SCOPE OF PEST CONTROL
Pasal 1
RUANG LINGKUP PENGENDALIAN HAMA

2.1 The work area covers the entire factory area of PT.

2.3 If there is an addition of a building or an expansion of an

Article 3

3.1. The Second Party provides manpower to carry out their

3.2. The schedule for carrying out the work is submitted by

3.3. If there is a change in schedule, both parties will
coordinate no later than 3 (three) working days prior to
implementation by prioritizing the schedule of activities
taking place in the First Party.
3.4. The First Party can contact the Second Party if there are
problems related to "Pest Management" work. The Second
Party will make every effort to resolve the problem within
a maximum period of 1 (one) x 24 (twenty four) hours
after the request was submitted.
Article 4
EQUIPMENT AND CHEMICALS
4.1. To carry out their work, Second Party Officers are
equipped with the appropriate equipment listed in the
"Equipment List - External & Internal Area" listed in the
Standard Operational Procedure ( SOP ) of PT Orcid
Mantis Indonesia, which is an integral part of this
agreement.
4.2. The chemicals used are listed in the "Preparation List -
External & Internal Area" listed in the Standard
Operational Procedure (SOP) of PT Orcid Mantis
Indonesia, as well as use according to the applicable
Material Safety Data Sheet (MSDS).
Article 5
DOCUMENTATION
The Second Party documents all Pest Management Service
work in the following documentation standards:
a. Service Slip Report
Service Slip Report is made and submitted by a second
party technician every time a service is carried out, in the
form of:
• Layout Monitoring Report (pest activity per
monitoring station and treatment carried out);
• Recommendation Reports;
b. Pest Progress Report
Reports are made every 1 (one) month to evaluate the
implementation of the Pest Management Service along
with recommendations.
c. Quality Reviews
Presentation of Quality Review Pest Management
Service every 3 (three) months by Second Party
Technical Support.
d. Pest Awareness Training
Performed 1 (one) time in 1 (one) year contract period.
e. Audit Assistance
• Audit Assistance maximum 2 (two) times in 1
(one) year contract period.
• Audit assistance is carried out by the Second Party
at the request of the First Party which is submitted
no later than 7 (seven) days before its

3.3. Apabila terjadi perubahan jadwal, kedua belah pihak
akan melakukan koordinasi paling lambat 3 (tiga)
hari kerja sebelum pelaksanaan dengan
memprioritaskan jadwal kegiatan yang berlangsung
di Pihak Pertama.
3.4. Pihak Pertama dapat menghubungi Pihak Kedua
apabila terdapat persoalan yang berhubungan dengan
pekerjaan “Pest Management”. Pihak Kedua akan
berusaha semaksimal mungkin menanggulangi
masalah tersebut dalam waktu paling lama 1 (satu)
x 24 (dua puluh empat) jam sejak permintaan
disampaikan.
Pasal 4
PERLENGKAPAN DAN BAHAN KIMIA
4.1. Untuk melakukan pekerjaannya, Petugas Pihak
Kedua dilengkapi dengan perlengkapan sesuai
tercantum dalam“Equipment List – External &
Internal Area” yang tercantum dalam Standard
Operational Procedure ( SOP ) PT Orcid Mantis
Indonesia, yang merupakan bagian tidak terpisahkan
dalam perjanjian ini.
4.2. Bahan Kimia yang digunakan tercantum dalam
”Preparation List – External & Internal Area” yang
tercantum dalam Standard Operational Procedure
( SOP ) PT Orcid Mantis Indonesia, serta
penggunaan menurut Material Safety Data Sheet
(MSDS) yang berlaku.
Pasal 5
DOKUMENTASI
Pihak Kedua mendokumentasikan seluruh pekerjaan Pest
Management Service dalam standard dokumentasi sebagai
berikut :
a. Service Slip Report
Service Slip Report dibuat dan diserahkan oleh teknisi
Pihak kedua setiap kali pelaksanaan service, yang
berupa:
 Laporan Layout Monitoring (aktivitas pest per
monitoring station dan treatment yang dilakukan);
 Recommendation Report;
b. Pest Progress Report
Laporan dibuat setiap 1 (satu) bulan untuk mengevaluasi
pelaksanaan Pest Management Service disertai
rekomendasi.
c. Quality Review
Presentasi Quality Review Pest Management Service
setiap 3 (tiga) bulan oleh Technical Support Pihak
Kedua.
d. Pest Awareness Training
Dilakukan 1 (satu) kali dalam 1 (satu) tahun periode
kontrak.
e. Pendampingan Audit
 Pendampingan Audit maximal 2 (dua) kali dalam 1
(satu) tahun periode kontrak.
 Pendampingan audit dilakukan oleh Pihak Kedua
atas permintaan Pihak Pertama yang disampaikan
paling lambat 7 (tujuh) hari sebelum pelaksanaannya;

