PAYMENT SCHEDULE JADWAL PEMBAYARAN

The Seller, The Buyer may sell or otherwise
dispose of them for The Buyer account. The unit
price for the rejected Products may be debited
against the invoice covering the shipment in which
such Products were included.

atas biaya dan risiko Pihak Penjual. Jika setelah 30
hari Produk tersebut belum direklamasi oleh Pihak
Penjual, Pihak Pembeli dapat menjual atau
membuangnya untuk kepentingan Pihak Pembeli.
Harga satuan untuk Produk yang ditolak dapat
didebit terhadap faktur yang mencakup
pengiriman di mana Produk tersebut dimasukkan.

 ARTICLE 10 PASAL 10
Liability For Delay By The Seller Tanggung Jawab Pihak Penjual Atas
Keterlambatan

In case of delayed delivery except for Force
Majeure cases, The Seller shall pay to The Buyer
for every week of delay penalty amounting to
0.5% of the total value of the Product whose
delivery has been delayed. Any fractional part of a
week is to be considered a full week. The total
amount of penalty shall not, however, exceed 5%
of the total value of the Product involved in late
delivery. If the delay is more than 10 weeks, The
Buyer is entitled to terminate this Contract.
However, The Seller will still be responsible for
above mentioned penalties. Vice versa, in case
The Buyer delay the payment or issue of L/C due
to The Buyer’s reason, The Seller will not be
responsible for late delivery. If The Seller does not
deliver Equipment, The Buyer is entitled to
withhold any pending payment to The Seller.
Dalam hal keterlambatan pengiriman kecuali
terjadi Keadaan Kahar, Pihak Penjual harus
membayar kepada Pihak Pembeli untuk setiap
minggu keterlambatan penalti sebesar 0,5% dari
total nilai Produk yang pengirimannya telah
ditunda. Setiap bagian fraksional dalam satu
minggu harus dianggap satu minggu penuh.
Jumlah total denda tidak akan melebihi 5% dari
total nilai Produk yang tercantum dalam
pengiriman. Jika keterlambatan lebih dari 10
minggu maka Pihak Pembeli berhak untuk
membatalkan Kontrak ini. Namun Pihak Penjual
tetap akan bertanggung jawab atas denda yang
disebutkan di atas. Begitu juga sebaliknya, jika
Pihak Pembeli menunda pembayaran atau
pencairan L / C karena alasan Pihak Pembeli, Pihak
Penjual tidak akan bertanggung jawab atas
keterlambatan pengiriman. Jika Pihak Penjual
tidak mengirimkan Produk, Pihak Pembeli berhak
untuk menahan pembayaran yang tertunda
kepada Pihak Penjual.

PASAL 11 PASAL 11
