Ringkasan Draf Peraturan

Draf Peraturan Keselamatan dan Kesihatan Pekerjaan (Jentera Berbahaya) 20XX

Selari dengan perkembangan semasa teknologi masa kini pelbagai penemuan baru
telah dihasilkan dalam usaha untuk terus memperbaiki aspek kehidupan manusia.
Dalam konteks pembangunan industri pelbagai jenis bahan dan jentera pengeluaran
baru telah dihasilkan untuk meningkatkan produktiviti sesebuah organisasi.

Mengambil kira perkembangan ini dan masalah semasa yang berkaitan dengan
penggunaan jentera-jentera di sesuatu tempat kerja atau pun di tempat-tempat awam,
Jabatan Keselamatan dan Kesihatan Pekerjaan telah mengambil inisiatif untuk
membangunkan satu draf peraturan bagi tujuan ini. Draf iniyang dinamakan sebagai
Peraturan Keselamatan dan Kesihatan Pekerjaan (Jentera Berbahaya )20XX dan
bertujuan untuk menangani isu-isu keselamatan berkaitan dengan penggunaan suatu
jenis jentera. Peraturan yang dibangunkan ini merangkumi jentera berbahaya
sepertimana berikut :-

¾ Dandang Setim
¾ Pengandung Tekanan Tak Berapi
¾ Pengandung Tekanan Berapi
¾ Lif Penumpang
¾ Eskalator, Walklator dan Dumbwaiter
¾ Lain-lain mesin angkat

Peraturan ini di bangunkan adalah gabungan semua peraturan sedia-ada seperti


Peraturan Dandang Stim dan Pengandung Tekanan Tak Berapi, Kilang dan Jentera
1970 dan Peraturan (Lif Penumpang Elektrik dan Barang) Kilang dan Jentera 1970
serta menyediakan kehendak baru bagi jentera mesin angkat. Peraturan ini adalah
dicadangkan untuk diwartakan di bawah peruntukan Akta Keselamatan dan Kesihatan
Pekerjaan 1994, dan Peraturan ini turut merangkumi kehendak-kehendak teknikalnya
yang relevan dengan perkembangan teknologi semasa.

Peraturan ini terbahagi kepada 12 bahagian yang mana seterusnya di perincikan


didalam 46 kehendak-kehendak. Kehendak-kehendak am yang berkaitan dengan
kesemua jentera-jentera berbahaya tersebut telah dikenalpasti dan memasukkan
kehendak-kehendak khusus untuk sesuatu jenis jentera berbahaya sepertimana yang
dinyatakan di atas.

Secara amnya fokus kawalan Peraturan ini merangkumi perkara-perkara berkaitan


dengan rekabentuk, pembuatan, pengubahsuaian, pembaikan, ujian dan pemeriksaan,
pengendalian dan penyelenggaraan jentera-jentera berbahaya termasuk keperluan ciri-
ciri keselamatan yang perlu diadakan.

Kehendak tersebut pula adalah samada dalam bentuk kehendak am bagi jentera
berbahaya atau kehendak khusus untuk jenis suatu jentera tersebut. Kesemua
kehendak tersebut telah dikenalpasti dan dimasukan sebagai peruntukan dalam
Peraturan ini.

Kewajipan sebagai pemunya, penduduk atau ‘duty holder’ terhadap mana-mana jentera
berbahaya juga telah dikenalpasti. Perekabentuk, Pembuat dan Pembekal juga
mempunyai kewajipan mereka yang tertentu dalam usaha memastikan jentera-jentera
bahaya ini direkabentuk, dibina dan dibekalkan kepada pengguna untuk digunakan
dengan selamat dan tanpa risiko kesihatan.

Kesimpulannya adalah diharapkan kehendak-kehendak peraturan ini dapat membantu


pihak pemunya, penduduk atau ’duty holder’ mana-mana jentera berbahaya di dalam
mengurus dan memastikan keselamatan dan kesihatan semasa pengendalian mana-
mana jentera berbahaya di tempat kerja mereka masing-masing ataupun
penggunaannya di tempat-tempat awam.