Pasal 7
Article 7 MASA BERLAKU PERJANJIAN
VALIDITY OF THE AGREEMENT
7.1. Masa berlakunya Surat Perjanjian Kerja ini adalah 24
(Dua Puluh Empat) bulan terhitung mulai tanggal 1

7.3. This agreement can be extended for a certain period of
time based on a written agreement between the two parties
at least 30 calendar days prior to the expiration date of the
agreement. If less than 30 calendar days there is no
agreement between the two parties for extension or
termination, then the period of this cooperation agreement
will automatically continue for at least the next 1 year.
Article 8
ASSESSMENT STANDARDS & WORK SKILLS
8.1. The Parties agree that the Pest & Rodent Management
work is carried out by the Second Party at the First
Party's place which will be adjusted to the quality of
Pest Management in a professional manner to meet.
8.2. The First Party is obliged to maintain good
environmental sanitation in order to support the pest
control program.
8.3. The Second Party provides manpower according to the
required qualifications, has good quality and
competence and provides the Safety, Occupational
Health and Environmental equipment needed by the
Second Party.
8.4. The Second Party carries out Pest & Rodent
Management work by complying with Safety,
Occupational Health, Environment and Energy
(K3Len) and Labor regulations set by the First Party,
applicable laws and regulations and other related
requirements while carrying out work or activities in
the First Party's area.
8.5. The Second Party guarantees that all treatment carried
out at the First Party's location is safe, does not carry
out a process or activity that can cause environmental
pollution, whether water, soil or air.
8.6. The Second Party in carrying out its work must pay
attention to health, safety and protection of the
environment and wear Personal Protective Equipment
(PPE) and follow applicable instructions.
8.7. The Second Party guarantees maintenance or insurance
costs for employees who experience work accidents
while working in the First Party's area.
8.8. Work carried out by the Second Party either in part or
in whole is not permitted to be subcontracted to other
Third Parties without prior written permission from the
First Party.
8.9. The Second Party evaluates the work done by the
Second Party's technicians. This assessment is carried
out by the Second Party Service Supervisor, where this
assessment is internal.
8.10. Both parties agreed to jointly conduct a review to
assess the quality of pest control work every 3 (three)
months.
8.11. If the First Party is dissatisfied with the performance
and/or work results of the Second Party, then the First
Party has the right to give the 1st Warning Letter in

berlaku sampai diselesaikannya kewajiban tersebut
oleh masing-masing Pihak.
7.3. Perjanjian ini dapat diperpanjang untuk jangka waktu
tertentu berdasarkan kesepakatan tertulis antara
kedua belah pihak minimal 30 hari kalender sebelum
tanggal berakhirnya perjanjian. Jika kurang dari 30
hari kalender belum adanya kesepakatan antara kedua
belah pihak untuk perpanjangan atau pengakhiran,
maka periode perjanjian kerjasama ini otomatis
berlanjut sampai minimal 1 Tahun berikutnya.
Pasal 8
STANDARD PENILAIAN & KECAKAPAN KERJA
8.1. Para Pihak menyetujui bahwa pekerjaan Pest & Rodent
Management dilaksanakan oleh Pihak Kedua di tempat
Pihak Pertama yang akan disesuaikan dengan mutu
Pest Management secara professional untuk memenuhi
standar yang dibutuhkan.
8.2. Pihak Pertama berkewajiban menjaga sanitasi
lingkungan dengan baik guna mendukung program
pengendalian hama.
8.3. Pihak Kedua menyediakan tenaga kerja sesuai dengan
kualifikasi yang diperlukan, memiliki kualitas dan
kompeten yang baik serta menyediakan peralatan
Keselamatan, Kesehatan Kerja dan Lingkungan yang
dibutuhkan oleh Pihak Kedua.
8.4. Pihak Kedua melaksanakan pekerjaan Pest & Rodent
Management dengan mematuhi peraturan Keselamatan,
Kesehatan Kerja, Lingkungan dan Energi (K3Len) dan
Ketenagakerjaan yang telah ditetapkan oleh Pihak
Pertama, peraturan perundangan yang berlaku dan
persyaratan terkait lainnya selama melakukan pekerjaan
atau aktivitas di area Pihak Pertama.
8.5. Pihak Kedua menjamin bahwa semua treatment yang
dilakukan di lokasi Pihak Pertama aman, tidak
melakukan suatu proses atau aktivitas yang dapat
menimbulkan pencemaran lingkungan baik air, tanah,
maupun udara.
8.6. Pihak Kedua dalam melaksanakan pekerjaanya harus
memperhatikan kesehatan, keselamatan serta
perlindungan terhadap lingkungan serta mengenakan
Alat Pelindung Diri (APD) dan mengikuti instruksi
yang berlaku.
8.7. Pihak Kedua menjamin perawatan atau biaya asuransi
bagi karyawannya yang mengalami kecelakaan kerja
selama bekerja di area Pihak Pertama.
8.8. Pekerjaan yang dilaksanakan oleh Pihak Kedua baik
sebagian ataupun seluruhnya tidak dibenarkan untuk
disubkontrakan kepada Pihak Ketiga lainnya tanpa ijin
tertulis terlebih dahulu dari Pihak Pertama.
8.9. Pihak Kedua melakukan penilaian atas pekerjaan yang
telah dilakukan oleh teknisi Pihak Kedua. Penilaian ini

