Pengertian Hukum Acara Pidana
Membahas masalah hukum acara pidana, pertama kali perlu dijelaskan pengertian hukum acara pidana itu sendiri.
Bagan di bawah ini, sebagaimana ditulis oleh H. Tresna dalam buku 'Azas-Azas Hukum Pidana", menunjukkan pembagian
hukum pidana pada umumnya.
1. Materiil, mengandung peraturan-peraturan tentang:
a. Perbuatan yang dapat dipidana;
b. Siapa yang dapat dipidana;
c. Pidana apa yang dapat dijatuhkan terhadap pelanggar undang
2. Formil, mengandung sejumlah peraturan yang mengandung cara negara
mempergunakan haknya melaksanakan pidana.

Secara singkat, pengertian hukum acara pidana:

1. Dalam arti sempit mengandung suatu pengertian bahwa apabila ada pelanggaran
hukum pidana materiil, maka hukum acara pidana berlaku atau berfungsi.
2. Hukum acara pidana dalam pengertian luas, merupakan ketentuan-ketentuan yang
digunakan untuk mencari dan mendapatkan kebenaran yang selengkap lengkapnya.
Berarti juga, walaupun belum atau bahkan tidak ada pelanggaran terhadap hukum
pidana materiil, hukum acara pidana sudah berjalan atau berfungsi apabila sudah
ada sangkaan telah terjadi suatu tindak pidana. Sebagai ilustrasi, dapat dijelaskan
kasus rekaan dan kasus konkrit di bawah:
