegiatan
pelayanan kesehatan serta dapat dimanfaatkan untuk pendidikan tenaga

Jenazah Perawat Covid-19 Ditolak Warga, Di Tempat Pemakaman
Ketiga Baru Bisa Dikebumikan

Kembali terjadi penolakan warga terhadap pemakaman jenazah, kali ini

jenazah diketahui merupakan seorang perawat yang sebelumnya menangani
pasien Covid-19. Perawat berinisial NK dikabarkan meninggal dunia di RSUP Dr.
Kariadi Semarang, Jawa Tengah, Kamis (9/4/20) kemarin pukul 12.25. Awalnya,
jenazah perawat itu berencana dimakamkan di Tempat Pemakaman Umum
(TPU) Siwarak, lingkungan Sewakul, Kelurahan Bandarjo, Kecamatan Ungaran
Barat, sesuai dengan permintaan pihak keluarga. Namun, proses pemakaman
tersebut harus dialihkan karena ada penolakan dari sekelompok warga setempat,
sebelum jenazah tiba di lokasi TPU Siwarak.
Pada video yang beredar di sosial media Facebook, terlihat suasanya di mana
adanya penolakan warga hingga mengakibatkan mobil ambulans yang
mengangkut jenazah kembali membawa jenazah NK. Hal itu juga disampaikan
oleh Ketua Umum Dewan Pengurus Pusat (DPP) Persatuan Perawat Nasional
Indonesia (PPNI) Harif Fadhillah.
“Terpaksa jenazah perawat NK dikembalikan ke kamar jenazah RSUP Dr. Kariadi,”
kata Fadhillah, Jumat (10/4/2020), seperti dikutip dari Tirto.id. Sementara itu, video
lainnya, memperlihatkan seorang wanita yang memohon sambil menangis di depan
para warga. Kedua video itu diunggah oleh akun Facebook Mukidi. Berikut
keterangan yang tertulis sebagai pelengkap video tersebut.
“Dan terjadi lagi, penolakan warga terhadap jenazah perawat yang menangani
COVID-19 di RSUP Kariadi, Semarang!
Lokasi: Sukuwakul, Ungaran.” seperti dikutip dari Facebook.
Berdasarkan informasi yang disampaikan oleh Harif Fadhillah, NK akhirnya
dimakamkan pada Kamis malam di tempat pemakaman lain.
“Dimakamamkan di tempat pemakaman ketiga, yaitu pemakaman keluarga pegawai
RS Kariadi semarang,” ujarnya. Fadhillah berkata proses perawatan dan
pemulasaran jenazah NK telah sesuai dengan protokol penanganan jenazah Covid-
19. Setelah ditelusuri lebih lanjut, kabar ini kian beredar di sosial media Twitter,
yang mana akun @teguhrasyid membagikan cuitan berikut.
“Baru denger dari teman yang residen semarang ada perawat karyadi yang meninggal
karena covid19 gak diterima dimakaman di pemakaman mana-mana. Akhirnya
dimakamin di pemakaman belakang Karyadi, dan lubang makamnya yang gali temen-
temen perawat sendiri. Sinting.” tulis Teguh. Cuitan yang telah dibagikan sebanyak
881 kali itu juga mencuri perhatian warganet lainnya. Bahkan, ada yang
menambahkan perihal kabar peristiwa tersebut.
“Iya, yg gali termasuk suaminya sendiri. Suaminya sekarang di RS Kariadi terus
garagara ditolak warga. Padahal masih punya 2 anak kecil.” tulis
@kfajarkurniawan.
“Ini suaminya juga bekerja di RS Kariadi.” tambah fajar.
Naas, ketika seharusnya jenazah Covid-19 segera dimakamkan, tetapi jadi
tertunda akibat kelakuan warga. Mengingat peristiwa serupa tidak hanya terjadi
kali ini saja, maka, terkait hal ini pemerintah seharunya ikut serta mengambil
langkah tegas agar kasus demikian tak lagi terjadi.