dimana penilaian ini bersifat internal.
8.10. Kedua belah pihak sepakat untuk melakukan review
secara bersama-sama untuk menilai kualitas hasil
pekerjaan pengendalian hama setiap 3 (tiga) bulan
sekali.
8.11. Apabila Pihak Pertama tidak puas terhadap kinerja
dan/atau hasil kerja Pihak Kedua, maka Pihak Pertama
berhak memberikan Surat Teguran ke-1 secara tertulis
kepada Pihak Kedua untuk memperbaiki kualitas kerja
selama 14 hari kerja lamanya. Jika Pihak Kedua belum
bisa memperbaikinya, maka Pihak Pertama berhak
memberikan secara tertulis Surat Teguran Kedua
sampai Surat Teguran Ketiga dalam jangka waktu

been able to fix it, then the First Party has the right to
give a written Warning Letter to the Second to the
Third Warning Letter within a period of 14 working
days respectively, and if the Second Party has not been
able to improve the quality of its work within the
agreed time, then The First Party has the right to
provide formal written notification
Article 9
JOB GUARANTEE
9.1. In accordance with the nature of the work, there is no full
guarantee that the extermination will be completed in one
job.
9.2. The Second Party guarantees that it will only use
chemicals approved by the Indonesian Ministry of Health
and related regulations.
Article 10
FORCE MAJEURE
10.1. What is meant by Force Majeure are matters that can
directly or indirectly affect the execution of work that
occur beyond human control/ability and cannot be
predicted in advance. Matters that can be classified
under force majeure circumstances are events that
include, but are not limited to:
a. Natural disasters (earthquakes, floods,
epidemics).
b. Acts of sabotage, war, national riots.
c. Government actions in the economic and
financial fields.
d. Continuous rainfall that hinders the
implementation of work.
10.2. Force Majeure must be notified in writing by the Party
affected by the Force Majeure to the other Party within
fourteen (14) calendar days since the occurrence of the
situation/event, including valid evidence from the
competent authority and the consequences for the work.
If within 7 (seven) calendar days after receiving the
notification the Party receiving the notification does not
provide a response to the Party affected by Force
Majeure, then that Party is deemed to
agree/acknowledge the existence of a force majeure as
conveyed by the Party affected by Force Majeure.
10.3. If a Force Majeure occurs, then the Party is released
from obligations pending during the period arising as a
result of the event, but is not released from each of its
obligations prior to the occurrence of the Force
Majeure. Both parties agree that if a Force Majeure
occurs for one (1) consecutive month, renegotiations
will be held regarding the actions that must or will be
taken in connection with the Force Majeure incident.

