Abstract
Transplantation is the transfer of body organs that still have a healthy
vitality to replace body organs that are unhealthy and no longer
functioning properly. At this time too, there are efforts to give organs to
people who need them, even if the person is not undergoing treatment,
namely for people who are blind. This is specifically an eye donor for
blind people. In carrying out an organ transplant, there are three parties
involved: first, the donor, namely the person who donates their healthy
organs to be paired with another person whose organs are suffering from
illness or an abnormality. Second: recipient, namely a person who
receives organs from a donor who, for one reason or another, has to have
their organs replaced. Third, the expert team, namely the doctors who
handle transplant operations from the donor to the patient. Human organ
transplantation is a new problem that has never been studied by classical
jurists regarding its laws. Because this problem is the offspring of
scientific advances in the field of limb transplantation, where modern
doctors can produce amazing results in removing body organs from
living/dead people and transplanting them into other people who have lost
their organs or are damaged due to illness and disease. so on which can
function exactly as if the limb was in its place before it was taken.