PART I – PRELIMINARY

„ Interpretation - Examples of the interpretations are “Accepted International


Standards”,”Approved firm”, “Approved manufacture”, “Authorised Inspection
Authority”,” duty holders” and others.

„ Application – The proposed Regulations applies to every dangerous


machinery.

PART II – GENERAL

„ Manufacture and Modification of the Dangerous Machinery

- Those who manufacture or modify Dangerous Machinery must get the


permission in writing from Director General.

- The design, materials, construction, workmanship, inspection and testing for all
dangerous machinery must comply with design codes, standards or specification
which was approved by the Director General.

- For steam boiler, the design, construction, erection, inspection and testing must
be review, supervision and witness by Authorised Inspecting Authorities .

„ Approved firm

- All work pertaining to repair, erect, maintainace, modify and or dismantle of any
dangerous machinery must be done by a registered and approved firm.

„ Competent Person- must registered with Director General

„ Authorised Inspecting Authority - must be approved and registered by Director


General.

„ Cancellation of Approval - Director General may revoke any approval given


when the manufacturer or repairer failed to comply any condition set-by Director
General.

„ Imported Dangerous Machinery


Conditions for Imported Dangerous Machinery are:

i. The machinery is new.


ii. For second-hand machinery, the importer or owner must proved the
machinery is safe to use and established the remnant life of the
machinery.
iii. The design, materials, construction, workmanship, inspection and testing
of any dangerous machinery must comply with design codes, standards or
specification which was approved by the Director General and also to be
review, supervise and witness by approved Authorised Inspecting
Authorities.

„ Approval of Design and Modification – by Director General of DOSH

„ Approval of Repair – by DOSH’s Director

„ Installation of Dangerous Machinery – approved by DOSH’s Director

„ Certificate of Fitness – Every Dangerous Machinery operated must have a


valid Certificate of Fitness with the validity period of 24 months.

„ Operation and Maintenance – to comply with Malaysian Standard or


International Standard and manufacturer’s recommendation

„ Training for Operator of Dangerous Machinery – Dangerous machinery to be


operated by trained person

PART III – DUTIES OF OCCUPIER, OWNER OR DUTY HOLDER

„ Information to be Held by Occupier, Owner or Duty Holder – The


informations are: approved design, Certificate of fitness, reports pertaining to
dangerous machinery and other relevant information. These informations should
be kept in good order.

„ Duties in Relation to Operation and Maintenance

- to ensure that the dangerous machinery is operated safety and within the limit

- to ensure that the dangerous machinery operated have a valid certificate of


fitness
-to ensure that after any repair or modification, the dangerous machinery is not
operated unless with a valid new certificate of fitness.

PART IV – DUTIES OF DESIGNER, MANUFACTURER AND SUPPLIER

„ Duties of Designer – To ensure that:

i. The machinery is safe when operated to its intended purpose


ii. Determine and specify the hazard level
iii. Determine and specify the life of the machinery
iv. To include, manufacturing, fabrication, inspection and testing
requirements

„ Duties of Manufacturer – to fabricate according to approve design and to


comply with the requirements set upon the machinery.

„ Duties of Supplier – to ensure the machinery was designed, fabricated,


inspected and tested according to a standard code.

„ Duties Relating to Provision of Information ie :

i. Designer to make sure manufacturer received the information.


ii. Manufacturer to make sure supplier received the information.
iii. Supplier to make sure owner, occupier or duty holder received the
information.

“Information” are those documents pertaining to safety procedures and


requirements related to design, manufactured, fabrication and inspection.

PART V – DUTIES OF APPROVED FIRM AND COMPETENT PERSON

„ Duties of Approved Firm – to ensure that the works of erection, maintenance,


repair and dismantle are safe and with risk to health.

„ Competent Person – to ensure that the operation, maintenance and inspection


are safe and without risk to health.

PART VII – DUTIES IN RELATION TO UNSAFE DANGEROUS MACHINERY

„ Duties of Employee – to notify the employer of any unsafe dangerous


machinery.
„ Investigation of Potentially Unsafe Dangerous Machinery – Employer to
investigate when he is aware that the dangerous machinery is unsafe and
not to put in service unless the unsafetyness was removed.