Pasal 9
JAMINAN PEKERJAAN
9.1. Sesuai dengan sifat pekerjaannya, maka tidak ada
jaminan sepenuhnya bahwa pembasmian tersebut
akan tuntas dalam satu kali pekerjaan.
9.2. Pihak Kedua menjamin bahwa hanya akan
menggunakan bahan kimia yang disetujui oleh
Departemen Kesehatan Indonesia serta peraturan
terkait yang berlaku.
Pasal 10
FORCE MAJEURE
10.1. Yang dimaksud dengan Force Majeure ialah hal-hal
yang secara langsung maupun tidak langsung dapat
mempengaruhi pelaksanaan pekerjaan yang terjadi
diluar kekuasaan / kemampuan manusia serta tidak
dapat diduga sebelumnya.
Hal-hal yang dapat digolongkan dalam keadaan force
majeure adalah peristiwa-peristiwa yang termasuk,
tetapi tidak terbatas pada :
a. Bencana alam (gempa bumi, banjir, wabah
penyakit).
b. Tindakan sabotase, peperangan, huru –
hara nasional.
c. Tindakan pemerintah dalam bidang
ekonomi dan keuangan.
d. Curah hujan yang terus menerus sehingga
menghambat pelaksanaan pekerjaan.
10.2. Force Majeure harus diberitahukan secara tertulis
oleh Pihak yang terkena Force Majeure kepada
Pihak lainnya dalam waktu empat belas (14) hari
kalender sejak terjadinya keadaan / peristiwa tersebut
, dengan menyertakan bukti-bukti yang sah dari
instansi yang berwenang serta akibatnya pada
pekerjaan. Apabila dalam waktu 7 (tujuh) hari
kalender setelah menerima pemberitahuan tersebut
Pihak yang menerima pemberitahuan tersebut tidak
memberikan jawaban kepada Pihak yang terkena
Force Majeure, maka Pihak tersebut dianggap
menyetujui/mengakui adanya keadaan yang memaksa
seperti yang disampaikan oleh Pihak yang terkena
Force Majeure.
10.3. Jika terjadi Force Majeure, maka Pihak tersebut
dibebaskan dari kewajiban yang tertunda selama
masa yang ditimbulkan sebagai akibat dari peristiwa
tersebut, akan tetapi tidak dibebaskan dari masing-
masing kewajibannya sebelum saat terjadinya Force
Majeure tersebut. Kedua belah pihak sepakat bahwa
jika Force Majeure terjadi selama satu (1) bulan
berturut-turut, maka akan diadakan perundingan
kembali mengenai tindakan-tindakan yang harus atau
akan diambil sehubungan dengan kejadian Force
Majeure tersebut.
Pasal 11
PERSELISIHAN
11.1. Apabila terjadi perselisihan sehubungan dengan
Perjanjian Kerja ini, maka kedua belah pihak sepakat

Article 11
DISPUTE
11.1. If there is a dispute related to this Employment
Agreement, then both parties agree to resolve the
dispute by deliberation.
11.2. If settlement through deliberation to reach a consensus
is not reached, then both parties appoint the Karawang
District Court to resolve the dispute.
ARTICLE 12
WORK SAFETY
1. The second party must meet the K3L standards. The first
party is in the first party's area and must fulfill the work
mechanism according to the K3L work standards.
2. The Parties must protect each other in their environment
and the area where the work is carried out from all
risks/injuries that may arise while carrying out work in
their area or the area where the work is related to this
agreement.
3. Occupational risks of accidents that may occur in the
workplace environment or while on duty for the
SECOND PARTY personnel are fully the responsibility
of the SECOND PARTY.
Article 13
CHANGE
13.1. This agreement cannot be modified without the prior
written consent of both parties.
13.2. Matters that have not been regulated in this agreement
will be further regulated in an Amendment or addendum
to the Agreement signed by both parties which is an
integral part of this agreement.

NOTICE AND COMMUNICATION
All notifications and all forms of communication required in
this Agreement must be made in written form and must be sent
by registered letter and/or courier or telex to the Parties at the

untuk menyelesaikan perselisihan tersebut dengan
musyawarah.
11.2. Apabila Penyelesaian melalui musyawarah untuk
mencapai mufakat tidak tercapai, maka dengan ini
kedua belah pihak menunjuk Pengadilan Negeri
Karawang untuk menyelesaikan perselisihan.
PASAL 12
KESELAMATAN KERJA
1. Pihak kedua wajib memenuhi standar K3L Pihak pertama
saat berada di area pihak pertama dan wajib memenuhi
mekanisme kerja sesuai standar kerja K3L.
2. Para Pihak harus saling melindungi dilingkunganya
maupun area tempat pekerjaan tersebut dilakukan dari
segala resiko/cidera yang mungkin timbul selama
melakukan pekerjaan di areanya atau area tempat
pekerjaan tersebut yang berkaitan dengan perjanjian ini.
3. Resiko kerja terhadap kecelakaan yang mungkin terjadi di
lingkungan tempat kerja atau pada waktu bertugas atas
personil PIHAK KEDUA sepenuhnya menjadi tanggung
jawab PIHAK KE
Pasal 13
PERUBAHAN
13.1. Perjanjian ini tidak dapat diubah tanpa persetujuan
tertulis terlebih dahulu dari kedua belah pihak.
13.2. Hal-hal yang belum diatur dalam perjanjian ini akan
diatur lebih lanjut dalam Amandemen atau addendum
Perjanjian yang ditandatangani oleh kedua belah
pihak yang merupakan bagian yang tidak terpisahkan
dari perjanjian ini.
Pasal 14
PEMBERITAHUAN DAN KOMUNIKASI
Semua pemberitahuan dan segala bentuk komunikasi yang
diisyaratkan dalam Perjanjian ini harus dibuat dalam bentuk
tertulis dan harus dikirimkan melalui surat tercatat dan/ atau
kurir atau teleks kepada Para Pihak dengan alamat sebagai

PENUTUP

mempunyai kekuatan hukum yang sama.