PART VII – STEAM BOILER, FIRED PRESSURE VESSEL AND UNFIRED


PRESSURE VESSEL

„ Essential Fittings
i. Boilers – minimum of 6 essential fittings
ii. Fired and unfired pressure vessels – minimum of 3 essential fittings.

„ Competent Person to Operate Steam Boiler – Every steam boiler operation


must be under the charge of a compentent person.

PART VIII – LIFT, ESCALATOR, WALKALATOR AND DUMBWAITER

„ Owner’s or Duty Holder’s Liability


i. Make an agreement with approved firm for periodic examination and
maintenance, and shall also state the name of the competent person.
ii. To inform an officer the date of commencement and expired of the
agreement.
iii. Period of agreement shall not be less than 1 year.

„ Compentent person to erect, inspect, test and maintain lift,


escalator,walkalator and dumbwaiter.
- The lift shall be examine thoroughly at least once in every six months
- The lift shall be service and adjusted once a month.

PART IX – HOISTING MACHINE

„ Competent Person to Erect, Inspect, Test, Maintain and operate hoisting


machine.
- The hoisting machine shall be examine thoroughly at least once in every six
months
- The hoisting machine shall be service and adjusted once a month.
- Tower crane, crawler crane,mobile crane mobile elevating work platform shall
be operated by a competent crane operator.
„ Dismantling of Hoisting Machine - To dismantle tower crane dan passenger
hoist, must get a written permission from Director General.
„ Hoisting Tackles – The design and construction of hoisting tackles must comply
with requirements of Malaysian Standard or International Standard and
manufacturer’s recommendation.

„ Hoisting Machines Not to Carry Person – Hoisting machines are not allowed
to carry person except to those which are exclusively designed and fabricate for
such purpose.

PART X – MISCELLANEOUS

„ Registration Number - Every dangerous machineries must have the


Government registration number.

„ Dangerous Machinery No Longer in Used – When any dangerous machinery


are no longer in used, the owner or occupier or duty holder of any dangerous
machinery shall inform the Director within 1 month of cease operation.

PART XI – PENALTY

The proposed penalty imposed range from a fine of RM1000.00 to RM 50,000.00 and
imprisonment from 3 months to 2 years.

PART XII-PROCESSING, INSPECTION AND TESTING FEES

„ Processing Fees

The proposed fees charge for processing an applications are:


i. Design approval, modification or repair of dangerous machinery: RM
500.00
ii. Registration or renewal of competent person: RM 100.00
iii. Approval or renewal as manufacturer or as approved firm: RM 3000.00
iv. Approval or renewal of Authorised Inspection Authority:RM 3000.00

„ Inspection Fees

The proposed fees charged for inspection of:

1. Steam boiler and Fired Pressure Vessel


i. Electrode boiler or autoclave: RM 100.00
ii. Steam boiler with heating surface of 50 m2 and below: RM250.00
iii. Steam boiler with heating surface above 50 m2 but below 100 m2:
RM 500.00
iv. Steam boiler with heating surface above 100 m2: RM 800.00.
2. Unfired Pressure Vessel
i. Cubic capacity of 1 m3 and below: RM 50.00
ii. Cubic capacity of more 1 m3 but below 10 m3 : RM 100.00
iii. Cubic capacity of 10 m3 and above: RM 200.00

3. Hoisting Machine
i. Safe working load below 4,000 kgs: RM100.00
ii. Safe working load above 4,000 kgs but below 15,000 kgs: RM 150.00
iii. Safe working load above 15,000 kgs but below 30,000 kgs: RM 200.00
iv. Safe working load above than 30,000 kgs: RM 300.00

4. Lifts
i. Travel distant of 30 m and below: RM 200.00
ii. Travel distant above 30 m but below 140 m : RM 400.00
iii. Travel distant of above 140 m : RM 600.00

5. Escalators, dumbwaiter and walkalator: RM 100.00

„ Testing Fees – The charge fee for conducting hydrostatic test or pneumatic test
is half of the inspection fees.
